HomeMy WebLinkAboutOrdinance 07-1993 � . � , ., ORDIHAHCE H0. 07-93 AH ORDINAHCE REVISIHG THE ZONING ORDINANCE OF THB JOINT JURISDICTIOH AREA SURROUNDING THE CITY OF BROOKINGS PERTAINIAIG TO THE AGRICULTURAL DISTRICT A. BE IT ORDAINED by the governing body of the City of Brookings, South Dakota, as follows, to-wit: I. That Section 405. , Agricultural District A, be amended se follors: 408. 13 One mobile home, on an established farmstead to be used for the occupancy of a farm employee, or by parente, grandparents, children or brothers and sisters of the occupant of the land, provided that seid mobile home is removed Mithin ninety (90) days of the vacation therefrom by the qualified occupant or occupants. 409. 7b Single family residences legally built under these ordinances shall be considered an established farm building site after it has exieted ten (10) years. 409. 7c The Board of Ad�ustment may deny any request for a smaller minimum lot size if it is determined to be an attempt to circumvent the intent or requirements of this ordinance. 409. 9 Move in Buildings: a. Any building moved into the Agricultural Dietrict must secure a building permit from the County Zoning Officer. b. Any residenae moved into the Agricultural District must have signature by petition of one hundred percent ( 100%) of the ad�oining landoMners and one hundred percent (100%) of the landoMners within tMo hundred (200) feet. EXCEPTION: A neM residence to be used for first occupancy, conBtructed off the property and moved to location ehall not require ad�oining landoMners' approval. 409. 10 Minimum Water and SeNer Requirements: A Mater and seMer eystem cannot be approved until it meets the folloMing standards: a. All public utilitiee and facilities shall be located, elevated, and constructed to minimize or eliminete flood damage; and b. All neM or replacement rater supply systems and sanitary sewage systems, in addition to meeting the requirements of the South Dakota Department of Environment and Hatural Resources muet be deslgned to minimize or eliminate infiltration of flood Maters into the systems and discharges from the eysteme into flood Naters. . . Al1 mobile homes regardlese of location, shall be tied doMn ae prescribed by the Defense Civil Preparedneee Agency, TR-75, issued June, 1972, by the U. S. Department of Defense. II. All ordinance in conflict hererith are hereby repealed.
