HomeMy WebLinkAboutOrdinance 02-1990 F .r ('�' , • " � ORDINANCE NO. 2-90 AN ORDINANCE ESTABLISHING A COMMITTEE ON HUMAN RIGHTS IN THE CITY OF BROOKINGS, SOUTH DAKOTA WHEREAS, it is the desire of the governing body of this city to establish a Committee on Human Rights which shall seek to eliminate discrimination in the City of Brookings, and WHEREAS, it is the intent of the governing body that the Commit- tee on Human Rights shall study the extent of discrimination based on race, color, creed, religion, sex, handicap, ancestry, or national origin occurring within the City of Brookings, and that said Committee shall inform the City Commission and the public of discrimination issues and make appropriate recommendations to the City Commission concerning possible solutions to discrimination problems present in the City of Hrookings, and WHEREAS, it is the intent of the governing body that the Commit- tee on Human Rights shall be empowered to hear and investigate com- plaints alleging discrimination and to refer those complaints in which it finds probable cause for discrimination to the appropriate govern- mental agency. NOW THEREFORE, be it ordained by the governing body of the City of Brookings, South Dakota: I . Committee on Human Riqhts Section 2-70. Created. There is hereby created in and for the city a Committee on Human Rights. Section 2-71 . Composition. The Committee on Human Rights shall consist of nine (9) members selected by the City Commission. The City Commission shall give due regard to representation of minority groups on the Committee. Section 2-72. Term of Office. The members of the Committee on Human Rights shall serve without compensation for a term of three (3) years. Section 2-73 . Vacancies. Should a vacancy occur in the Committee on Human Rights, the City Commission shall appoint a member to fill such vacancy for the unex- pired term of the vacancy. If a member is absent from three consecu- tive regular meetings, the member' s seat shall be termed vacant and a new member shall be appointed. �. - :"� Section 2-74. Officers. The Committee on Human Rights shall designate from among its member- ship a Chairperson, Vice Chairperson, Secretary, and such other officers and sub-committees as it may deem appropriate and necessary. Section 2-75. MeetinQs. The Committee on Human Rights shall meet at such times and places as may be determined by said Committee. Section 2-76. Powers Generallv. (a) To study and determine the existence, character, causes, and extent of discrimination in employment, housing accommodations, property rights, education, public accommodations, and public services in the City of Brookings. (b) To advise and provide a forum for those who have been subjected to unfair and discriminatory practices in the City of Brookings. (c) To hear and investigate complaints alleging discrimination and where probable cause for discrimination is found to exist by the committee, to refer the complaint to the appropriate governmental agency. The Committee shall develop rules of procedure subject to approval of the City Commission. (d) To advise the Mayor, City Commissioners, and the respective departments of the city concerning matters consistent with the purpose and powers of the Committee. (e) To conduct educational programs and disseminate information in furtherance of the policy of the Committee to eliminate discrimination in the City of Brookings. ALL ORDINANCES IN CONFLICT HEREWITH ARE HEREBY REPEALED.
