Public Hearing: October 11, 2016. Summary: This ordinance will amend the 2016 Budget to decrease expenditures in accounts where savings have occurred, to provide for transfers of cash from one fund to another, to increase expenditures for accounts where unanticipated expenditures have occurred, and to increase expenditures for unbudgeted projects authorized by the City Council. Background: Occasionally it is necessary to adjust the budget for events that were unknown when the original budget was adopted. In 2016, the City Council authorized additional spending for a Bike Master Plan, a Comprehensive Master Plan, a settlement with Bel Brands for the construction of the digester, and the purchase of property adjacent to the Park Shop. In addition, the City experienced some unexpected major repairs to facilities which include the HVAC system at the Library, the irrigation system at Fishback Soccer Fields, and sandblasting and repainting the main pool at the aquatics facility. Other smaller adjustment for both increases and decreases were made to keep the budget in balance and better reflect the actual needs. Background: The property is located immediately north of Lowe’s along 25th Avenue. The area includes a mix of commercial and residential uses. The Preliminary Plat for Wilbert Square Addition was approved by the City Council on November 24, 2015. The PDD is intended to provide flexibility for creative, efficient, and well-planned urban development that allows for a mix of compatible uses. The Initial Development Plan shows two buildings with a mix of retail, office, restaurant, and residential apartments contained within two phases of development. There are 56 1-Bedroom apartments planned with the first phase. The structures are both 12,000 square feet in size and will be up to four stories in height. The parking will be in front of both buildings and the site will be accessed off a new street, Wilbert Court. An Initial Development Plan is required with a PDD rezoning request to see the general project layout and evaluate the concept with the purpose of the PDD. The compatibility of proposed land uses, development design, building placement, and the need for flexibility outside of the traditional zoning districts, are all factors to be considered. The area to be rezoned includes all development and to the centerline of Wilbert Court. The proposed underlying B-2 District allows for office, retail, restaurant and mixed commercial/residential uses. Recommendation: Planning Commission voted 8-0 to recommend approval. OFFICIAL SUMMARY Item #5a – Struck explained that the developer is looking into a mixed use concept on the lots being proposed for a rezone. Struck stated that a traditional B4 zoning district doesn’t allow for mixed uses and the PDD would allow for flexibility in the area. The intial concept is to have commercial use on the first floor and residential uses above. Struck explained that Wilbert Court which is indicated on the drawings has not been platted yet. He also indicated that to the north of the proposed area is the Research Park and to the west is Innovation Village. Heuton inquired about the separation of tenant parking from customer parking. JR explained that currently they are thinking that the parking towards the front of the development will be for the commercial parking and the parking around the outside will be for residential, however they haven’t ruled out underground parking yet. Struck asked if the Wilbert Court will be a private street or a public right-of-way? JR stated that currently the intention is to make it a public right-of- way. Pierce asked about the size of the detention pond and what it will be used for due to its larger size? JR stated that it is just shy of a half acre and it will have a slope on it to allow them to mow it. They are also planning to landscape around it and have a fountain in the middle. JR explained that all the units in Phase 1 that face the north will have decks looking out towards the pond. Heuton asked if this pond would service just this development? JR stated that it will service about 60% of Wilbert Square. Pierce asked if the City had seen this drainage plan and approved it? Lanning explained that the drainage plan will be submitted at the time of the Initial Development Plan, so she hasn’t seen any plans yet. Tornquist inquired if this is a Planned Development District then this zoning doesn’t have to comply with the B-4 or the Residential guidelines or regulations? Struck stated that the applicant is proposing a PDD with an underlying B-2 zone, but this hasn’t been finalized yet. He stated that the plan could be approved with a B-2 zoning because they do meet the setback requirements and the parking so they aren’t looking for any particular concessions at this time. But one advantage to the rezone is the commission does have the ability to limit some of the uses within the District. Struck explained the slight differences between the B-2 and B-4 zoning. Pierce asked “if the Planning Commission does have restrictions they would like applied, should this be indicated now?” Struck stated that the Planning Commission will have an opportunity to restrict uses during the IDP and FDP process, but it may be a good idea to indicate to the developer, now, some thoughts of the Planning Commission. Summary: This resolution will approve the Unit Financial Charge for the 2017, 2018, and 2019 Storm Drainage Fees. Background: The Storm Drainage Fee ordinance was adopted in 1980s, which allows the City to collect a Drainage Fee on all properties in the city limits, including tax exempt agencies such as South Dakota State University, US Post Office, Department of Transportation, and others. The collected fees are deposited in the Storm Drainage Budget and are used to maintain and enhance the current storm sewer system, purchase property for drainage projects, construct new drainage facilities, in addition to making storm sewer repairs, pipe cleaning, and Phase II DENR storm water quality requirements. The City Council approves the unit financial charge each year and it is used to calculate the Drainage Fees for each property. The Drainage Fee calculation is determined using the following formula: square footage of the parcel x the runoff weighting factor x the unit financial charge History: For a history of the Drainage Fee, the unit financial charge was .00019 in 2006, .00036 from 2007 through 2009, and .00054 from 2010 to 2016. The increase in the Drainage Fee has been used to fund maintenance and drainage improvement projects listed in the City Budget. The following is an example of the amount charged on a typical residential lot that is 10,000 square feet: 2006 cost: $14.25 2007 to 2009 cost: $27.00 2010-2015 cost: $40.50 The financial charge is set in the fall each year and the Storm Drainage Fees are calculated and submitted to Brookings County for the property tax billing, which will be collected the following year. The fee is examined each year to determine if there is a need for additional funds to cover maintenance and project costs. The City Council held discussion at their September 13, 2016 Council meeting.
