AH ORDIHAHCE ESTABLISHING A PROCEDURE FOR REVIEW OF' APPLICATIONS
FOR ALCOHOLIC BEVERAGE OH-SALE AGREEMEHTS AND APPLICATIOHS FOR ON-SALE
MALT BEVERAGE AND WINE LICENSE.
BE IT ORDAINED BY THE GOVERHIHG BODY OF THE CITY OF BROOKINGS,
SOUTH DAKOTA, AS FOLLOWS, TO-WIT:
I.
The City Commisaion shall revieM all applications submitted to
the City for available On-Sale Alcoholic Beverage Agreements and for
On-Sale Malt Beverage and Wine Licenaes in accordance rith SDCL 35-2
and in accordance with the folloMing factors:
1. �pe of business rrhich avplicant provoses to overate:
On-Sale Alcoholic Beverage Operating Agreementa and On-Sale Malt
Beverage and Wine Licenses may not be issued to convenience
grocery atores, gas stations or other stores where groceries or
gasoline are sold unless it can be established that minors do not
regularly frequent the establiehment.
2. The manner in which the business is otaerated:
On-Sale Alcoholic Beverage Operating Agreements and On-Sale Malt
Beverage and Wine Licenses may not be issued to establishmente
rrhich are operated in a manner which results in minors regularly
frequenting the establishment.
3. The extent to Nhich minors are emoloved in such a alace of
bueiness•
On-Sale Alcoholic Beverage Operating Agreements and On-Sale Malt
Beverage and Wine Licenses may not be iasued to convenience
grocery stores, gas stations or other stores where groceries or
gasoline as sold and which regularly employ minors.
4. The adeQuacv of the police fecilities to vroverlv volice the
proposed location:
The City Commission shall inquire of the Police Chief rhether the
Police Department can adequately police the proposed location.
5. Other factora:
The hours that business is conducted shall be considered by the
City Commission in its review of applicatione for On-Sale
Alcoholic Beverage Operating Agreements and On-Sale Malt Beverage
and Wine Licenses.
