Recommendation: City Council delegates their responsibility for approving new volunteer appointments on a monthly basis to the City Manager to avoid a delay in volunteer work comp benefits, etc. Attachments: Resolution City of Brookings Printed on 2/18/2016Page 1 of 1 powered by Legistar™ Resolution 16-025 Resolution authorizing the City Manager to approve Volunteers for Work Comp Coverage Whereas, the citizens of the City of Brookings voted on June 1, 1999 to amend the Brookings City Charter as adopted March 18, 1997, and Whereas, the amendment included eliminating the commissioner form of government and provided for the creation of a City Council-City Manager form of government, and Whereas, South Dakota Codified Law 62-1-5.1 states that “Volunteers serving state or political subdivision without pay--Computing or imputing wage--Certain persons not deemed volunteers. Any volunteer worker rendering services in or for any agency, department, institution, or instrumentality of the state or of any of its political subdivisions, including counties, townships, school districts, or municipalities, whose services have been duly recommended to the officer or governing body responsible for employment of personnel for the respective entity and duly appointed thereto by such officers or governing body, shall for purposes of this title be deemed an employee of the state or the political subdivision, as the case may be. The appointment shall be entered into the official records or minutes of the entity. In the event of injury or death, for the purposes of computing compensation for volunteer workers other than volunteer firefighters, a volunteer uncompensated worker's employment earnings from all sources during the last six months of employment shall be used. In the event the volunteer uncompensated worker has never been employed, the worker shall be considered to be earning the state minimum wage over a forty-hour week. The worker's average weekly wage shall be calculated by one of the methods in §§ 62-4-25 to 62-4-27, inclusive. In no event may payments to volunteer uncompensated workers exceed the maximum limitations for benefits as set out in this title. No local prisoner, state inmate, or federal inmate providing services to the state or any of its political subdivisions may be considered a volunteer worker under this section. Whereas, the City Council desires to formally approve the official volunteer list annually and cover these volunteers for work comp purposes pursuant to SDCL 62-1-5.1; delegate their responsibility for approving new volunteer appointments on a monthly basis throughout the year to the City Manager. Summary: This resolution will award bids for 2016-07STI, Asphalt Concrete Freight on Board Project. Background: This project is the annual street maintenance project that provides the asphalt patching material that the Street Department picks up at the plant to repair asphalt pavement throughout the City. The Street Department staff also uses the materials to overlay small street areas which are usually one block long or shorter. A bid letting was held on Tuesday, February 16, 2016 and the City received the following bid: Bowes Construction Co., Inc. in the amount of $54,950.00. The total low bid is approximately 18% lower than the engineer’s estimate of $67,200.00. Fiscal Impact: The City will enter into a contract with Bowes Construction Co., Inc. for $54,950.00. Background: This project is the Chip Seal Project for the 2016 Project Area, which is located east of Medary Avenue, between 6th Street and 8th Street South. This is an annual project, where the contractor applies oil and city-purchased pea rock chips to the streets. The City then sweeps up the excess chips a few days afterward for re-use or sale. The land was subsequently rezoned to an I-1R west of 32nd Avenue and to an I-1 east of 32nd Avenue (Bel Brands facility). GHP Systems, Inc. bought Lot 1, Block 1, on the west side in 2011. In 2013, Lots 2, 3, and 4, of Block 1 were platted for possible transfer and development. Lot 2 was approved for rezoning to the I-1 District by the Planning Commission in January and has been forwarded to the City Council for final action. Specifics: Lot 3 is north of, and abutting, Lot 2. It is bordered by the Business B-3 District to the north, an Industrial I-1R District to the west, and the Industrial I-1 District across 32nd Avenue to the east. Lot 4 to the west of this lot will continue to be owned by the city and used only for stormwater detention/retention. This lot could provide a landscape buffer between I-29 and Lot 3. Permitted uses in the I-1 and I-1R Districts are very similar. The two major differences between the districts are that the I-1R requires the approval of an I-1R Site Plan prior to development and building setbacks are much greater in the I-1R than the I-1. In addition to the standard review process, the I- 1R Site Plan regulations address several external site design elements such as the exact location of loading docks, outdoor storage areas, and fencing. (Pierce/Gregg) Motion to approve the rezoning. All present voted aye, except Aiken and Tornquist voted no. MOTION CARRIED. SUMMARY The rezoning request involved a 7.2 acre parcel of land along the west side of 32nd Avenue. The land was zoned to the I-1R District in 2011. Lot 2, directly south of Lot 3, was recommended for rezoning to the I-1 District in January, 2016, and had been forwarded to the City Council for action. Lot 3 was bordered by the Business B-3 District to the north, the I-1 District to the east and the I-1R District to the south and west. The city would retain ownership of the lot to the west and use it for stormwater retention in the future. Tornquist was concerned about setting a precedence for rezoning land away from the I- 1R District in this area. Aiken concurred and felt an I-1 District zoning on this lot would not provide an adequate buffer from the Business B-3 land to the north. Pierce questioned why this lot, and the lot recommended for rezoning in January, were not brought forward for rezoning at the same time. Heuton responded that it had to do with the timing of the sale of the lots. Pierce asked what the landscaping requirements would be for a lot in the I-1 District. Hanson indicated that the standard landscape requirements in Section 94-399 of the zoning code would apply. These regulations required tree plantings based on the amount of surfacing on the lot versus simply 10 trees per acre as was required in the I-1R. In addition, perimeter landscaping was not required in the I-1 like it was in the I-1R. Fargen asked if there was any opposition to the rezoning from neighboring landowners. Hanson replied no. Fargen felt the lot next to I-29 could provide a landscape buffer for this lot if it was rezoned to the I-1 District. Proposal: Modify the Agriculture definition for the Urban Chicken Demonstration Pilot Project (UCDPP) Background: Agriculture, as a land use, is defined in the zoning ordinance and allowed in only a few districts within the city. The definition addresses many activities and aspects of a farming enterprise. Some of these, by their nature, would be incompatible to many other adjacent uses while others may not. However, they are currently all lumped together as you can see in the first paragraph of the definition. There are a few residents who still operate a farming enterprise within city limits where the current agriculture definition would be applicable. Specifics:The UCDPP is designed to allow residents to apply for a temporary permit for the raising and keeping of chickens on their property. It is restricted to properties that contain a single-family dwelling that is either owner-occupied or rented. Therefore, it is not zone-specific but rather use- specific. Paragraph two has been added to specifically address how the UCDPP will preempt certain language in the agriculture definition during the limited duration of the project. The Urban Chicken Demonstration Pilot Project is a one year pilot project with an additional sixth month grace period for completion of the project and relocation of the hens. The ordinance authorizing the temporary keeping of chickens contains a sunset clause of August 1, 2017 and it is the intent of this Zoning Amendment to coincide with the dates of the Urban Chicken Demonstration Pilot Project. Agriculture: The production, keeping, or maintenance, for sale, lease or personal use, of useful plants and animals including but not limited to: sod crops; grains and seed crops; dairy animals and dairy products; poultry and poultry products; livestock including beef cattle, sheep, swine, horses, ponies, mules, or goats, or any mutations or hybrids thereof, including the breeding and grazing of any or all of such animals; bees and apiary products; fur animals; tree orchards and forest products; fruits of all kinds, including grapes, nuts and berries; vegetable farms; nursery, floral, ornamental and greenhouse products; or lands devoted to a soil conservation or forestry management program. The term Agriculture does not include flower or vegetable gardens or fruit trees and berry plants which are grown for personal use and consumption provided the production of these uses is not sold. In addition, during the limited duration of the Urban Chicken Demonstration Pilot Project, the term Agriculture does not include the keeping of chickens by those who are issued permits pursuant to the Urban Chicken Demonstration Pilot Project. The BBAC is to review and make recommendations on capital improvement projects developed by the City departments and outside agencies to ensure that adequate consideration is given to bicycles. Considerations: ● Address the bike lane recommendations pursuant to Brookings City Resolution 15-092. BBAC 2 Recommendation #1: The BBAC recommends the City Council remove parking and implement bicycle lanes as follows on streets addressed by city council resolution 15-092. - 4’ Striped Bicycle Lanes on streets that are 30’ or larger. o 2 – 11ft driving lanes + 2 – 4ft bicycle lanes = 30ft - 4’ Striped Bicycle Advisory Lanes on streets that are less than 30’. o 2 - 4ft bicycle lanes with dashed lines that can be shared by motor vehicles. Proposal: Establish a light processing facility in the Industrial I-1R District Background: Lot 3 is a 7.2 acre parcel that was rezoned to the Industrial I-1R District in 2011. This zone is an industrial overlay district with a site plan review component. All developers must submit their project plans for approval by the Planning Commission and City Council prior to obtaining a building permit. The I-1R Site Plan requirements are in your packet. An I-1R Site Plan was approved for this lot in 2013. However, no development occurred as a result of that approval. The current proposal is different than the 2013 plan. Specifics: The I-1R Site Plan requirements have two sections; 1. (a-h) and 2. (a-d). The plan complies with the data requested in 1. (a-h). The actual specific information for a future freestanding sign (g.) is allowed under a separate permit. The additional site plan regulations in 2. (a-d) are also met except for (d.). The required 25’ wide landscape area on the north and south sides has been reduced to 3’ on the south end and 0’ on the north end. The plan does have a 60’ wide landscape area on the front (50’ required) and a large, grass area to the west, or rear yard. Please note that the plan indicates a possible future expansion of the building to the west that would likely impact this landscaped area. The plan shows 42 trees on-site that will include red sunset maples, honey locusts, and scarlet oaks. The 42 trees meet the landscape requirements in Section 94-399. However, the minimum number of trees required under the I-1R regulations is 72 (10 trees per acre). The plan also shows several areas near the building that will contain shrubs. Recommendation: The Planning Commission voted 9 yes and 0 no to approve an amendment to the proposed I-1R Site Plan. The amendment would prohibit any improvements within the 35’ wide drainage easement along the south end of the lot. This easement was placed on the plat of the lot 3 in 2013 to insure adequate access to future stormwater drainage facilities that would be constructed on lot 4 to the west. SUMMARY Hanson noted that agenda items 5a. and 6a. involved the same lot. The prospective developer requested that the I-1R Site Plan application be acted on in the event a rezoning of the property to the Industrial I-1 District was not approved. This would save time in getting the project started in the spring. The proposed plan met the requirements except for the required 25’ landscaping strips along the side lot lines and for the minimum number of trees that were required to be planted on site. The plan showed surfaced parking up to the north side lot line and within 3’ of the south side lot line. The site had 30 fewer trees than required under the I- 1R regulations but did meet the standard tree planting requirements for a non-I-1R District location. An additional map was presented to the commission that indicated a 35’ wide drainage easement along the south lot line. This easement was required by the city in order to direct stormwater over to lot 4 which was located west of lot 3. No improvements are permitted in a drainage easement. Tornquist inquired about the possible future expansion to the west that was noted on the plan. Hanson replied that an amended I-1R Site Plan would need to be submitted and approved if that was proposed. Pierce was concerned about granting such large landscape variances on the sides of the lot. Tornquist questioned if the building could be rotated 90 degrees. Proposal: Create a 20 acre residential subdivision in a Residence R-3 District Background: A sketch plan of this subdivision was reviewed in January. Primary discussions involved the development timetable, land use, external street connections, and infrastructure. The owner stated that the land would be developed in two phases starting on the north end. A mix of low and high density residential uses was contemplated. However, the lot layout indicated single-family and two-family uses would be the dominant land use. The proposed preliminary plat is very similar to the sketch plan submitted previously. An area plat map and aerial view are in your packet. Specifics: The various elements of the subdivision plan are addressed below: ·Street design - All streets conform to minimum width requirements for local residential streets. There are two intersections proposed at 20th Street South and one street connection to the south that will link up with a future street in the Bluegill Addition. The proposed streets represent 20% of the gross land area. A street connection to the west was discussed at the January PC meeting but has not been proposed by the owner. The owner’s reasons for this are as follows: 1.The proposed Ace Avenue will connect to future 23rd Street in the Bluegill Addition. 23rd Street would be able to route traffic to 17th Avenue and 22nd Avenue. 2.With the existing parks, including Southbrook, the Nature Park, Edgebrook, and Fishback, there is nothing in the Park Master Plan for parks on the Fairbanks property. 3.The addition of a connector street would include the loss of at least one lot, possibly two due to setbacks. 4.There would be additional costs for the street and other infrastructure, that would also include future public costs like snow removal and other maintenance. ·Land design - This is a grid system style layout with lots arranged in rows within rectangular blocks. The size and linear shape of the parcel does restrict design options somewhat. There are 69 lots and one detention pond lot on the plan. All lots meet the minimum frontage width and area requirements for a single-family dwelling use in the R-3. Eighteen lots can also accommodate a two-family dwelling and 11 lots could be occupied by a twinhome (zero lot line structure) or small apartment building. Of course, future platting or lot consolidation could occur which would alter the overall density of the subdivision. The Residence R-3 District does provide that type of flexibility. ·Open space - No open space is planned. Moriarty Park, Dakota Nature Park, Southbrook Softball Complex, and Edgebrook Golf Course are within walking distance. ·Drainage plan - The City Engineer’s Department will require a preliminary stormwater drainage plan for the area. The plat was nearly identical to the sketch plan that was discussed in January. Hanson noted that all street widths and lot areas met the subdivision standards. Corner lots were wider to accommodate the larger front yard setback requirements. No open space was planned since the subdivision would be in walking distance to several parks. He added that a preliminary stormwater drainage plan would be required by the city engineer’s department. A primary issue during last month’s discussion was a possible street connection to the west. The land to the west of the Southland Addition was a 35 acre parcel referred to as the Fairbanks land. Heuton and Lum supported a connecting street to the west. Lum inquired about future land use options to the east. Hanson noted that future developments in the area could result in all or part of the mobile home park converting to a business use which would be in-line with the Vision 2020 goals for the 22nd Avenue So./20th Street So. arterial intersection. If this occurred, a connecting street going east from the Southland Addition would be discouraged. Lance Park, owner of the land, felt that a connecting street from the west would send too much traffic through his subdivision. He also felt there were wetland issues on the Fairbanks land to the west that would prevent 22nd St. South from connecting to his subdivision. He noted that the proposed south connection into the Bluegill Addition would provide adequate traffic routes. He remarked that the sanitary sewer availability and the grade of the land determined his design. Lanning commented that crossing a designated wetland area could be an issue for both Fairbanks and Bluegill. Hanson stated that traffic and pedestrian access between subdivisions was important in order to reduce travel times and provide optional travel routes. Requiring a connecting street now would not prevent the owner from amending the subdivision plan in the future if the design of adjacent parcels made the street unnecessary. The proposed street segment could then be converted into a residential lot. A comprehensive master plan would identify how the physical growth and development of the Brookings community could align with future goals and dreams of its citizens and leaders. A thriving community is dependent on internal and external investments of both time and money. Attracting these investments requires a more detailed road map to illustrate how and where the City of Brookings will develop. The purpose of the Comprehensive Master Plan Advisory Committee is to assist the City in developing a new Comprehensive Master Plan. The Advisory Committee’s Mission is to build consensus around a comprehensive strategy for Brookings’ future by engaging community input and advise the process of developing the Plan. The Committee will collaborate with the Planning Commission and city staff to complete the plan. Specific Objectives: ● Develop and direct the process to complete a new plan ● Research and gather comparable plans and processes ● Research use of a Consultant to aid in the development of the Plan ● Develop a Budget ● Present Budget to Council for Approval ● Advise the City Manager in selection of Consultant ● Work with the Consultant to complete a new plan ● Develop milestones and deliverable due dates ● Execute the process to deliver a draft plan for Planning Commission and City Council approval. ● The Advisory Committee shall formally report its activities to the Planning Commission quarterly. ● Engage community members and stakeholders to provide input and comment throughout the process of developing the plan.
