CITY OF BROOKINGS, SOUTH DAKOTA
WHEREAS: Dakota Royal Charity Draft Horse Show, Inc. (501c3) is a national draft
horse show and a proud member of the National Championship Classic Series 6 Horse
Championship; and
WHEREAS: the Dakota Royal Charity Draft Horse Show is a 501(c)(3) nonprofit and
tax exempt South Dakota Corporation that is dedicated to raising funds for youth and
youth activities in South Dakota; and
WHEREAS: In the past 3 years, the Dakota Royal Charity Draft Horse Show has raised
over $90,000 for youth horse activities and scholarships in South Dakota; and
WHEREAS: the Dakota Royal Charity Draft Horse Show is the proud sponsor of a free
seminar by nationally recognized feed expert, Dr. Harry Anderson, a former SDSU
graduate and founder, CEO and President of Total Feeds, which serves the cattle, horse,
canine and human populations; and

Action on Resolution 15-070, a Resolution awarding the Landfill Farm Land Bid.
The Landfill received two bids on the rental of the 120 acres of farm land located on the north side of
the property.
Summary:
Daniel Luze bid $ 211.00 per acres or $ 25,320.00 per year and David Rochel bid $154.25 per or
18,510.00 per year
Background:
The current contract was bid in 2010. The rental agreement is for a five year period starting January
1, 2016 and ending on December 31, 2020
Fiscal Impact:
The bid for the land in 2010 was at $ 101.10 per acre. The bid for 2016 to 2020 will be $ 211.00. This
will be an increase in revenue for the City.
Recommendation:
Staff recommends that the bid of Daniel Luze in the of $ 211.00 per acre be accepted.

Resolution 15-070
Resolution of Intent to Lease Real Property to Private Person (City Farm land)
Whereas, the City of Brookings opened bids for approximately 120 acres of Landfill
Farm Land Lease for the City-owned parcel located in Section 8-T110N-R49W located
north of the Brookings Regional Landfill on Tuesday, June 9, 2015 at 1:30 PM at the
Brookings City & County Government Center; and
Whereas, the City of Brookings has received the following bids for Landfill Farm Land
Lease: Daniel Luze, Elkton, SD - $211.00/acre, and David Rochel, Aurora, SD
$154.25/acre.
The lease will be for a period of (5) five years, commencing on January 1, 2016 and
ending on December 31, 2020. Annual rent payment will be due on April 1
st of each
year. If a portion of the farm land is used for Solid Waste activities, the number of acres
to be paid for will be adjusted at the bid price of $211.00 per acre.
Now Therefore, Be It Resolved that the high bid of Daniel Luze, Elkton, SD for $211.00
per acre be accepted.
Be it Further Noted, that a public Hearing on this Resolution was held on June 23, 2015
at 6:00 o’clock P.M. in the Chambers of the City & County Government Center and that
all persons were given an opportunity to be heard on the intent to lease real property.

First Reading and Introduction on Ordinance 15-011, an Ordinance rezoning the SW ¼ of the NE ¼
of Section 34-T110N-R50W from a Residence R-1B to a Residence R-1C and R-2 District and a
Residence R-2 District to a Residence R-1C District. Public Hearing: July 14, 2015.
Proposal: Create a mixed-density residential subdivision.
Background: The area was annexed in 2006 and rezoned from Agriculture to Residence R-1B and R
-2 in 2013.
Specifics: The developer is proposing to rezone a small area of Residence R-1B to Residence R-2
by extending the R-2 zoning east along Steamboat Trail to Lot 8. The developer is also proposing to
rezone the Residence R-2 south of Steamboat Trail to a Residence R-1C as well as the area west of
the platted lots adjacent to Vail Circle in a northerly direction to Steamboat Trail from a Residence R-
1B to a Residence R-1C.
The attached zoning maps highlight the areas affected by the zoning request. The area outlined in
purple represents the R-1C designation while the area outlined in green represents the R-2
designation.
Recommendation:
The Planning Commission voted 8 yes and 0 no to recommend approval of the request to rezone as
presented.

An Ordinance to Change the Zoning within the City of Brookings
Be It Ordained by the City of Brookings, South Dakota
Section 1. That the real estate situated in the City of Brookings, County of Brookings,
State of South Dakota, described as follows, to-wit:
The SW 1/4 of the NE 1/4 of Section 34-T110N-R50W from a class Residence R-
2 District to a class Residence R-1C District and from a class Residence R-1B
District to a class Residence R-1C and R-2 District
In accordance with Section 94-7 of Article I of Ordinance 17-13 of the Code of
Ordinances of Brookings, South Dakota, as said districts are more fully set forth and
described in Articles III and IV, Chapter 94 of Ordinance No. 17-13 of the City of
Brookings, South Dakota.
Section 2. The permitted use of the property heretofore described be and the same is
hereby altered and changed in accordance herewith pursuant to said Ordinance No. 17-
13 of the City of Brookings, South Dakota.
Section 3. All sections and ordinances in conflict herewith are hereby repealed.

TIMBERLINE REZONE
MINUTES
Sioux Empire Development Corporation has submitted a petition to rezone the SW1/4 of
the NE1/4 of Section 34-T110N-R50W from a class Residence R-2 District to a class
Residence R-1C District and from a class Residence R-1B District to a class Residence
R-1C and R-2 District.
(DeKraai/Gregg) Motion to approve the petition to rezone. All present voted aye.
MOTION CARRIED.
SUMMARY
Hanson displayed the current zoning and the proposed zoning in the area. A large
portion of the current R-2 zoning and a smaller area in the R-1B District would be
rezoned to R-1C. The R-2 District along the north side would be extended east a few
hundred feet into the current R-1B District. He added that the R-1C zoning was more
restrictive than the R-2 Zoning it was replacing. The R-1C and the R-1B Districts had
the same permitted uses.
Dave Casper, who owned a lot in the area, asked for an explanation of the zones.
Hanson explained the R-1B and R-1C only permitted single family dwellings while the
R-2 allowed single-family and two-family dwellings, and twinhomes. Casper stated he
did not object to the rezoning.

Public Hearing and Action on Resolution 15-069, a Resolution for a Petition to Annex the S ½ of the
NW ¼ of Section 34-T110N-R50W (West of Timberline Addition).
Proposal: Sioux Empire Development Corporation has petitioned to annex 80 acres into the City of
Brookings.
Background: Land to the east of the proposal was annexed in 2006 and has begun development
with various stages of preliminary and final platting having occurred. Infrastructure is being installed
and residential construction is underway. A 20 acre undeveloped parcel lies immediately to the north
and is owned by the developer. Land to the south is outside city limits and continues its agricultural
use. The west side sanitary sewer interceptor is located along West 16th Avenue and angles
southeast to Brighton Road. The floodplain provides a natural boundary line to the west.
Specifics: The area requested to be annexed is unplatted, undeveloped and has been used for
agricultural purposes. It is abutting city limits on the east and would be a reasonable extension of the
city’s boundary. In addition, connection to the west sanitary sewer interceptor will provide a logical
service extension to the area. The major street plan identifies Summit Pass as a collector street
extending through this area and connecting with West 16th Avenue.
Recommendation:
The Planning Commission voted 8 yes and 0 no to recommend approval of the request to annex.

Resolution Annexing the South ½ of the Northwest ¼ of Section 34-T110N-R50W
Whereas, the City of Brookings is authorized pursuant to South Dakota Codified Law 9-4-
1 to annex contiguous territory upon receipt of a written petition, describing said territory
sought to be annexed, signed by not less than three-fourths (3/4) of the legal voters and
by the owner or owners of not less than three-fourths (3/4) of the value of said territory,
and
Whereas, the City of Brookings desires to annex the following described property, to wit:
the south 1/2 of the northwest 1/4 of Section 34-T110N-R50W.
Whereas, the aforesaid land is contiguous to the present boundaries of the City of
Brookings, and
Whereas, the City of Brookings has received a Petition for Annexation of Territory signed
by the owners of greater than three-fourths (3/4) of the value of the aforesaid property
and there being no legal voters residing in said territory.
Now, Therefore Be It Resolved by the City of Brookings, South Dakota that the property
described above is hereby annexed to the City of Brookings.

MINUTES
Sioux Empire Development Corporation has submitted a petition for the annexation of
the S 1/2 of the NW 1/4 of Section 34-T110N-R50W
(Drew/DeKraai) Motion to approve the request for annexation. All present voted aye.
MOTION CARRIED.
SUMMARY
Hanson noted that the portion to be annexed contained 80 acres. It was contiguous to
the city limits along the entire east side and along the north side in the northeast corner.
Land to the south, west, and north was undeveloped.

Action on Preliminary Plat of Lots 10-25, Block 6; Lots 9-15, Block 7; and Lots 7-15 and 20-33, Block
8, Timberline Addition in the W1/2 of the NE1/4 excluding the North 1,350’ in Section 34-T110N-
R50W.
Proposal: Preliminarily plat 46 lots with adjoining right-of-way for future development.
Background: This is the second phase of a 40 acre parcel west of the developed Timberline
Addition. The first phase preliminarily platted 23 lots and was zoned R-1B. Summit Pass is
designated a collector street and extends westward into this parcel.
Specifics: The various elements of this preliminary subdivision plan are addressed below:
·Street design - All streets and cul-de-sacs conform to the minimum width/radius requirements.
Summit Pass continues west from Timberline Addition as required by the major street plan. It
will intersect with Brighton Road or West 16th Avenue in the future. Street connections to the
north in this area are limited due to the existing cemeteries along 8th Street South. A future
street linkage to the south needs to be discussed along the west end of the this preliminary
plat.
·Land design - Block lengths are acceptable. Lot size is compatible with the proposed zoning.
Corner lots have extra width. Interior lot lines are straight and acceptable.
·Open space - A retention/detention pond is planned south of Summit Circle. Otherwise, no
additional open space is planned for this phase. A future park area should be discussed since
the Parks Master Plan identified a future park towards the southwest of the this subdivision.
·Drainage Plan - The City Engineer’s Department will require a preliminary storm drainage plan
for this area. Approval should be subject to an approved preliminary drainage plan.
·Grading Plan - Grading is anticipated to be minimal in the design of this phase.
Recommendation:
The Planning Commission voted 8 yes and 0 no to recommend approval of the preliminary plat
subject to an approved preliminary drainage plan.

SEDCO PRELIMINARY PLAT
MINUTES
Sioux Empire Development Corporation has submitted a preliminary plat of a portion of
the Timberline Addition in the W 1/2 of the NE1/4 of Section 34-T110N-R50W.
(Gregg/Fargen) Motion to approve the preliminary plat as presented contingent upon an
approved drainage plan. All present voted aye. MOTION CARRIED.
SUMMARY
This platting was the second phase of the development west of the original Timberline
Addition. Hanson stated that the street widths and cul-de-sac radii met the subdivision
requirements. Summit Pass was extended west as a 70’ wide collector as required by
the Major Street Plan. The street would eventually connect with Brighton Road and W.
16th Avenue. A retention/detention area was planned on the south side. Grading was
anticipated to be minimal in the area. Hanson noted that a neighborhood park was
proposed by the city for the area. The park would serve most of Timberline and future
residential subdivisions to the south. The location for the park would need to be
addressed on future preliminary plans.
Heuton questioned whether a secondary access needed to be required since Summit
Pass was the only way into the development. Hanson responded that he believed
Summit Pass would be linked to Brighton Road and W. 16th Avenue in the near future
with a right-of-way plat.

Action on Preliminary Plat of the south portion of Prairie Hills Addition in the E1/2 of Section 2-T109N
-R50W.
Proposal: Create a Large Scale Residential Development (LSRD) plan for a low-density residential
subdivision.
Background: The Prairie Hills Addition is a 200 acre mixed-use development. The developer has
submitted various preliminary plats over the years, however, the concept has generally stayed
consistent. The residential portion of Prairie Hills is primarily in the south end.
Specifics: The developer submitted a revised preliminary plat of the residential portion of Prairie Hills
Addition to the Planning Commission in May. He came back in June with additional revisions. The
design is similar to Indian Hills where there are common areas that abut the lots. Private sidewalks
within the common area, owned by the homeowners association, would provide pedestrian access
through the subdivision in lieu of the customary street-side sidewalks. The maintenance of these
private sidewalks was discussed at length at the commission meeting since private sidewalks in the
Indian Hills Addition were not cleaned on a regular basis particularly during the winter months.
Excerpts from the revised Subdivision Regulations are attached which provide guidance on how the
maintenance issues could be addressed with sidewalks/trails installed in the common areas of Prairie
Hills Addition. The developer also proposed shorter building setbacks, smaller lot areas, and
narrower street widths.
In regards to the narrower street widths, the roadway portion would still be 31’ from the back-of-curb
to back-of-curb which is customary for a local street. The developer also proposed to off-set the
roadway on streets that would be narrower than 60 feet wide but still be required to have street-side
sidewalks. This design would create a 9 ½’ boulevard on one side and a 14 ½’ boulevard on the
other side which would contain a 5’ wide sidewalk. However, under the variances approved by the
Planning Commission, no off-sets are needed. It is believed the developer may want to discuss
narrowing Sweetgrass Drive to 55’ instead of the 60’ width approved by the Commission. In this
case, the off-set roadway request would be back up for discussion. The City Engineer has stated
that her department and the Brookings Municipal Utilities would accept the off-set roadway design as
proposed by the developer and approved by the city.
Recommendation:
At the May 5th and June 2nd Planning Commission meetings, the Planning Commission approved the
following variances to the preliminary plat as part of the LSRD plan:
1.7’ side yard setback (8’ required in R-1B)
2.20’ rear yard setback (25’ required in R-1B and R-3).
3.9,000 sq. ft. minimum lot area (10,000 required in R-1B).
4.20’ front yard setback for lots where the sidewalk is located in the common area (30’ required
in R-1B).

Excerpt from Subdivision Regulations
Sec. 51-64. – Street Standards
(i)Concrete or asphalt pedestrian walkways of an appropriate width (as determined
by the engineering design standards) shall be required upon and through blocks
where deemed necessary to provide circulation or access to schools,
playgrounds and other community facilities. They may also be required to
provide access through greenways and common areas. Maintenance shall be
the responsibility of the adjacent property owners unless stated otherwise.
Sec. 51-65. – Land Design and Improvements.
(6)Maintenance Agreements. Where a subdivision contains sewers, lift stations,
water supply systems, park areas, road systems or other facilities or services
which are necessary to the area, and which are of common use or benefit and
which are not accepted for maintenance by an existing public agency, provisions
shall be made by written agreement for the proper and continuous maintenance
and supervision of such facilities. A sign copy of the agreement shall accompany
every plat having a facility or service covered by such an agreement.

Policy Discussion pertaining to the Sale of City Property for Development Purposes.
Summary:
At a previous City Council meeting, you delayed action pertaining to the transfer of one of two seven-
acre parcels in the Foster Industrial Park to BEDC for purposes of subsequent sale to private parties
who are seeking to expand/develop small businesses that would be characterized as heavy
commercial or light industrial in nature.
The purpose of the delay in the pending sale was to entertain a policy discussion regarding the city’s
role in such development initiatives that would be necessitated by the sale of city land for such
purposes, and the price by which the land would be sold.
