ORDINANCE N0. 1-8fr
AN ORDINANCE ESTABLISHING REQUIREMENTS FOR PET SHELTERS IN
THE CITY OF BROOKINGS, SOUTH DAKOTA.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF
BROOKINGS, SOUTH DAKOTA THAT CHAPTER SEVEN (7) OF THE REVISED
ORDINANCES OF THE CITY OF BROOKINGS SHALL BE REVISED TO INCLUDE
ARTICLE V. as follows, to-wit :
I .
Article V. Pet Shelters
Sec . 7-80. Definition.
For the purpose of interpreting this Article, the following
words , terms and phrases , shall have the meaning set forth
hereinafter .
Pet Shelter . A pen, cage , enclosure or accessory structure
used for the purpose of harboring four (4) to fifteen (15)
pets , such as rabbits , chinchillas or similar animals at
least four (4) months of age, other than dogs, cats , poultry
or domestic livestock .
Sec . 7-81 . Permitted Location.
A pet shelter shall be allowed as an accessory use upon
residential premises in the City subject to the requirements of
this Article.
Sec . 7 -82 . LicensinQ Required.
It shall be unlawful for any person within the city to keep,
maintain or operate a pet shelter without first having obtained a
license therefor from the City Finance Officer or an authorized
agent .
Sec . 7-83 . Inspection Required.
An inspection of the sanitary condition of a proposed
shelter by the Deputy Health Officer or an a.uthorized agent
shall be required prior to the issuance of the initial pet
shelter license.
Sec . 7-84 . Application.
Any person des:iring to keep, maintain or operate a pet
_ shelter shall , on or before the thirty-first day of December of
each year, make application to the City Finance Officer or an
authorized agent for a license for such pet shelter . Such appli -
cation shall Le in writing stating the name and address of the

applicant , the location of the pet shelter, a description of
the type and number of animals being harbored and the purpose of
raising said animals . The application shall be raade on a
printed blank furnished by the city finance officer or an
authorized agent and shall be filed with the city finance
officer or an authorized agent .
Sec . 7-85. Fee.
Before any license shall be issued under the provisions of
this Chapter, the applicant shall pay to the City Finance Officer
or an authorized agent , a fee for each pet shelter to be licensed.
The annual fee for said license shall be $10 . 00.
Sec . 7-86 . Commercial pet shelter prohibited.
It shail be unlawful to maintain or operate a pet shelter as
a commercial enterprise.
Sec . 7-87 . Number of pets limited.
It shall be unlawful to maintain or operate more than fif-
teen (15) pets over four (4) months of age in a pet shelter.
Sec . 7-88 . Adequate facilities required.
It shall be unlawful to maintain or operate a pet shelter
without adequate pens, feeders and waterers.
Sec . 7-89. Rit�ht of Entry.
The Board of Health or its authorized representatives shall
have the right to inspect any pet shelter at any reasonable hour
for the purpose of enforcing the provisions of this Chapter.
Sec . 7-90. Revocation of License .
A license may be revoked for any of the following reasons :
1 . Substantiated complaints to the board of health by adja-
cent neighbors about odor or noise .
2 . Unsanitary conditions as determined by the board of
health or its representative.
3 . Submission of false information upon application for a
license .
4 . Any violation of the provisions of this Chapter.
Sec . 7-91 . RiAht of Appeal.
In the event a pet shelter license is not issued upon initial
application therefor or is revoked, the applicant may appeal the

decision to the City Commission. Any decision of the City
Commission shall be final.
III .
Any and all ordinances in conflict herewith are hereby
repealed .
