ORDIHANCE NO. 29-92
AH ORDIHAHCE GRAHTING TO HORTHWESTERN PUBLIC SERVICE COMPAHY, ITS
SUCCESSORS AHD ASSIGNS, THE RIGHT TO OCCUPY ANY OF THE STREETS, ALLEYS
OR PUBLIC PLACES OF THE CITY OF BROOKIHGS, SOUTH DAKOTA, FOR THE
PURPOSE OF TRAHSKITTIHG OR DISTRIBUTIHG HATURAL GAS.
BE IT ORDAIHED BY THE CITY OF BROOKIHGS, SOUTH DAKOTA TO WIT:
I.
Section 1. The right is hereby granted to Aorthaestern Public
� Service Company, its successore and assigns, to occupy any of the
streets, alleys or public places of the City of Brookings, South
Dakota, for the purpose of transmitting or distributing natural gas
for a period of trenty (20) years from the 15th day of December, 1992,
provided, however, that the right herein granted ehall not be
exclusive.
Section 2. The grantee ahall be liable for all damages due to
its negligence in constructing, operating or maintaining its netural
gas system aithin the said municipality, and shall at all times save
the said municipality harmless from any and all liability arising out
of negligence of the grantee.
Section 3. This Ordinance shall not be effective unless said
Company shall �ile its unconditional acceptance of this Ordinance Mith
the City Commiseion of said City Nithin forty-five (45) days after the
publication of said Ordinance.
II.
All ordinances in conflict herewith are hereby repealed.
