BE IT ORDAIIdED BY THE GOV�RistING BODY �F THE CITY OF BROOKINGS, �OUTH DAKOTA, THAT CHAFTE�t SIK (6) OF THE REVISED ORBINANCE$ OF THE CITY QF BROOKINGS H� AMENDED AS FOLLQW�: I . ARTICLE I . IN GENERAL 3ec. 6-i . Bond or liability in5urance required foar amusement xides. No person shall conduct, operate, m�nag� or spansor any ferris wheel, merry�-go-round ar other amusement ride operated for hire or for th� purpose of pramoting or advertisfng any trade or business, without first filing with the city finance officer a bond or certificate of lfabilitg insurance, in the amount of at least five hundred thousand dollars {$5D0, 000.00) , indemnifying the public against damages sus- tained by reason pf �he operation of such ride. Such bond or certifi- cate of insurance shall be subjec� td approval by the city attorney. This section shall apply tv all persons, whether or not a license i.s required by any other provision of this chapter. ARTICLE II. DANCE HALLS. Sec. 6-37. Definitions. For the purpoges o� this article, the following words and phrases sh��,� have the meanings respectYvely ascribed to them: Public dance. Any dance or ball to which admission can be had by paymer�t of a fee, or by the purchase, ppssession or presentatian of a ticket or token, o� at whicl� a charge is made for the caring for clo�hing or other propertp, or any other dances to which the public generally may gain admission, �rith or rerithout the payment of a fee. Public dance hall . Any roc�m, place or space in which a public d�nce or public ba11 is held, or any room, place or space where dancing is p�rmitted. Sec. 6-38. Licen$e required. It shal� be unlawful for any person to conduct, operate, carry on, k�ep Or maintain a dance hall or place for public dances within the city or within one ( 1) mile from the outer boundary of the same, without first obtai#ing from the city a license there£or. Sec. 6-�9. Chapter �2 applicable. The provisio�s of Chapter� 22, inso�ar as the same may be applica- ble and not in conflict, shall apply to and govern the issuance of any license under the provisions of this ar�icle. 3ec, 6-4Q. AQplication for license. Any person desiring a license required by �his ar�icle shall make application therefor to the city �inance officer. Su�h application in addf�ion to the information required by sec�ion 22-4, shall state the lengtM of time whic� such person de�ires to engage in such business. Sec. b-41. Certain dances forbidden. It shall be unlawful for any person conducting, operating or maintaining a public dance or place where the public is permitted arid a1lQwed to da�ce in the city, or within one (1) mile of the outer boundary of th� same, to permit, suffer or allow any pe�son in su�h h�11 or place to dance or participate in any immodest, suggestive, or immoral dances; and it shall be unlawful for any person or persons in such ha11 or place tp dance or participate in a�y immodest, suggestive or immoral dances or act of any character. Sec. 6-42. Supex�v�ision. The manager, person or operator of any public dance hall or place for public danCes licensed o� having a permit issued under this artic2e, shall allow ar�d permi� unrestr�cted entrance of any police office� of the city, the mayor, or any m�mber of the city commission acting in an offiCial Capacity to enter in and upon such premises at any �time and to remove therefrom any person found �o be intoxicated or in violation of the ordinances of the city. The city commission may require the manager, person or operator of any public dance or dance hall licensed or having a permit issued under this articie, to emplay a matron and/or a police officer to sup�rvise in �nd about such premises the Conduct of the participants and patrons of such premises, and such matron and/or police officer shall be duly appointed upon authority of �he city commis�ion for such duty wfth all duties and pawers of a regularly appointed police officer. The manager, person or oper�tor of such public dance h�ll pr publfc dance shall remi� forthwith to the city finance officer a sum equal to the salary o�' any person appointed to so act as provided herein. Sec. 6-43. Illumination of grot�nds. It sh�all be the duty of the person or manager in charge of a public dance hall, licensed under thi$ arti�le, to provide adequate illumination for the purpose of lighting all the adjoining grounds used by the pasticipants or attendant$ at such dance hall . Sec. 6-44. Biackou�� prohibited, It shall be unlawful for any person or manager in charge of any dance hall or gublic dance, licensed or having a permalt issued under '�his article, to al.low or permit dancing in such dance ha11 Or at su�h dance in the evening with extinguished lights. Sec. 6-45. �'oilet roc�ms. It shall be the duty of the person in charge of any dance hall or public dan�e, licensed or having a permit issu�d under the provisions of thi.s article, to prpvide separate to�let rooms for each sex, which toilet rooms shall be kept in a �lean and sanitary candition. Sec. 6-46. Hours of operation. It shall be unlawful for any person who has obtained a license or permit under the provisions of this article to permit or allow dances to be participated in between the hours of 2 :00 a.m. and 7:00 a.m. DIVISION 2. INDIVIDUAL DANCE PERMIT Sec. 6-57. Required. It shall be unlawful for any person to conduct, operate or carry on any public dance within the city or within one ( 1 ) mile from the outer boundary of the same without first obtaining a permit therefor from the city. Sec. 6-58. Chapter 22 applicable. The provisions of Chapter 22, insofar as the same may be applica- ble and not in conflict, shall apply to and govern the issuance of any permit under the provisions of this division. Sec. 6-59. Application. Any person desiring a permit required by this division shall make application therefor to the city finance officer. Such application, in addition to the information required by section 22-4, shall state the number of public dances the applicant wishes to conduct. Sec. 6-60. Number of dances limited. Each permit issued under the provisions of this division shall be valid only for the number of dances specified therein and for which the required fees shall have been paid. ARTICLE III . CIRCUSES, CARNIVALS, MERRY-GO-ROUNDS. Sec. 6-71. License required. It shall be unlawful for any person owning, managing or operating any circus, menagerie, rodeo, side show, carnival, merry-go-round, amusement ride or similar exhibition to have or exhibit the same within the city without first having procured from the city a license so to do. Sec. 6-72. Chapter 22 applicable. The provisions of Chapter 22, insofar as the same may be applica- ble and not in conflict, shall apply to and govern the issuance of any license under the provisions of this article. Sec. 6-73. Application for license. Any person desiring a license required by this article shall make application therefore to the city finance officer. ARTICLE IV. INDECENT ERPOSURE PROHIBITED. Sec. 6-80. Indecent egposure or Simulation Thereof Prohibited; Licensee' s Duty to Prevent. . � ( 1) It is unlawful for any person or premises licensed for the sale of alcoholic beverages while in the presence of any other person: (a) To fail to conceal , with a fully opaque covering, the sexual parts of his or her body, to include the genitals, pubic area and anus of any person of the nipple and areola of the female breast. (b) To expose any devise, costume or covering which gives the appearance of, or simulates, the genitals or pubic area of the male or female body, or the nipple or areola of the female breast. (c) To allow erotic dancing which simulates sexual activity. (2) It is unlawful for any licensee in alcoholic beverages to cause, allow or permit any person on said licensed premises to violate the provisions of subsection ( 1 ) of this section. (3) It is unlawful for any person or premises licensed for the sale of alcoholic beverages to permit any professional female or male dancer, stripper, or performer to engage in any physical contact with patrons or customers while dancing or performing and all such dancing or performances shall be confined to a stage or designated area separate and apart from the seating area for patrons and customers. (4) Any licensee of alcoholic beverages who violates this Ordinance shall be subject to a fine and a licensee shall be subject to suspension or revocation of its license for such violation whether or not a Complaint for such violation has been issued. II . All ordinances in conflict herewith are hereby repealed. I refer speci�ically to the ar�icle in the Hrookings Register of March 9, 1990 and to i�s publi�ity o� past activities in Nate Brady' s bar but also to any such �ctivities in any Brookings e�tablishment in the fu�ure. I specifically protest the appearance at any time in this city of nude dancers, of sCantiXy dressed dancers including the showing of G strings and pasties, and the presentation of dances suggest��� of sexual activity. I strongly urge the Mayor �o le�d the Commissian in a clearly worded statement of what constitute� indecent ezposure and immoral dances. I urge the Mayor to lead the Comrtission in passing Ordinances which will pr�vent the further appearances of strippers in this city �nd a�y futuse pXesentation ox lewd and suggest�ve dancing. The moral majority in Brookings have both right and responsibility to maintain decency, respect for women and good city government. Please list me as one of the "prudes governing the city" if my vote or my opinion have any effect .
