Public Hearing: February 23, 2016. Proposal: Rezone a 7.2 acre parcel of land along the west side of 32nd Avenue Background: The city purchased the Foster land in 2011 for industrial purposes. The land was subsequently rezoned to an I-1R west of 32nd Avenue and to an I-1 east of 32nd Avenue (Bel Brands facility). GHP Systems, Inc. bought Lot 1, Block 1, on the west side in 2011. In 2013, Lots 2, 3, and 4, of Block 1 were platted for possible transfer and development. Lot 2 was approved for rezoning to the I-1 District by the Planning Commission in January and has been forwarded to the City Council for final action. Specifics: Lot 3 is north of, and abutting, Lot 2. It is bordered by the Business B-3 District to the north, an Industrial I-1R District to the west, and the Industrial I-1 District across 32nd Avenue to the east. Lot 4 to the west of this lot will continue to be owned by the city and used only for stormwater detention/retention. This lot could provide a landscape buffer between I-29 and Lot 3. Permitted uses in the I-1 and I-1R Districts are very similar. The two major differences between the districts are that the I-1R requires the approval of an I-1R Site Plan prior to development and building setbacks are much greater in the I-1R than the I-1. In addition to the standard review process, the I- 1R Site Plan regulations address several external site design elements such as the exact location of loading docks, outdoor storage areas, and fencing. The requirements are attached for your review. Recommendation: The Planning Commission voted 7 yes and 2 no to recommend rezoning Lot 3, Block 1, Foster Addition to the Industrial I-1 District. Dated this 22nd day of January, 2016. ____________________________ Dan Hanson Planning & Zoning Administrator 2/2/2016 PLANNING COMMISSION MINUTES The City of Brookings has submitted a petition to rezone Lot 3, Block 1, Foster Addition from an Industrial I-1R District to an Industrial I-1 District. (Pierce/Gregg) Motion to approve the rezoning. All present voted aye, except Aiken and Tornquist voted no. MOTION CARRIED. SUMMARY The rezoning request involved a 7.2 acre parcel of land along the west side of 32nd Avenue. The land was zoned to the I-1R District in 2011. Lot 2, directly south of Lot 3, was recommended for rezoning to the I-1 District in January, 2016, and had been forwarded to the City Council for action. Lot 3 was bordered by the Business B-3 District to the north, the I-1 District to the east and the I-1R District to the south and west. The city would retain ownership of the lot to the west and use it for stormwater retention in the future. Tornquist was concerned about setting a precedence for rezoning land away from the I- 1R District in this area. Aiken concurred and felt an I-1 District zoning on this lot would not provide an adequate buffer from the Business B-3 land to the north. Pierce questioned why this lot, and the lot recommended for rezoning in January, were not brought forward for rezoning at the same time. Heuton responded that it had to do with the timing of the sale of the lots. Pierce asked what the landscaping requirements would be for a lot in the I-1 District. Hanson indicated that the standard landscape requirements in Section 94-399 of the zoning code would apply. These regulations required tree plantings based on the amount of surfacing on the lot versus simply 10 trees per acre as was required in the I-1R. In addition, perimeter landscaping was not required in the I-1 like it was in the I-1R. Fargen asked if there was any opposition to the rezoning from neighboring landowners. Hanson replied no. Fargen felt the lot next to I-29 could provide a landscape buffer for this lot if it was rezoned to the I-1 District. Proposal: Modify the Agriculture definition for the Urban Chicken Demonstration Pilot Project (UCDPP) Background: Agriculture, as a land use, is defined in the zoning ordinance and allowed in only a few districts within the city. The definition addresses many activities and aspects of a farming enterprise. Some of these, by their nature, would be incompatible to many other adjacent uses while others may not. However, they are currently all lumped together as you can see in the first paragraph of the definition. There are a few residents who still operate a farming enterprise within city limits where the current agriculture definition would be applicable. Specifics:The UCDPP is designed to allow residents to apply for a temporary permit for the raising and keeping of chickens on their property. It is restricted to properties that contain a single-family dwelling that is either owner-occupied or rented. Therefore, it is not zone-specific but rather use- specific. Paragraph two has been added to specifically address how the UCDPP will preempt certain language in the agriculture definition during the limited duration of the project. The Urban Chicken Demonstration Pilot Project is a one year pilot project with an additional sixth month grace period for completion of the project and relocation of the hens. The ordinance authorizing the temporary keeping of chickens contains a sunset clause of August 1, 2017 and it is the intent of this Zoning Amendment to coincide with the dates of the Urban Chicken Demonstration Pilot Project. Recommendation: The Planning Commission voted 9 yes and 0 no to recommend approval of the zoning ordinance amendments. Be It Ordained and Enacted by the Council of the City of Brookings, State of South Dakota, as follows: I. Sec. 94-1. – Definitions. Agriculture: The production, keeping, or maintenance, for sale, lease or personal use, of useful plants and animals including but not limited to: sod crops; grains and seed crops; dairy animals and dairy products; poultry and poultry products; livestock including beef cattle, sheep, swine, horses, ponies, mules, or goats, or any mutations or hybrids thereof, including the breeding and grazing of any or all of such animals; bees and apiary products; fur animals; tree orchards and forest products; fruits of all kinds, including grapes, nuts and berries; vegetable farms; nursery, floral, ornamental and greenhouse products; or lands devoted to a soil conservation or forestry management program. This definition shall not include intensive agricultural activities such as, but not limited to, feedlot operations, chicken or turkey farms, and agribusiness activities. The term Agriculture does not include flower or vegetable gardens or fruit trees and berry plants which are grown for personal use and consumption provided the production of these uses is not sold. In addition, during the limited duration of the Urban Chicken Demonstration Pilot Project, the term Agriculture does not include the keeping of chickens by those who are issued permits pursuant to the Urban Chicken Demonstration Pilot Project. This temporary exception is for the limited purpose of the Urban Chicken Demonstration Pilot Project which shall expire at the time the Urban Chicken Demonstration Pilot Project ends. II. Any or all ordinances in conflict herewith are hereby repealed. They have been developed by the architects and staff. The first step of architectural design, pre-schematic, is to identify the major components of the building and place them in a relational configuration to each other. The attached diagrams incorporate all of the amenities identified in the initial feasibility report with options for generalized relationship to each other. Once pre-schematic arrangements are identified, the project moves to the next phase of final schematic design which is to add the next level of detail where specific facility amenities are sized and located. This phase would not commence until post-referendum. JLG Architects will be at the meeting to further describe pre-schematic and site design issues.
