BE IT ORDAIHED BY THE GOVERHIHG BODY OF THE CITY OF BROOKIHGS THAT SECTIOH 34-250 OF THE REVISED ORDINAHCES OF THE CITY OF BROOKINGS BE AND THE SAME SHALL HEREBY BE AMENDED TO READ AS FOLLOWS, TO-WIT: I. Section 34-250 - Places Where Prohibited. Except when necessary to avoid conflict with other traffic or in compliance with law or the directions of a police officer or official traffic control device, no person shall stop, stand or park a vehicle: (Subparagraphs a through k unchanged) ( 1 ) Upon any boulevard. (This provision shall not be applicable to boulevard parking pursuant to a epecial boulevard parking permit granted pursuant to policies and procedures established by the City Commission> . II. '• 18 0 t�,���.• o Mayor S O.S � Finance Officer RESOLUTIOH H0. 95-92 - ESTABLISHZHG BOULEVARD PARKING POLICIES AHD PROCEDURES BE IT RESOLVED by the Board of Commissioners of the City of Brookings, South Dakota as folloas: IN ORDER to continue to occupy the City boulevard parking with a Boulevard Parking Space after July 31, 1993, the owner of property contiguous to the boulevard must have obtained a Boulevard Parking Permit. APPLICATION for this permit ahall be made by the owner on a regular building permit form obtained at the City Engineer's Office, P. O. Box 270, 311 Third Avenue, Brookings, SD 57006 (605-692-6629). AH EXISTIHG asphalt or concrete surfaced boulevard parking space may be granted a permit by the City Engineer if all of the following conditions are met: l. The dimenaions of the parking space are a minimum of 8' x 17' 2. Access to the space is from the street with a curb cut or mountable curb or from a legal driveway in the case of spaces parallel to the street. 3. The parking space was in place and completely surfaced with asphalt or concrete before the date of passage of Ordinance No. 27-92 (i1-24-92). 4. The surfacing is in good condition A PROPERTY OWNER may appeal the decision of the City Engineer to the Board of Adjustment if a permit is refused. All regulations of the Board of Ad�ustment will then apply. AFTER July 31, 199�, every boulevard not covered by a Boulevard Parking Permit shall be restored to a grassed area and shall have any curb cut or broken back curb replaced rith curb matching the local street. Failure by the owner to make these boulevard repairs by July 31, 1993, Mill constitute a default alloring the City to cause such restoration and repairs to be made and the cost collected from the property o�ner by assessment or court action. ' DURIHG periods of snoM removal phen vehicles are prohibited from parking on atreets they may temporarily be placed upon a boulevard contiguous to the property orrned or rented by the vehicle oaner. Except when necessary to avoid conflict with other traffic, - or in compliance with law or the directions of a police officer or official traffic-control device, no person shall stop, stand or park a vehicle: _ (a) On the madway side of any vehicie stopped or paxiced at the edge or curb of a street; (b) On a sidewalk; , (c) Witiun an intersection; (d) On a crosswalk; (e) Between a safety zone and the adjacent curb or within thirty (30) feet of points on the curb immediately o� posite the ends of a safety zone, unless a different length is indicated by signs or mariflngs; (f) Alongside or opposite any street excavation or obstruc- tion when stopping, standing or parldng would obstruct traffic; (S) Upon any bridge or other elevated structure upon a highway or within a highway tunnel; (h) On any railroad tracks; (i) At any place where official signs prohibit stopping; (j) Upon private propertq without the prior consent of the person lawfully in possession of such premises; (k) In front of a private driveway; (1) LJpon anp boulevard contiguous to private �property owned by another.
