AH ORDIHANCE AMENDING CHAPTEB 7 OF THE REVISED ORDIHANCES OF THE
CITY OF BROOKIHGS AND PERTAIHIHG TO AHIMALS ARD FOWL.
BE IT ORDAIHED By the governing body of the City of Brookinga,
South Dakota that Chapter 7 of the Revised Ordinances of the City of
Brookings be amended as folloMs, to-Mit:
Section 7-12 - Enforcement. The Animal Control Officer or any
properly designated city employee is authorized to enter upon private
property for the purpose of enforcing Section 7-11. Ho person shall
conceal any animal or othervrise interfere with the proper enforcement
of Section 7-il. The Animal Control Officer or any properly
designated city employee may impound an animal in violation of Section
7-11.
Section 7-13 - Penaltv. If the owner in possession of an animal
refuses to provide proof of rabies vaccination as requested in Section
7-51, or any person otherwise violates the provisions of this chapter,
said conduct shall constitute a violation punishable upon conviction
by a fine of not more than two hundred dollars (5200. 00) for each
offenae. Each day a violation occurs shall constitute a separate
offense.
Section 7-48 - Doas involved in bite incidents. A dog that has
bitten any person or exhibited a propensity to attack or bite human
beings and this propensity to attack or bite human beings is knoMn to
the owner, shall not be allowed off the premises of its owner unless
muzzled and on a leash in charge of the owner or a member of the
owner's immediate family over sixteen ( 16) years of age. Any dog that
has been declared to be a biting dog and is subsequently found off the
premiaes of its owner and contrary to the procedure set forth in this
ordinance, may be seized by any person and upon delivery to the proper
suthorities, may upon establishment of the biting character of seid
dog, be humanely disposed of by an Animal Control Officer or other
person or persons authorized by the governing body. A complaint may
also be brought for said violation.
Section 7-49 - Revuired. It shall be unlawful for any person
within the city to keep, maintain or have in their custody or under
their control, any dog or cat r►hich is over the age of three (3>
months, rithout first having obtained a license from the City Health
Department or an suthorized agent.
Section 7-50 - Apvlication. Any person or designated agent
desiring to keep, maintain or have in their custody or control Mithin
the city, any dog or cat, shall on or before the thirty-first day of
December of each year make application to the City Health Department
or an authorized agent for a license to keep such dog or cat. Such
application shell be in Mriting stating name, sex, color and other
distinguishing characteristics, suah as "guard dog", of said dog or
cat and the name of the owner thereof, ahich application shall be made
on a printed blank furnished by the City Health Department or an

authorized agent and shall be filed with said City Health Department
or an authorized agent.
Section 7-51 - Rabies vaccination required. Ho dog or cat
license tag shall be issued to any owner of any dog or cat who does
not present to the City Health Department or an authorized agent at
the time of making application for such license, a certificate of
vaccination against rabies by a veterinarian duly licensed to practice
veterinary medicine within any etate. The certificate must show the
date of such vaccination and must state the period of time for Mhich
the dog or cat is effectively immunized, r+hich period of immunization
must be for at least one ( 1 ) year from date of issuance of license.
Section 7-52 - License fee. Before any license shall be issued
under the provisions of this chapter, the applicant shall pay to the
City Health Department or an authorized agent a fee for each dog or
cat to be license. The annual fee for seid license shall be
determined from time to time by resolution of the City Commission
which shall be on file in the City Health Department.
Section 7-58 - Imvoundment fees. Fees ahall be determined for
the impoundment of any dog or cet from time to time by resolution of
the City Commission Nhich shall be on file in the City Health
Department.
Section 7-61 - Disposition of unredeemed doas and cats. All dogs
and cats impounded under the provisions of this chapter and remaining
unclaimed after five t5) days of impoundment, unlesa impounded for a
longer specified time by the order of the City Health Department, may
be placed for adoption or disposed of by humane means by the Animal
Control Officer without notice.
Section 7-64 - Accetotance fees. The fee for acceptance of
animals at the shelter shall be determined from time to time by
resolution of the City Commission which shall be on file in the City
Health Department.
Section 7-76 - Reaistration reQuired. In the interest of public
safety, all wild animals and hybrid animals Mhose peers exist
predominately in a wild or nonresidential confined atate and Mhose
unconfined presence might constitute a danger to humans, shall be
registered with the City of Brookings Animal Control Department.
Section 7-77 - Providina reaietration information to relevant
personnel. The City of Brookings Animal Control Department shall
provide copies of all wild animal and hybrid registratione to the
Police Department and other emergency rescue personnel which may have
reason to enter the premises where wild animals are present, for
purposes of rescue operations resulting from a natural disaster or
personal emergency.
Section 7-78 - Runnina at larcte. It shall be unlawful for any
person to permit or suffer to run at large Mithin the city any Mild or
hybrid animal. The applicable fine for permitting wild or hybrid
animals to run at large will be determined from time to time by

Health Department.
ALL ORDIHAHCES IN COHFLICT HEREWITH ARE HEREBY REPEALED.
