Resolution 19-011 - Resolution Fixing Time and Place for Hearing upon Assessment Roll for Sanitary Sewer Assessment Project 2018-12SSA, Western Avenue between Martin Boulevard and 20 th Street South Be It Resolved, by the City Council of the City of Brookings, South Dakota, as follows: 1. The Assessment Roll for Sanitary Sewer Assessment Project 2018-12SSA, having been filed in the office of the City Clerk on the 22nd day of January, 2019, and the City Council shall meet in the Chambers, Brookings City & County Government Center, in said City on Tuesday, the 12th day of February, 2019, at 6:00 o'clock PM. 2. The City Engineer is authorized and directed to prepare a notice describing, in general terms Sanitary Sewer Assessment Project 2018-12SSA, the date of filing the Assessment Roll, the time and place of hearing thereon, stating that the Assessment Roll will be open for public inspection at the office of the City Engineer and referring to the Assessment Roll for further particulars. 3. Action on Resolution 19-012, a Resolution authorizing the City Manager to Sign Easement Documents for City Property Located in Mayland’s First Addition and Insbrook Park Addition. Resolution 19-012 - Resolution Authorizing the City Manager to Sign Easement Documents for City Property Located in Mayland’s First Addition and Insbrook Park Addition Whereas, the City of Brookings desires the 22nd Avenue Reconstruction Project which will include roadway widening and shared-use path; and Whereas, the City of Brookings is the owner of property in Block 4 of Mayland’s First Addition and Block 1 of Insbrook Park Addition; and Whereas, temporary and permanent easements are necessary for the construction of the Project. Now, Therefore Be It Resolved, that the City Manager of the City of Brookings is Authorized to sign easement documents for City property located in Mayland’s First Addition and Insbrook Park Addition. 3.E. Action on Resolution 19-013, a Resolution awarding the contract to Purchase One Chip Truck for the Brookings Parks, Recreation and Forestry Department. Resolution 19-013 - Resolution Awarding the Contract for the purchase of One Chip Truck for the Brookings Parks, Recreation and Forestry Dept. Whereas, the City of Brookings held a bid letting at 1:30 PM on Tuesday, January 15, 2019; and Whereas, the City of Brookings has received the following bids: Company Bid Price Custom Truck One Source $90,500.00 Boyer Trucks $97,480.00 North Central International of Sioux Falls, Inc. $100,231.00 The 2019 Parks Department Forestry Division capital budget for this expenditure is $110,000.00. Now, Therefore, Be It Resolved, that the bid from Custom Truck in the amount of $90,500.00 be accepted. 3.F. Action on Resolution 19-014, a Resolution to purchase two (2) Toro Greensmaster Triflex 3320, one (1) Toro Sand Pro 5040 off of the National Joint Powers Alliance for the Parks, Recreation & Forestry Department (EdgeBrook Golf Course). Whereas, the City of Brookings has sought and received the following quote for two (2) Toro Greensmaster Triflex 3320, one (1) Toro Sand Pro 5040 from the National Joint Powers Alliance: Company Bid Amount Midwest Turf & Irrigation •two (2) Toro Greensmaster Triflex 3320 $88,401 •one (1) Toro Sand Pro 5040 $27,703 •equipment trade-in value ($9,200) Now, Therefore, Be It Resolved that the contract from Midwest Turf & Irrigation in the amount of $106,904 be accepted. The capital budget for this expenditure is $107,000. Open Forum. Matt Schmidt requested information on snow plow gates. December 31, 2018 Treasurer’s Report. Erick Rangel, Chief Finance Officer, and Arnold Ehlers, Interim Finance Director, presented a summary of the City's financial position to the City Council and public. Resolution 19-010. A motion was made by Council Member Niemeyer that Resolution 19-010, a Resolution approving Change Order No. 1 (Final) for 2018-05SSI, Viaduct Drainage Improvement Project; VJ Ahlers Excavating, Inc., be approved. The motion carried by the following vote: Yes: 7 - Niemeyer, Hansen, Kidwiler, Wendell, Bacon, Tilton Byrne, and Corbett. FIRST READING - Ordinance 19-002. Introduction and first reading was held on Ordinance 19-002, an Ordinance pertaining to a conditional use permit to erect a temporary telecommunication tower with a height of 165 feet in a Residence R-2 Two-Family District on Lot 3 and the East ½ of Lot 4, Block 1, Hill Park Addition, also known as 1116 4th Street. Public Hearing: February 12, 2019. Ordinance 19-001. A public hearing was held on Ordinance 19-001, an Ordinance Amending Article ll of Chapter 42 of the Code of Ordinances of the City of Brookings, pertaining to the Board of Health. A motion was made by Council Member Wendell, seconded by Council Member Hansen, that Ordinance 19-001 be approved. The motion carried by the following vote: Yes: 7 - Niemeyer, Hansen, Kidwiler, Wendell, Bacon, Tilton Byrne, and Corbett. Resolution 19-015. A motion was made by Council Member Kidwiler, seconded by Council Member Niemeyer, to approve Resolution 19-015, a Resolution approving the appointment of Bonnie Foster as Acting City Clerk of the City of Brookings. A motion was made by Council Member Wendell, seconded by Council Member Tilton Byrne, to amend Resolution 19-015 to insert, "until such time as the position can be advertised and a search process can be completed." The motion failed by the following vote: Yes: 3 - Wendell, Bacon, and Tilton Byrne; No: 4 - Niemeyer, Hansen, Kidwiler, and Corbett. On the original motion, the motion carried by the following vote: Yes: 5 - Niemeyer, Hansen, Kidwiler, Bacon, and Corbett; No: 2 - Wendell, and Tilton Byrne. Resolution 19-015 - Resolution Approving the Appointment of an Acting City Clerk Whereas, the City Council is authorized pursuant to Section 2.08 of the City Charter to Appoint a Clerk; Now, Therefore, It Is Hereby Resolved by the City Council of the City of Brookings, South Dakota, that Bonnie Foster is hereby appointed as Acting City Clerk of the City of Brookings. A motion was made by Council Member Kidwiler, seconded by Council Member Tilton Byrne, to direct staff to research a new location for the Brookings Food Pantry. The motion carried by the following vote: Yes: 7 - Niemeyer, Hansen, Kidwiler, Wendell, Bacon, Tilton Byrne, and Corbett. Executive Session. A motion was made by Council Member Wendell, seconded by Council Member Niemeyer, to enter into Executive Session at 6:29 PM for purposes of consulting with legal counsel or reviewing communications from legal counsel about proposed or pending litigation or contractual matters; and discussing marketing or pricing strategies by a board or commission of a business owned by the state or any of its political subdivisions, when public discussion may be harmful to the competitive position of the business with the City Council, City Manager and City Attorney present. Council Members Hansen and Tilton Byrne did not enter into Executive Session. The motion carried by a unanimous vote. Summary: The Design-Build Larson Ice Center Project includes replacing both concrete rink floors, all associated cooling piping, mains, headers, and subfloor heating system in both ice rinks. Installing a subfloor drainage system capable of reducing ground water under both ice rink floors, and replacing an aging R-22 ice system. The new ice system will be an ammonia indirect system with all associated piping, headers, mains, and condensers required for a complete installation. Staff followed the Design-Build RFP requirements for this process and three Firms were invited to submit proposals. Staff conducted proposal evaluations and invited two Firms to interview for the project. Based on all relevant information provided in this process staff is recommending awarding the project to the McKinstry Firm from Roseville, MN. Recommendation: Staff recommends awarding the project to the McKinstry Firm from Roseville, MN to include replacing both rink floors, installing a rink water mitigation system, addressing overall site water mitigation options, and installing an Ammonia Indirect ice plant system. The recommendation is based on the McKinstry Firm being able to successfully meet the scope of work and selection criteria as identified through the Design-Build RFP process. Due to the urgent timeliness for scheduling, manufacturers lead timeline for manufacturing a new ice system, and the potential for a complete failure of the current R22 ice system, staff is recommending proceeding forward with this project as soon as possible. Person(s) Responsible: Paul Briseno, City Manager Summary: The Larson Ice Center Project includes replacing both concrete rink floors, subfloor heating system, installing water mitigation measures, and replacing the ice plant. A Design-Build RFP was followed for this process and three firms’ submitted proposals. After thorough evaluation and interviews, staff recommends awarding the project to McKinstry from Roseville, MN, with the implementation of an ammonia indirect ice plant. Background: The Larson Ice Center opened in 2002 and consists of two regulation sized ice sheets (Red/Blue Rinks) and a holding barn. The current R22-Indirect/Glycol ice plant traditionally has a life expectancy of 20-25 years. However, the Larson Ice Center is failing and professionals recommend the ice system and rink floors be replaced as soon as possible. The R22 skid is currently working as intended, however the condensers are aging and need replacing. The subfloor heating system is not working as intended and the heat exchanger has failed. In both rinks the steel mains and headers are documented as leaking and the concrete slab of the Red Rink has heaved several inches causing poor ice playing conditions and inefficiencies. In 2018 the City of Brookings prepared an Ice System Replacement Feasibility Report. The report documents the existing conditions as well as recommendations to consider moving forward. Discussion: Based on the review of the selection criteria, staff selected McKinstry with an ammonia indirect ice plant for the following reasons: Overall quality of their proposal and abilities of their professional personnel Experience with similar projects utilizing an ammonia indirect ice plant Capacity to meet the difficult scheduling window and budget requirements Provide 5 years of follow-up support on the project and will be single point of accountability Based on the Design-Build Procurement Procedures McKinstry is the Best Value Selection Based on information received from proposal submittals there were three options to choose from for the ice plant system, they included an Ammonia Indirect System, CO2 Indirect System and a CO2 Direct System. There are pros and cons with each type of system, staff recommends moving forward with an ammonia indirect system for the following reasons: Ability to isolate the Red and Blue Rinks independently by closing the respective glycol supply and return valves. A direct C02 system would likely require complete capture of the C02 charge or venting to the atmosphere. Maintaining different ice temperature set points in each rink is accomplished in a glycol system through the use of modulating, three-way, or mixing valves. Leak detection is more easily accomplished in a glycol piping system. The system will include built in "temporary" connection points to the main glycol headers allowing for the quick connection of a temporary chiller should the main refrigeration plant experience a failure. Ammonia systems are the most widely utilized replacement option for ice arenas throughout the U.S. The availability, proximity, and experience of installation and repair technicians for indirect ammonia systems far exceeds that of other options. Consultations with the Brookings Fire Department and primary code official indicated no reservations with the use of an ammonia refrigeration skid. Two of the three firms submitting a proposal supplied 30 year life cycle modeling cost projections that indicated the ROI on the ammonia indirect system was very comparable to that of a CO2 indirect or CO2 direct system. The timeframe for replacement and installation is April 2019 - August 2019. The ice floors and ammonia indirect system need to be operational for use by September 1, 2019. The firm may begin construction as construction documents are completed and as the facility schedule allows, with approval by the City. The firm shall complete all substantial construction services no later than August 30, 2019. Legal Consideration: The recommended Firm has submitted and met the bid bond requirements. Financial Consideration: The financial proposal from McKinstry is a not to exceed fee for professional and construction services of $3,690.278.00. Staff will work with McKinstry upon approval of the project regarding details of the contract. Staff will work with bond counsel to fund the project. Options: The City Council has the following options: 1. Award the project to the McKinstry Firm 2. Reject all proposals and restart the process Recommendation: Staff recommends awarding the Larson Ice Center ice plant and ice floor replacement to the McKinstry Firm. Background: The City received a petition to install sanitary sewer on Western Avenue from approximately 240 feet North of Martin Boulevard to approximately 530 feet North of Martin Boulevard. The City Council approved Resolution of Necessity 18-042 on May 22, 2019, authorizing the City to proceed with the project. The project location is shown on the attached map. There are three property owners on the East side of Western Avenue that did not have a sanitary sewer main adjacent to their property and were not hooked up to the City’s sanitary sewer system. This project provided an extension of the sanitary sewer main and each property received one sanitary sewer service. The project has been completed and the City is proceeding with the process to assess the property owners with their portion of the construction costs. Discussion: The project will be assessed based on special benefits where each of the three property owners will receive similar benefits and thereby would pay similar costs. The assessment cost is $33,504 and each property owner’s cost is $11,168.00. The assessment will be divided into ten (10) equal annual installments and interest of ten (10) percent per annum shall accrue on the unpaid balance of the assessment. The lease is being offered on a temporary basis to Mr. Hartung in the same manner as the previous tenant which will allow him time to build a hangar at the airport for the permanent location of his business. Background: Eric Hartung wishes to locate his sky diving business at the Brookings Regional Airport and he would like to lease a small office at the Airport Terminal on a temporary basis. He plans to construct a hangar on airport property in 2019 or 2020 for his business. The City previously rented 282 square feet of space in the Airport Terminal Building to a past tenant, which is being offered to Eric Hartung. The lease price will be $10.00 per square foot per year, which equates to $235 per month. Mr. Hartung will also pay the City for one-half of the monthly utility cost for the Terminal building. The Civil Air Patrol pays the other half of the utilities. This resolution will approve a lease through December 31, 2019. Discussion: According to FAA guidance, the City’s lease should be similar to each aviation tenant. Therefore, the lease is being offered to Mr. Hartung in the same size and price that was approved for the previous tenant. Legal Consideration: A public hearing is required as per SDCL 9-12-5.2 to lease to a private person: 9-12-5.2. Powers - Lease to private person - Resolution - Notice - Hearing - Authorization. If the governing body decides to lease any municipally owned property to any private person for a term exceeding one hundred twenty days and for an amount exceeding five hundred dollars annual value it shall adopt a resolution of intent to enter into such lease and fix a time and place for public hearing on the adoption of the resolution. Notice of the hearing shall be published in the official newspaper once, at least ten days prior to the hearing. Following the hearing the governing body may proceed to authorize the lease upon the terms and conditions it determines. The Notice of Public Hearing was published as required. Financial Consideration: The airport fund will receive $235 per month, plus one-half the utility cost from Eric Hartung. Options: The City Council has the following options: 1. The Lease will be an amount of Two Hundred Thirty Five Dollars per month ($235.00) and one-half the monthly utility costs at the Airport Terminal Building. Background: The City is proposing a lease for a parcel of property at the Brookings Regional Airport for United Development, LLC who recently finished construction of a new commercial hangar. The property is a designated hangar area, 80’ x 120’, for an area of 9,600 square feet in Section 27, Township 110 North, Range 50 West. The lease amount will be 9,600 square feet at the rate of $0.15/square foot as adopted in Resolution 18-071 for commercial uses. The term of the lease will be February 12, 2019 through December 31, 2023. The annual lease rate will be adjusted annually as adopted by the City Council.
