HomeMy WebLinkAboutOrdinance 08-1989 • ORDINANCE N0.8-89 AN ORDINANCE OF THE CITY OF BROOKINGS, SOUTH DAKOTA, AMEND- ING ARTICLE III OF CHAPTER 10, OF THE CODE OF ORDINANCES OF THE CITY OF BROOKINGS, SOUTH DAKOTA, PERTAINING TO HOUSE MOVING. I . That Section 10-42 of the Brookings Ordinances shall be amended to read as follows: (a) Except as hereafter provided, no moving permit shall be issued until the notice of application has been given by publication in the official newspaper at least five (5) days prior to the date when such application shall be considered and by mailing a copy of said notice to owners of real estate adjoining the real estate upon which the building or structure is to be moved. Said notice shall state the time and place of said hearing and in general terms, a description of the building to be moved and the location. All requests for moving permits shall be accompanied by a deposit of twenty- five dollars ($25.00) which shall be used to defray the expenses of administrative preparation. II . That Section 10-55 of the Brookings Ordinances shall be amended to read as follows: (a) The applicant for a license for house moving shall file with the city Finance Officer a certificate of insur- ance which indemnities the public against loss by negligence of the applicant or his agents in the sum of not less than one hundred thousand dollars ($100, 000.00) to any one person and three hundred thousand dollars ($300, 000.00) in any one accident, for both bodily injury and property damage, and the form and content of such policy is approved by the city commission and the policy is written by an insurance company approved by the city commission; and condi- tioned that the applicant, if a license be granted to him, will conform to all requirements relating thereto which are now or may be hereafter established by the city commission; and that he will promptly repair and make good to the satisfaction of the commissioner in charge of streets and alleys all damage to any pave- ment, sidewalk, crosswalk, hydrant, street, alley or other public property done or caused by himself, his servants or employees in moving any building or in connection with the moving thereof; and that he will indemnify and save harmless expenses arising or which may arise in favor of any person or persons by reason of any negligence or misdemeanor on his part or the part of his servants or employees in connection with the moving of any building or the use of any public street or ground for that purpose. III . That sections and ordinances in conflict herewith are hereby repealed. FIRST READING . May 16, 1989 SECOND READING AND ADOPTION: May 23, 1989 PUBLISHED .
