ORDINAHCES OF THE CITY OF BROOKIHGS, SOUTH DAKOTA AHD PERTAIHING TO
THE BROOKIHGS HOUSING AND REDEVELOPMENT COMMISSION.
BE IT ORDAIHED BY THE GOVERHING BODY OF THE CITY OF BROOKIKGS,
SOUTH DAKOTA, AS FOLLOWS, TO-WIT:

ARTICLE II. BROOKIHGS HOUSING AND REDEVELOPMENT COMMISSIOH. i

Sec. 19-i1. Formation, purpose. :
�
The Brookings Housing and Redevelopment Commission, a South
Dakota Honprofit Corporation, has been formed to administer, contract,
control and supervise HUD Section 8, existing certificate, voucher,
moderate rehabilitation and other related housing programs through the
use of municipal, county, state and federal funds. �

Sec. 19-12. Composition; appointment. !
The Brookings Houaing and Redevelopment Commission provided for
by this article shall be composed of five (5) Direators. Three (3) of
the Directors shall be duly qualified residents and electors of the
city and shall be appointed by the mayor with the approval of the city
commission. Two (2) of said Directors shall be residents and electors
of the county residing outside the corporate limits of the city and
shall be appointed by the chairman of the board of county
commissionera with the approval of the county commission.
Sec. 19-13. Terms.
The Directors of the Brookings Houaing and Redevelopment
Commission shall be initially appointed for terms of one (1), two (2),
three (3), four (4) and five (5) years, respectively, provided at the
first meeting in January of each year one ( 1) membera ahall be
appointed, except in the event a vacancy occurs on a date other than
the first Monday of the year, then the vacancy may be filled by
appointment for a term not exceeding five (5) years, rrhich term shall
expire on the first Monday in January. After the initial appointment
of Directors to the commission, all Directors shall be appointed for
terms not exceeding five (5) years.
Sec. 19-14. Ex-officio Directors.
One ( 1) Director each of the city commisaion and county
commission to whom housing matters relate shall be asaigned as
ex-officio Directors of the Brookings Housing and Redevelopment
Commission.
Sec. 19-15. Meetings.
The Brookings Housing and Redevelopment Commission shall hold !
meetings at least once esch calendar quarter at a time and place to be
established each year at the annual meeting. Special meetings may be '
called at any time by the chairperson by giving at least twenty-four
(24) hours' advance notice in accordance with SDCL 1-25-1. 1.

Sec. 19-16. 9uorum of Directors/officers/rules.
The poNers of' the Brookinge Housing and Redevelopment Commission
shall be vested in the Directors thereof in office at any time, a
ma�ority of whom shall constitute a quorum for all purposes. The
Commiesion shall select a chairperson, a secretary and a treasurer
from among its Directors who shall hold their offices respectively one
( 1 ) year and until their succeseors have been appointed. The
commission shall adopt such bylaws and other rules for the conduct of
its affairs as it deems appropriate.
Sec. 19-17. Expense of commissionera.
No Director shall receive compensation for their services, but
Directors shall be entitled to receive necessary expenses, including
traveling expenses, incurred in the performance of their duties.
, Sec. 19-18. Commission as Hon-Profit Corporation/General PoMers.
The Brookings Housing and Redevelopment Commission shall be
organized as a South Dakota Nonprofit Corporation and shall have all
of the power necessary or convenient to carry our the purposes set
forth herein together pith the povrers granted by SDCL Chaptere 11-7
and 11-7A, inclusive; but the commission shall not have the power to
levy or collect taxes or special aesesements. The Brookings Housing
and Redevelopment Commission shall have the power and authority to
superintend, manage, administer and control local, etate and federal
houeing programs within its �urisdiction, including the poper to
contract with individuals, public and private firms to adminieter said
housing programs on behalf of this commission.
Sec. 19-19. Collection of funds.
All funds and revenues derived from the operation of the
Brookings Housing and Redevelopment Commission may be collected by the
city finance officer, and a record of all such funds and revenues
shall be submitted at least quarterly to the city commission and
county commission.
II.
Al1 ordinance in conflict herewith are hereby repealed.
