HomeMy WebLinkAboutOrdinance 19-1990 , , . • � ORDINANCE NO. 19-90 AN ORDINANCE ESTABLISHING A JOINT MUNICIPAL-COUNTY HOUSING AND REDEVELOPMENT COMMISSION FOR THE ADMINISTRATION OF HUD SECTION EIGHT (8) EXISTING CERTIFICATE, VOUCHER, MODERATE REHABILITATION AND OTHER RELATED HOUSING PROGRAMS. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS, SOUTH DAKOTA, AS FOLLOWS, TO-WIT: I. Article I. Joint Municipal-County Housing and Redevelopment Commission Section 19-1. Created There is hereby created and established in and for the city a Joint Municipal-County Housing and Redevelopment Commission to administer, contract, control and supervise HUD Section Eight (8) Existing Certificate, Voucher, Moderate Rehabilitation and other related housing programs through the use of municipal, county, state and federal funds, and to jointly exercise any or all powers conferred by SDCL Chapters 11-7 and il-7A. Section 19-2. Composition, appointment. The Housing and Redevelopment Commission provided for by this Article shall be composed of five (5) commissioners. Three (3) of the commissioners shall be duly qualified residents and electors of the City and shall be appointed by the Mayor with the approval of the City Commission and County Commission. Two (2) of said members shall be residents and electors of the County, residing outside the corporate limits of the City, and shall be appointed by the Chairman of the Board of County Commissioners, with the approval of the County Commission and City Commission. Section 19-3 . Terms The members of the Housing and Redevelopment Commission shall be initially appointed for terms of one (1) , two (2) , three (3) , four (4) and five (5) years respectively; provided, at the first meeting in May of each year, one member shall be appointed. Thereafter, all commissioners shall be appointed for five (5) year terms. Each vacancy in an unexpired term shall be filled in the same manner in which the original appointment was made. Section 19-4. Ex officio Members One member each of the City Commission and County Commission to whom housing matters relate shall be assigned as ex officio members of the Housing and Redevelopment Commission. r , � ' • � i � Section 19-5. Meetincrs The Housing and Redevelopment Commission shall hold meetings at least once each calendar quarter at a time and place to be established each year at the annual meeting. Special meetings may be called at any time by the Chairman by giving at least twenty-four (24) hours advance notice in accordance with SDCL 1-25-1. 1. Section 19-6. 4uorum of Commission/Officers/Rules. The Powers of the Housing and Redevelopment Commission shall be vested in the commissioners thereof in office at any time; a majority of whom shall constitute a quorum for all purposes. Each commission shall select a chairman, a secretary, and a treasurer from among its commissioners, who shall hold their offices respectively for one (1) year and until their successors have been appointed. The Commission shall adopt such by-laws and other rules for the conduct of its affairs as it deems appropriate. Section 19-7. Expense of Commissioners. No commissioner shall receive compensation for his services, but each commissioner shall be entitled to receive necessary expenses, including traveling expenses, incurred in the performance of his duties. Section 19-8. Commission as Body Corporate/General Powers. The Housing and Redevelopment Commission shall be a public body corporate and politic, exercising public and essential governmental functions, and shall have all the power necessary or convenient to carry out the purposes set forth herein, together with the powers granted by SDCL Chapter 11-7 and 11-7A, inclusive, but the Commission shall not have the power to levy or collect taxes or special assessments. The Housing and Redevelopment Commission shall have the power and authority to superintend, manage, administer and control local, state and federal housing programs within its jurisdiction, including the power to contract with individuals, public or private firms, to administer said housing programs on behalf of this Commission. Section 19-9. Collection of funds. All funds and revenues derived from the operation of the Housing and Redevelopment Commission may be collected by the City Finance Officer and a record of all such funds and revenues shall be submitted at least quarterly to the City Commission and Brookings County Commission. . � , . � ' , ., . II. All ordinances in conflict herewith are hereby repealed.
