AN ORDINANCE LIMITING THE NUMBER OF MALT BEVERAGE RETAILER
LICENSES AND OK-SALE WINE LICEHSES IN THE CITY OF BROOKINGS, SOUTH
DAKOTA.
BE IT ORDAIHED HY THE GOVERHING BODY OF THE CITY OF BROOKIHGS,
SOUTH DAKOTA, AS FOLLOWS, TO-WIT:
I.
WHEREAS, the Governing Body of the City of Brookings has reviewed
the issue of the increasing number of malt beverage retailer licenses
and has determined that it is in the beat interest of the City to
control the number of malt beverage retailer licenees and on-sale vrine
licenses approved by the City of Brookings; and
WHEREAS, South Dakota Codified Laws Section 9-29-7 alloMs
municipalities to prohibit or regulate the transaction of business in
alcoholic beverages, now therefore
The City of Brookings hereby prohibits the consideration for
approval of any new or additional malt beverage retailer licenses or
on-sale wine licenses until such time as the City Commission has
passed and published further regulations concerning the issuance of
new malt beverage retailer licenses and on-sale wine licenses or the
City determines it is in the best interest to remove the prohibition
set forth in this Ordinance.
This prohibition does not prevent transfer or renewal of existing
licenses.
This Ordinance is necessary for the immediate preservation of the
public pesce. health, safety or support of the municipal government
end its public institutions and shall take effect upon the passage and
publication thereof.
II.
All ordinances in conflict herewith are hereby repealed.
