HomeMy WebLinkAboutOrdinance 30-1995 ,� , . ORDINANCE NO. 30-95 AN ORDINANCE REVISING THE ZONING ORDINANCE OF THE CITY OF BROOKINGS PERTAINING TO DEFIIVITIONS, DISTRICTS AND GENERAL REGULATIONS. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS, SOUTH DAKOTA, THAT ARTICLE II, CHAPTER 50, TI� 1994 REVISED ZONING ORDINANCE SHALL BE AMENDED AS FOLLOWS, TO-WIT: I. 50.02.132 Day Care Facility - A building in which care and supervision is provided for more than twelve(12) children at any one time including children under the age of six living in the home. 50.02.135 Day Care, Family- A residence in which care and supervision is provided for twelve (12) or less children at any one time including children under the age of six living in the home. 50.02.306 Lot, Corner- A lot abutting upon two or more streets at their intersection, or upon two parts of the same street forming an interior angle of less than 135 degrees. The nanower lot frontage shall be considered the primary front lot line. Corner lots with only one lot line not defined as a front lot line sha11 be allowed a side lot line. (Cross Ref. Sec. 50.20.312). 50.02.552 Tree- A tree with a minimum designated caliper and/or height range. Caliper indicates the diameter of the trunk six(6) inches above grade. (See Sec. 50.70.336). BE IT ORDAINED BY TI� GOVERNING BODY OF THE CITY OF BROOKINGS, SOUTH DAKOTA, THAT ARTICLE IV, V and VI, CHAPTER 50, THE 1994 REVISED ZONI1�iG ORDINANCE SHALL BE AMENDED AS FOLLOWS, TO-WIT: I. 50.20.040 1. Business or professional office, personal health service, grocery store, pharmacy 50.24.030 16. Office 50.31.200 Site Plan Requirements B. 4. Landscaped areas shall be developed in the front fifty feet (50') of a front yard and twenty- five feet (25') of a side or rear yard. Landscaped areas sha11 include shrubbery or trees. A minimum of ten(10)trees per acre shall be required based on the total acreage of the site. The requirements of section 50.70.336, Landscaping, are also applicable and constitute additional site plan requirements. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS, SOUTH DAKOTA, THAT ARTICLE VII, CHAPTER 50, THE 1994 REVISED ZONING ORDINANCE SHALL BE AMENDED AS FOLLOWS, TO-WIT: I. 50.70.130 B. Reconstruction/Restoration. When the use of a building or structure is nonconfornung and such a building or structure is destroyed by a fire, explosion, act of God, or the public enemy, such building or structure shall only be reconstructed or restored in accordance with the applicable requirements of the zoning district in which it is located. For the purpose of this ordinance, a structure shall be considered to be destroyed when the cost of restoration exceeds one-half the current assessed valuation of the building or structure. 50.70.240 B. 3. Lot area-Each lot provided for the occupancy of a single mobile home/manufactured housing unit shall have an area of not less than 5,500 square feet. (Sections 3A, 3B, 3C and 3D are unchanged) 4. Density-No park sha11 be permitted to have a density of more than seven(7}mobile home/manufactured housing units per acre and each park shall provide an area of not less than eight (8) acres. 50.70.316 Accessory Building Location. B. An accessory building located upon a business or industrial lot shall not be within five feet (5') of any side or rear lot line. An accessory building shall maintain a front yard setback equal to or greater than the setback of the principal building. 50.70.332 Fences,Walls and Hedges. Ezceptions: 1. Fences, walls and hedges up to six(6) feet in height may be placed in a front yard of a lot abutting an arterial street provided: a. Said lot is a double frontage lot; and b. The lot is not adjacent to an alley which accesses onto the arterial street; and c. The lot is not a corner lot; and d. No driveways exit onto the arterial street; and e. Said fence, wall, or hedge is set back four(4) or more feet from the front property line. 2. Split rail designs may extend thirty-six (36) inches above the adjacent grade. 50.70.336 Landscaping. The City encourages developments which are safe, clean, healthy and attractive. To achieve this goa1, the City has established certain standards which are required of all developments. Due to the benefits that trees provide in the reduction of heat, dust, pollution and because of the particular need to encourage vegetation in our city, trees are required to be planted and maintained on each site. All trees sha11 meet standards for height and/or caliper. Each tree shall be balled and burlapped, container grown or planted by tree spade and shall meet the following minimum requirements at the time of planting: Developments with one (1) acre or less in area 1. Shade tree - A tree with a caliper of two and one half(2 1/2) inches or greater. 2. Ornamental tree - A tree with a caliper of two (2) inches or greater. 3. Conifer tree - A tree with a height of not less than six (6) feet. Developments with more than one(1) acre 1. Shade tree - A tree with a caliper of two (2) inches or greater. 2. Ornamental tree - A tree with a caliper of one and one-half(1 1/2) inches or greater. 3. Conifer tree - A tree with a height of not less than five (5) feet. The city encourages developers to preserve any desirable species of trees on the site which are in good health and will count such trees as part of the minimum requirement. A partial list of acceptable trees within each category are: 1. Shade trees - green ash, seedless honey locust, Norway maple, hackberry, linden, oak and sugar maple. 2. Ornamental trees - flowering crabapple, mountain ash, amur maple, clump birch, hawthorn and Japanese tree lilac. 3. Conifer trees - pine, spruce and fir. All trees shall be planted on the site and adjacent to the parking area according to the following: 1. One tree sha11 be provided on site for the first 4,000 square feet of paved surface. 2. One tree shall be provided for each additiona13,000 square feet of paved surface. Twenty percent (20%) of the required trees may be conifers. However, conifers shall only be planted on the perimeter of any paved area used for parking. 50.70.352 Hardsurfaced Parking. In a11 residential districts and the RB-4 neighborhood business district, where a permitted use or permitted special use requires five (5) or more parking spaces, such spaces shall be surfaced with concrete or asphalt. The expansion of a parking area required as a result of the enlargement of a pree�sting use shall also be hardsurfaced. 50.70.368 Landscaping of Front Yards. Front yards of lots with residential uses shall be devoted entirely to landscaped area except for the necessary surfacing of driveways and sidewalks used to reach parking and loading areas. Section 50.70.500 Parking and Loading Requirements 50.70.510 Location of Parking Spaces. b. No off-street parking of motor vehicles, recreational vehicles, watercraft or trailers shall be permitted in the front yard of any lot located in any residential district except upon a driveway providing direct access to the garage or rear yard and except for the yard area between the driveway and the nearest side lot line. Exception. Parking in the front yard of schools, churches, museums, art galleries, libraries, public recreation facilities and parks is permitted provided it is not located within the minimum front yard building setback area. Section 50.70.600 Access Drives B. Residential Districts 1. No more than one(1) access drive shall be pernutted onto any street which the lot or block abuts Egception. a. An apartment building or apartment complex, church, school or other assembly use on a lot or block with one hundred fifty(150) feet or more of frontage on any street may install one (1) additional access drive. . . _ , . , b. Two family dwellings may have one access drive for each garage where said garages are separated by or attached to opposite ends of the building. II. All sections and ordinances in conflict herewith are hereby repealed.
