BE IT ORDAIHED BY THE GOVERHIHG BODY OF THE CITY OF BROOKIHGS, SOUTH DAKOTA, AS FOLLOWS, TO-WIT: I. Section 2-81. ComDosition. The Committee on Human Rights shall consist of ten (10) members, nine (9) of which ehall be selected by the City Commission and one ( 1) of which shall be selected by the Brookings County Board of County Commissioners. In selecting members, due regard shall be given to representation of minority groups on the Committee. One member of the Committee selected by the City Commission shall be a student enrolled in a post-secondary educational institution. Section 2-72. Term of Office. Date of Avvointment. Compen8ation. All membera of the Committee on Human Rights ehall serve for a term of three (3) years exaept the student member r►ho shall serve a one ( 1) yesr term. Any member whose term expires may be reappointed. Members of the Committee shall be appointed by the Mayor and the Chairman of the Brookings County Board of County Commissioners at the first regular meeting in January of each year, and the student member of the Committee shall be appointed the first meeting of May. Al1 members of the Committee on Human Rights shall serve rithout compensation. Section 2-76. Powers Generallv. (a) To study and determine the existence, character, causes, and extent of discrimination in employment, housing accommodations, property rights, education, public accommodations, and public services in the City of Brookings. (b) To advise and provide a forum for those pho have been sub�ected to unfair and discriminatory practices in the City of Brookings. (c) To hear and investigate complaints alleging discrimination and where probable cause for discrimination is found to exist by the Committee, to refer the complaint to the appropriate governmental agency. The Committee shall develop rules of procedure sub�ect to approval of the City Commission. (d) To advise the Mayor, City Commissioners, and the respective departments of the City concerning matters coneistent with the purpose and powers of the Committee. (e) To conduct educational programs and disseminate information in furtherance of the policy of the Committee to eliminate discrimination in the City of Brookings. . r . , . (f) To hear and investigate complaints alleging discrimination regarding Brookings County, South Dakota, in aaaordance with the Grievance Proaedures adopted by Brookings County, South Dakota. II. INTRODUCTION The Grievance Procedures set forth in this document provide administrative rules for use by the Brookings Human Rights Committee in acting on grievances for the City of Brookings and BROOKINGS COUNTY, SOUTH DAROTA, in matters dealing with discrimination on the basis of race, color, creed, religion, sex, disability, ancestry, or national origin in the areas of `. employment, housing, public accommodation, state and local government services and programs, telecommunications and transportation services . These administrative procedures have been approved by the Brookings City Commission for use for all City of Brookings municipal entities and by the BROOKINGS COUNTY Board of County Commissioners for use for all County '�ntities. In addition, also enclosed is MARK' s revision of the introduction paragraph to the Human Rights Grievance Procedures. I have reviewed the enclosed Ordinance and find it acceptable and appropriate for submission to the Brookings City Commission. O. Box 686 Brookings, South Dakota 57006 RE: BROOKINGS HUMAN RIGHTS COMMITTEE Dear Steve: Reference is made to our telephone conversation , regarding the Brookings Human Rights Committee. As I indicated to you, the County is considering appointing the Human Rights Committee as a grievance procedure under the -ADA. The County would simply adopt the grievance procedures previously established by the Brookings Human Rights Committee. In doing so, the County would like to have the option to appoint one member of the Human Rights Committee. This would provide a liaison between the Committee and the County Commissioners . I have prepared a proposed Ordinance for submission to the City Commission, which would provide for these changes . Enclosed you will find a copy of the Ordinance. In addition, I have prepared a proposed change to Section 1 of the Brookings Human Rights Committee Grievance Procedures . This change would accommodate the inclusion of Brookings County in these procedures . I would ask that you review these documents and get back to me with any proposals or comments . If the same meet with your approval, I would seek your assistance in submitting these to the Brookings City Commission for consideration.
