ORDINANCE N0. 18-87
AN ORDINANCE TERMINATING A FRANCHISE TO KOTA CABLE TV
COMPANY OF BROOKINGS, SOUTH DAKOTA.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF
BROOKINGS, SOUTH DAKOTA:
WHEREAS this body adopted an Ordinance granting a Franchise
to KOTA Cable TV Company of Brookings , South Dakota on March 21 ,
1978 which Franchise was approved by the voters of the City of
Brookings and has been amended from time to time thereafter, and
WHEREAS the Franchise Ordinance provided for certain
responsibilities and duties of the Grantee therein, to include
signal quality requirements as specified in Article VIII
thereof, operations and maintenance and Article IX thereof and
said Ordinance further requires payment of certain franchise
fees to the City of Brookings as is set forth in Article XXII
thereof, as amended, and
WHEREAS KOTA Cable TV has failed to responsibly operate
the system in a good and efficient manner and has furthermore
failed to pay in a timely manner all of the franchise fees due
the City of Brookings , now therefore ,
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF
BROOKINGS THAT ORDINANCE N0. 647 OF THE CITY OF BROOKINGS AND
ALL AMENDMENTS THERETO ARE HEREBY CANCELLED AND REPEALED AND
GRANTEES RIGHTS THEREUNDER ARE HEREBY TERMINATED.
