HomeMy WebLinkAboutOrdinance 35-1991 � � , . , ORDINANCE NO. 35-91 AN ORDINANCE REVISING CHAPTER 25 OF THE REVISED ORDINANCES OF THE CITY OF BROOKINGS AND PERTAINING TO GAMBLING IN THE CITY. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS, SOUTH DAKOTA, AS FOLLOWS, TO-WIT: I. ARTICLE V. GAMBLING Section 25-67. Prohibited qenerally. Except as permitted by State law, no person shall in the city, or within one (1) mile of the outer boundaries thereof, play at roulette, poker, blackjack, twenty-one or any other gambling game, dice game, or game of change upon which money or any article of value is staked, or to resort to, attend or be present at any place where such gambling games or games of chance are carried on. Section 25-68. Gamblinq house prohibited. Except as permitted by State law, no person shall in the city, or within one (1) mile of the outer boundaries thereof, keep any building or part of any building to be used or occupied for gambling. An owner, agent or superintendent of any such place shall not knowingly let the same or allow it to be used for gambling. Section 25-69. Operators of qamblinq houses. Except as permitted by State law, no person shall within the city, or within one (1) mile of the outer boundaries thereof act as gamekeeper of or have charge of and manage any gambling game or games of chance upon which money or other articles of value are staked, or act as doorkeeper, solicitor, runner, agent or abettor of or for any house wherein any gambling games or games of chance for money or other articles of value are practiced or allowed to be practiced or carried on. Section 25-70. Maintaininq gamblinq devices prohibited. Except as permitted by State law, it shall be unlawful for any person to maintain, keep or exhibit in the city, or within one (1) mile of the outer boundaries thereof, any slot machine wherein the gain by chance is involved, or any table, cards, dice used or intended to be used in playing any game of cards, dice or other gambling game or game of chance for money or other articles of value. section 25-71. Gamblinq apparatus nuisance. Every article, apparatus or device used, operated or kept in violation of any of the provisions of this chapter, shall be deemed a public nuisance, and may be seized by the officers at the time of the arrest of a person for violation of any provisions of this article, having the same in his possession. Upon conviction of such person for such violation, said gambling apparatus or articles may be destroyed under order of the court. ,, � . � Seation 25-72. Sale of ��chances�� or lottery tickets, etc. , restricted. Except as permitted by State law, no person shall sell or vend or have in possession any lottery tickets or any writing, card, paper or documents in the nature of any bet or wager or chance to share in the distribution of any prize or prizes except that the aforesaid provisions shall not apply to a lottery otherwise permitted by State law or a lottery or bingo game conducted in accordance with the provisions of SDCL 22-25-25. III. Al1 ordinances in conflict herewith are hereby repealed.
