AN ORDINANCE PROVIDING RESTRICTIONS ON ISSUANCE OF MALT
BEVERAGE RETAIL DEALER LICENSES IN THE CITY OF BROOKINGS, SOUTH
DAKOTA.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF
BROOKINGS, SOUTH DAKOTA, AS FOLLOWS, TO-WIT:
I.
No malt beverage retail dealer license shall be issued to any
establishment which derives less than seventy-five (75�) percent
of its gross business income, excluding video lottery income, from
the sale of beverages and/or food which is prepared and/or con-
sumed on the premises. Bona fide congressionally chartered
veterans organizations, religious, charitable, educational, or
fraternal organizations, and local or civic clubs , which exist
under the laws of the State of South Dakota, are excluded from the
requirements of this paragraph.
II.
All ordinances in conflict herewith are hereby repealed.

The Lottery is receiving an increasing number of applications for video lottery
establishment licenses for locations that, in the pasi, have not been typically licensed for
the on-sale consumption of alcoholic beverages. The purpose of this memo is to delineate
the respective roies of the local governing bodies and the Lottery regarding video lottery
machine placement in the state. �
It is important to recognize that video lattery machine piacement is restricied by statute
to only those locations licensed fo� the on-sale consumption of alcohoiic beverages. Any
location in possession of an on-sale alcohoiic beverage ticense is initially qualified to
apply to the Lottery for a video lottery establishment ticense.
The Lottery recognizes that the approval and issuance of alcoholic beverage licenses is the �`
exclusive power of the city and county govemments. The local governing bodies have the
authority to decide whether the applicarit is a suitable persort to hold such license and
whether th�locarion is a suitable place for the dispensing and consumption of alcoholic .
bevera es. During the past legislative session,the legislature mcreased the person's age
to 21 for machine piay in accordance with the on-sale licensing requirement.
It is the position of the Lottery Commission that any location licen . . e
consumptiort of alcoholic beverages is a proper piace or video lottery activity on the
bas�s of the local governmg ody s dects�on �n the granting of the on-sale license. The
legis a re, y-b restrici�ng video lottery machine placement to those locations holding an
on-sale alcoholic beverage license, intended for local govemmer�ts to detennine the
suitable environment in which video lattery may be conducied.
Accordingly, the Lottery wiil issue video lottery establishment licenses to those
applicants thaz hold an on-sale alcoholic beverage license and meet all the statutory and ,
regulaiory requirements. Local governments should be aware during thelr proceedings in
considering appiications for an on-sale alcohotic beverage license that the grarti of such
license, in effect. qualifies the location to make application to the Lottery for a video
lottery establishment license.
We hope this explanation of the respective roles of local governmer�t and the Lottery in the
granting oi on-sale aicoholic beverage and video lottery establishments licenses addresses
the questions surrounding piacement of video lottery machines in the state.
