(a) OF THE 1988 EDITION OF THE UNIFORM BUILDING CODE AND PERTAINING TO THE APPOINTMENT OF MEMBERS OF THE BOARD OF APPEALS OF THE CITY OF BROOKINGS, SOUTH DAKOTA. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS, SOUTH DAKOTA, AS FOLLOWS, TO-WIT: I. Section 204. (a) Creation, Kembership, Officers. � 1. A Board of Appeals is hereby established; the members shall be appointed as necessary by the City Commission at the first city commission meeting in January and shall be qualified by experience and training to pass upon matters pertaining to building construction and who are not employees of the jurisdiction. In the event a vacancy occurs on a date prior to the first city commission meeting in January, then the vacancy may be filled by appointment for a term not exceeding five (5) years which shall expire prior to the first city commission meeting in January. 2 . The Board of Appeals shall consist of five (5) members. Each member shall be appointed for a term of five (5) years. Their successors shall be appointed upon the expiration of their respective terms to serve five (5) years. A vacancy shall be filled by the Mayor with concurrence of the City Commission for the unexpired term of any member who resigns, dies or is removed. 3. The Board of appeals shall elect a chairperson and vice-chairperson from its members. The Building Official shall be an ex-officio members and shall act as secretary to said board. II.
