Public Hearing: September 25, 2018. Temporary Liquor License. A public hearing was held on a Temporary Liquor Applications from Aramark Educational Services, LLC, to operate within the City of Brookings, South Dakota on September 20 for the Festival of Books to be held at the SDSU Alumni Center, 815 Medary Avenue. A motion was made by Council Member Kidwiler, seconded by Council Member Tilton Byrne, that the Temporary Liquor Application be approved. A public hearing was held on Resolution 18-074, a Resolution of Intent to Lease to Precision Health Technologies, LLC the following described property in the Research and Technology Center, 811 32nd Ave., Brookings, SD. A public hearing was held on Ordinance 18-011, an Ordinance appropriating monies to fund the necessary expenditures and liabilities of the City of Brookings for the 2019 Fiscal Year and providing for the Annual Tax Levy and Annual Tax for All Funds. A motion was made by Council Member Bacon, seconded by Council Member Hansen, that Ordinance 18-011 be approved. Summary: The resolution will approve the final change order for 2018-09STI Recreational Trail Overlay Project with Bowes Construction, Inc. to adjust bid quantities to as-constructed quantities for a total decrease of $4,436.58 to close out the project. Background: The City of Brookings received a grant for the South Dakota Recreational Trails Program from the South Dakota Department of Game, Fish and Parks for asphalt overlays on several recreational paths in Brookings. The grant will reimburse the City for $83,000.00 of the project. The trails included in the project were the following: ·Trail east of Main Avenue South to Medary Avenue South, then southerly along Medary Avenue South to the Fishback Soccer Complex ·Trail along 22nd Avenue South, running south of 12th Street South and easterly along the shelter belt ·Trails in Larson Park, east of 22nd Avenue South The project is completed and is ready to be closed out. This change order will adjust the bid quantities to as-constructed quantities for a total decrease of $4,436.58 to close out the project. The following is a summary of the contract: Original Contract Price:$125,455.00 Increase from Previously Approved Change Orders:$0.00 Contract Price Prior to this Change Order:$125,455.00 Decrease of this Change Order (No. 1 Final):$4,436.58 Contract Price incorporating this Change Order:$121,018.42 Fiscal Impact: The contract will be decreased by $4,436.58 to close out the project and the City will receive $83,000 in grant reimbursement. YTD Budget to Actual    Investments:   We continue to see gradual increases in interest rates for our investments.  For August, our 1‐ year US Treasury Yield increased from 2.126% in July to 2.16% in 2018.      Sales Tax:   Sales Tax    o In September the SD Legislature passed a pair of bills impacting remote sellers and  marketplace providers.     Beginning November 1, 2018, remote sellers who meet certain thresholds must  obtain a SD sales tax license and pay applicable sales tax. A remote seller is one  without a physical presence in SD with gross revenues from sales into SD exceed  $100,000 or the business made sales delivery into SD in 200 or more separate  transactions.  This includes not only tangible personal property but any products  transferred electronically, or services.   Beginning March1, 2019, marketplace providers who meet certain thresholds  must obtain a SD sales tax license and pay applicable sales tax.  Marketplace  providers are required to remit sales tax on all sales it facilitates into SD if the  thresholds of 200 transactions in SD or $100,000 or more in sales to SD  customers.  o For August, 1st Penny, 25%, and 75% tax ended over 2017 receipts at 3.85%.    o 3rd B Tax ‐ Tax on Lodging, Alcohol and Prepared Food, ended the month at 2.61% over  August 2017.  o BID Tax (pillow tax) has consistently been performing below 2017 numbers however  does appear to be picking up steam ending August at ‐4.22% compared to last year.  July  was down ‐7.74% from 2017. Corbett, Mayor ATTEST: Shari Thornes, City Clerk City of Brookings, SD/SDSU Law Enf Agmt Page 1 of 6 LAW ENFORCEMENT AGREEMENT _________________________ WHEREAS, the City of Brookings ( “City”) through its Police Department and the Brookings Chief of Police ( “Chief”) has responsibility for law enforcement in the City of Brookings, and South Dakota State University, a public institution of higher education under the control and management of the South Dakota Board of Regents ( “SDSU”) has a responsibility to its students, faculty and the community of Brookings to provide a safe learning environment and for the protection of its physical grounds and property; and WHEREAS, the City of Brookings and SDSU agree that it is to their mutual benefit for University Police Department (“UPD”) personnel at SDSU to have the status as Brookings Police Department police officer to provide law enforcement efficiency and consistency for the benefit of the City and the students, faculty, staff of SDSU and the State of South Dakota. NOW, THEREFORE, the parties agree as follows: 1. Designation as Officer: SDSU may designate qualified persons to be appointed as police officers for the City. Appointments shall be made with the approval of the Chief and Brookings City Manager, and after such approval and upon swearing to the required oath, a SDSU Police Officer (“UPD Officer”) shall also have the status of Deputy City Police Officer. SDSU will designate a Chief of the UPD in accordance with the provisions of this Agreement. 2. Recruitment and Authorization of UPD Officer(s): The SDSU UPD will follow established SDSU and State of South Dakota policies and procedures for recruiting, screening, and hiring UPD Officers. SDSU will include one member selected by the City and one member mutually selected by the City and SDSU in its search committees. SDSU shall propose candidates for police officers to the City Manager and the Chief of Police for review prior to final appointment. SDSU shall provide information concerning background, work history, or other pertinent information for the evaluation of the SDSU candidate’s fitness for employment as a police officer. All officer candidates selected to fulfill the duties of a UPD Officer must be appointed by the City Manager prior to commencement of their employment. The City shall be diligent in its review of the police officer candidates and shall inform UPD of acceptance or rejection of the officer candidate as soon as possible. If a candidate is rejected, the City will provide written documentation outlining the justification for the rejection. Upon appointment by the City Manager, a completed South Dakota Law Enforcement Officers Standards and Training Commission application shall be submitted to the Chief for signature, authorizing the officer candidate to attend Law Enforcement Training as prescribed by South Dakota Law. Authorization as Law Enforcement Officers and Other Duties: All UPD Officers who have been duly sworn as police officers are hereby authorized as law enforcement officers of the City pursuant to South Dakota Codified Law 9-29-19 and amendments thereto, and in accordance with their appointment and this Agreement. Persons appointed as police officers pursuant to this Agreement may perform tasks which are unrelated to law enforcement at SDSU while also holding appointment as police officers. Assignment of other tasks by SDSU will be made in a manner which will not result in a conflict with their performance as a police officer. 4. Scope of Authorization: Persons appointed as police officers pursuant to this Agreement shall limit their law enforcement duties to the City of Brookings main campus of SDSU, other property owned by SDSU in the City of Brookings, and areas contiguous thereto, or if they are off campus for a valid official reason and observe an apparent violation of state law or city ordinance. Persons appointed pursuant to this Agreement shall perform law enforcement duties in a manner which complies with the standards approved by the Chief, and the currently adopted policies and the procedures of the UPD, and the City of Brookings Police Department. When SDSU police officers are performing duties on behalf of the Brookings Police Department, they shall be performing their duties as duly-appointed Brookings City Police Officers. If there are any conflicts between City of Brookings and UPD policies and procedures, the Chief and UPD Chief shall identify the conflict and develop a mutually acceptable policy or provide a procedure to resolve the conflicting provision. The City agrees that officers of the Brookings Police Department will only perform law enforcement duties on the campus of SDSU and on other properties owned by SDSU at the request of the University Police Department, or if they are on campus for a valid official reason and observe an incident or activity which places the well being of any person in jeopardy, or as part of an investigation. The City of Brookings Police Department Officers shall provide the SDSU UPD with notice in accordance with best practices if their activities require them to be on-campus or on SDSU property. Similarly, UPD Officers shall provide notice to City of Brookings Police Department Officers in accordance with best practices if their activities require them to be off-campus. 5. Training: All persons appointed police officers pursuant to this Agreement shall meet the required minimum standards of training for a law enforcement officer as provided by South Dakota State law and by the South Dakota Commission of Law Enforcement Officers Standards and Training, and such further standards as the City may from time to time reasonably require. The training procedures shall be substantially identical except for differences related to equipment/weapons City of Brookings, SD/SDSU Law Enf Agmt Page 3 of 6 unique to each department. In the interest of promoting consistency in cross- training, the City and SDSU will collaborate by sharing training resources. In recognition of unique characteristics of the campus and community law enforcement environments, the Chiefs shall mutually develop a cross-training program to develop skills of City Police Officers for campus and SDSU property law enforcement and UPD Officers for community law enforcement. It is agreed that each new officer for each department shall be provided one training and familiarization shift with a Field Training Officer (“FTO”) from the other unit. If it is determined by the FTO that an additional training and familiarization shift(s) are necessary, the training agency agrees to provide such additional training. Newly appointed officers shall receive this training program within the first six (6) months of appointment. Both parties shall seek to develop and implement opportunities for mutual training, utilizing resources of each department where practical. 6. Access to Reports: The Parties to this Agreement agree to provide mutual access to law enforcement reports that could lead to investigations and incidents of criminal nature impacting their respective jurisdictions and any related legally required reporting requirements. 7. Disciplinary Actions: a. Notice of Disciplinary Action: Once an applicant is appointed, the City shall be notified of any disciplinary action and substantiated complaints leading to disciplinary action involving UPD Officers in the deployment of their law enforcement duties. This information will be provided within the confidentiality parameters set by South Dakota State law and South Dakota Bureau of Personnel guidelines. b. Disciplinary Action Process: SDSU shall issue all discipline and discharge actions consistent with all rules, regulations, and policies of the State of South Dakota, Board of Regents, South Dakota State University, and the SDSU Police Department. i. The City may suspend or revoke the appointment of a UPD Officer for just cause based upon the City’s policies. In the event of such action, the City shall notify the SDSU UPD Chief of this action and the basis for this action. SDSU shall suspend the authority of the police officer to act in that capacity until final resolution of appropriate discipline, discharge, or re-instatement. A UPD Officer whose appointment has been revoked by the City Police Chief or City Manager may be retained by SDSU for functions other than law enforcement and campus security. ii. AUPD Officer whose appointment by the City has been revoked shall have the right to appeal that action and request a hearing. Such appeal and request for a hearing must be initiated in writing City of Brookings, SD/SDSU Law Enf Agmt Page 4 of 6 to the City Police Chief (with a copy to the SDSU Police Chief) within five (5) working days of the date the appointment was revoked. Failure to appeal and request a hearing within that time frame shall result in the permanent revocation of the appointment. iii. In the case of an appeal, a review board shall be established consisting of two members appointed by the City, two members appointed by SDSU and one member mutually appointed by the City and SDSU. The review board shall conduct a hearing within thirty calendar days from the date the appeal is received. The review board will deliver a written recommendation to the SDSU Vice President for Technology and Security, or successor, and the City Manager for a final decision within ten (10) calendar days after the hearing. Should the SDSU Vice President for Technology and Security and City Manager determine the appointment was unjustly revoked, the officer’s appointment shall be fully restored by the City Police Chief. However, the City retains final authority over UPD Officer appointment status pursuant to Sections 1 and 2 of this Agreement. c. South Dakota Commission of Law Enforcement: The City, SDSU, or the employee may pursue other procedures before the State of South Dakota Commission of Law Enforcement Officer’s Standards and Training, which has the ultimate authority concerning a police officer’s commission. 8. Employment Related Costs: SDSU will be responsible for all costs incurred for wages, benefits, training, equipment, and uniforms for its employees. Costs associated with joint training shall be mutually agreed upon by the Parties to this Agreement prior to implementation of the training. 9. Notice of Employment Discontinuation: SDSU agrees to notify City when UPD Officers cease employment so the City can maintain accurate rosters of current personnel. 10. Indemnification: Nothing in this Agreement shall be construed as an indemnification by one party of the other for liabilities of a party or third persons for property loss or damage or death or personal injury arising out of the performance of this Agreement. Any liabilities or claims for property loss or death or personal injury by a Party to this Agreement or its agents, employees, contractors, or assigns or by third persons, arising out of and during this agreement shall be determined according to applicable law. 11. Insurance: SDSU and the City shall each maintain occurrence based general liability insurance or equivalent form, with a limit of not less than $1,000,000.00 each occurrence. If such insurance contains a general aggregate limit, it shall City of Brookings, SD/SDSU Law Enf Agmt Page 5 of 6 apply separately to this Agreement and shall be no less than two times the occurrence limit. The City of Brookings understands and agrees that SDSU is subject to the limitations of liability set forth in SDCL Chs. 3-21 and 3-22; that SDSU participates in the Public Entity Pool for Liability Agreement; and the coverage provided thereunder constitutes SDSU’s sufficient coverage for this section. 12. Workers Compensation: All officers in the course of their duties shall remain employees of their employing agency, the parties are not joint employers, and, therefore, shall continue to be covered by their employing agency for the purpose of Workers Compensation. The Parties to this Agreement shall comply with the Workers Compensation requirements of South Dakota law. 13. Joint Powers: The appointments and authorizations contained herein do not constitute a joint exercise of powers pursuant to SDCL Ch. 1-24. 14. Mutual Communication: The Parties to this Agreement agree to have their representatives conduct joint meetings as often as deemed necessary, but no less than annually, and as requested by either party during the term of this Agreement to discuss issues of mutual interest and concern in regard to the performance of this Agreement. It is anticipated that items brought forward during the meetings may result in amendments to this Agreement. All such amendments shall be in writing by the dully authorized representatives of the Parties to this Agreement. 15. Choice of Law: The Parties to this Agreement will comply with all laws applicable to this Agreement and the performance thereof. This Agreement is governed by and shall be construed in accordance with the laws of the State of South Dakota and any lawsuit pertaining or related thereto shall be venued in the courts of South Dakota. 16. Failure of Appropriation: This Agreement depends upon the continued availability of appropriate funds and expenditure authority from the Legislature for this purpose. If for any reason the Legislature fails to appropriate or grant expenditure authority or funds become unavailable by operation of law or federal funds reductions, this Agreement will be terminated by the State and SDSU. Termination for any of these reasons is not default by the State and SDSU nor does it give rise to a claim against he State of South Dakota or SDSU. 17. Agreement Term: The term of this Agreement shall be three (3) years, beginning September 30, 2018 and terminating September 29, 2021 unless extended by mutual written agreement. Staff drafted a permit parking program which will be made available to tenants in the B-1 area. The permit parking would allow a six month license for $100 or annual for $180. As a new program the utilization will be monitored and adjusted according to the demand. Initially ten parking stalls will be made available at the 3rd Avenue and 5th Street parking lot. Should the demand warrant more stalls, staff can adjust available reserved parking stalls. The first step in implementing the downtown permit parking program is to modify Chapter 82 of the Code of Ordinances, which pertains to permitted parking in municipal parking lots. The current ordinance limits parking to a maximum of 72 hours in a municipal parking lot. This ordinance amendment will allow parking in a municipal parking for a duration longer than 72 hours in designated spaces determined by the City’s parking permit program. Background: The 35 acre property is located on the west side of I-29 and is part of the entry way corridor. The purpose of the I-1R District is to allow for aesthetically pleasing development along major arterials and highly visible areas and protect gateways to the community. Historically, the land and structures were used as a regional distribution center for Coast to Coast stores. CRC Global Solutions has used the property for the past ten (10) years to provide warehouse services to companies. There are two (2) existing buildings on the property. The larger building was constructed in 1977. The City approved a site plan for the hoop structure in 2004. The bins will provide storage for fully processed soybean seeds. The bins will be 44 feet in height which is approximately the same height as the hoop structure. The bins will be used for storage of a finished product only and the use will be significantly less intensive than a typical grain terminal. The turnover of seed will be relatively low causing slight increase in truck traffic. The existing streets and infrastructure are adequate to serve the proposed project. The applicant met with the Development Review Team (DRT)on August 23,2018 to discuss the project.The intensity of the use,screening measures,utilities,drainage,access and other factors were discussed.The I-1R District requires a minimum of 10 trees per acre.In this case,350 trees are required due to the large size of the parcel.There are currently about 100 existing trees and a hedge on the property.The applicant is proposing to add a total of 28 trees to provide screening from surrounding businesses and the I-29 corridor.The Planning Commission and City Council may authorize a waiver from the number of required trees.The proposed site plan meets all the other requirements of the I-1R District. The City Engineer is suggesting that the bins be placed on a current asphalt surface, by doing this the green space would not change and a drainage plan would not be required. Thomas Lombard, Special Projects Manager for CRC, explained how the business works and how the bins work. Fargen asked if these bins will have a dryer mechanism. Rasmussen asked Lombard if he was ok with the City Engineer comments regarding the drainage. Lombard explained that this cement slab isn’t going to be large and it shouldn’t have much of an effect on the drainage and they have a good drainage system. Jorgensen asked if any part of this will be fenced? Lombard stated no, these bins are stationary, the electric will be locked up, and the bins will be 15 to 20 feet high without ladders. Siver asked Lombard if he would be willing to provide additional green space if he is going to be removing some grass to install the grain bins on the west side. Lombard explained that they have 75 to 100 truck tractors come in each day and they need to have parking available for them. He wouldn’t like to have these drivers parking on the street and down the road. Tornquist asked if the street system can handle the traffic. Lanning explained that the City doesn’t have any concerns with the traffic. Tornquist is concerned that if the applicant removes the hedge, they are going to be losing some trees/shrubbery. Lombard explained that the new trees, because of the size of the trees, will be more beneficial than the shrubs. Tornquist and Aiken feel that 350 trees is excessive, but they would like to see more than 128 trees. Struck explained that staff came up with this number of trees based on the thought that the trees need room to grow. Aiken wonders if additional trees could be planted along the driveway leading in. Lombard is concerned about trees being planted here because of the snow that accumulates at the driveway. Rasmussen feels that staff has reviewed this plan and has recommended an additional 28 plantings, and he agrees with the staff recommendation. CRC GLOBAL SOLUTIONS – SITE PLAN BROOKINGS, SD CRC South Dakota is a 3rd party warehouse operation in Brookings, South Dakota. Currently we warehouse agricultural seed products such as Corn, Soybeans and Alfalfa. For our Brookings location to continue its strategic presence in distributing seed products to the Midwest we must do two projects that will expand the scope of the business and services we provide. The two projects are: A multi-bin storage & delivery system, it will be located on the west edge of the southside of the property in front of the Hoop warehouse. This system will hold only clean soybean seed that will be delivered to our warehouse to be picked up and/or delivered to the end user area farmers. The six bins will have a capacity to hold 30 thousand bushels of clean seed that is 5 thousand bushels each. They will have between 1 to 5 thousand bushels of seed in each of them. That would be a maximum of 30 thousand bushels of seed at any time stored in them. Currently we expect to turn the bins 4 times during the season. This would be approximately 100 to 120 thousand bushels of clean seed. The bins will be self-contained as will the delivery systems. There will be no dust or smell from this operation. The bins will be used for approximately 6 months out of the year. The site will be kept clean and maintained by the warehouse staff. o The clean soybean seed will be brought in bulk by semi’s, the product will be off loaded into the bins for storage. o The soybean seed will be loaded for delivery to the customers in reverse order of loading. The second proposed project is a 2-bin bulk soybean delivery system. These bins will be placed up next to the warehouse toward the east end in front of doors 13 & 12. These bins will be 2 – 1,200-bushel storage bins. The bins will only have clean soybean seed in them when getting ready for a pickup. The seed will be loaded into the bin from inside the warehouse with seed that is already onsite. We will only fill the bins as needed for that day’s delivery or pickup. The bins will be empty from July to April. I would say that the bins will be empty 95% of the time during the year. CRC GLOBAL SOLUTIONS –SITE PLAN BROOKINGS,SD o The seed for this project will already be in the warehouse in Mini-bulk bags or Seed paks. The seed will be moved to the staging area the day before delivery is scheduled. The bins will be loaded for delivery 4 hours before scheduled pickup. Both proposed projects will be enclosed systems. This means that the conveyors and auger are enclosed and not opened during operation. Neither of these projects will be involved in any seed processing. Truck traffic ~ I do not foresee a large increase in truck traffic. The reason for this is the same amount of seed will be moved into the warehouse regardless if it comes in as bulk seed (for the multi-bin system) or packaged seed (for the two bin-system). Project Address: 2500 Eastbrook Drive Project Overview: Proposing to add 6 bins for storage of clean soybean seed and a two (2) bin bulk delivery system. Developer’s Timeline: Scheduled for Planning Commission on September 4, 2018. Construction timeframe is to be determined. Zoning: Industrial I-1R Restricted. The district is intended to provide for aesthetically pleasing industrial development along major arterials and highly visible areas. The I-1R District requires site plan review by the Planning Commission and approval by the City Council. The intensity and design of the project is considered on a site specific basis. Bins are 44 feet in height and the district allows structures up to 50 feet in height. Platting: Both lots are already platted. Lot 1 (Including Lot H-1) Block 2, & Lot 6, Block 2, Insbrook Park Addition Electrical Service Area: Existing electrical is sufficient. Electrical substation is located to the south and dust will affect the operation; however, this is not expected due to the clean nature of the product and closed bin system. Traffic & Emergency Access: Streets and access is existing. No concerns. Connectivity: N/A Stormwater: Drainage plan may be needed prior to a building permit as approximately 4,000 sq. ft. of impervious surface will be added. Jackie Lanning will do some research and make this determination. The bins could be moved to an area that is already impervious so a drainage plan would not be required. Sidewalks: N/A City Utilities: No concerns. -2- Assessments: N/A Detention: Covered under Stormwater. Landscaping: Zoning Ordinance requires a minimum of 10 trees per acre to be placed in the front 50 feet of the lot and 25 feet of the side/rear yard. In this case, the ordinance calls for 350 trees due to the large parcel. The applicant may ask for a waiver through the approval process. There are currently about 100 existing trees and a hedge on the property. Staff supports fewer trees so long as they are of a larger variety with a minimum three (3) inch caliper and strategically placed every 50 feet to provide a buffer from the I-29 corridor and surrounding businesses to the north and west. The specific tree species may be determined at a later date with approval of the Parks and Forestry Director. Building Plans: Engineered foundations will be required for bins. Summary: This resolution will authorize the City of Brookings to receive Lot 1 and Lot 2, Block 2 in the Nelson 5 th Addition from CD Properties for the purpose of a detention pond and lift station. Background: The City Engineering and Brookings Municipal Utility staff worked with CD Properties, LLC, developers of the Reserve Addition, regarding the donation of Lot 1 and Lot 2, Block 2 in Nelson 5 th Addition to the City of Brookings. The developer platted Lot 1 and 2, Block 2, for the purposes of a detention pond adjoining the City’s detention pond and for a sanitary sewer lift station. The developer met the requirements of the City and BMU regarding the work and staff is agreeable to the acceptance of the lots. Fiscal Impact: There will be costs for mowing and BMU will incur costs to maintain the lift station. Recommendation: Recommend approval of the resolution. Attachments: Resolution Plat map City of Brookings Printed on 9/20/2018Page 1 of 1 powered by Legistar™ Resolution 18-079 A Resolution Accepting A Conveyance of Real Property in Nelson 5th Addition to the City of Brookings, South Dakota WHEREAS, CD Properties has conveyed certain real property to the City of Brookings, South Dakota, consisting of a detention pond and lift station, to be used for public purposes and specifically to provide a sanitary sewer lift station and additional detention for drainage purposes in Nelson 5th Addition, said real property being described as follows: Lot One (1) and Lot Two (2) of Block Two (2) in Nelson 5 th Addition to the City of Brookings, County of Brookings, State of South Dakota, and WHEREAS, the City Council recognizes the benefit the community will receive as a result of the conveyance of this real property, NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council that the real property described above is hereby accepted by the City of Brookings, South Dakota. Summary: The City is implementing a permit parking program for tenants in the downtown B-1 area. The City will make available 10 parking stalls in the City’s 72-hour parking lot located on the west side of 3rd Avenue between 4th Street and 5th Street. This resolution will set fees for the permit parking program. Background: The City received a request from a downtown tenant to consider implementing a downtown permit parking program to allow vehicles to park in a City lot for a longer duration due to the limited overnight street parking in the downtown area. Staff drafted a permit parking program which will be made available to tenants in the B-1 area. The permit parking would allow a six month license for $100 or annual for $180. As a new program, the utilization will be monitored and adjusted according to demand. Initially, ten parking stalls will be made available on the 3rd Avenue and 5th Street parking lot. Should the demand warrant more stalls, staff can adjust available reserved parking stalls. The permit parking program will be administered by the City Engineering Department. This Resolution will set the fees for the parking permits. Fiscal Impact: The City will have initial costs of signage and vehicle tags and will receive revenue from the downtown permit parking fees. Now, Therefore, Be It Resolved that the fees for Permitted Parking in Municipal Parking Lots be $100 for a six-month permit and $180 for an annual permit.
