APPEAL PROCESS GUIDE
FOR LOCAL, COUNTY
& CONSOLIDATED
BOARD OF EQUALIZATION MEMBERS
NOTICE TO BOARDS OF EQUALIZATION and PROPERTY OWNERS
PRODUCTIVITY VALUATION FOR 2018 ASSESSMENTS
All agricultural land is to be assessed using the productivity valuation method.
Information concerning this valuation process and the data used to establish the values is
available from your Director of Equalization and at the Department of Revenue and website at:

It is important to remember that a property is to be valued fairly and uniformly. A property cannot
be assessed higher than actual market value and cannot be assessed higher than other
comparable properties.
If anyone has questions on this, please contact your local Director of Equalization or the
Department of Revenue.
PLEASE NOTE: Any lessee responsible for payment of taxes pursuant to the provisions of a lease
shall be considered the taxpayer and may also appeal the valuation, classification, and taxable
status of the property.
LOCAL BOARD OF EQUALIZATION
All board minutes shall be transmitted to the Department of Revenue. The Secretary of Revenue has the
power to review and invalidate any actions for which there is no legislative authority.
Appeal to the local board must be perfected by mailing or by filing a written notice of appeal with
the clerk of the local board. Filing means “in the hands” of the clerk. Postmarked by the deadline
is considered timely.
COMPOSITION
The local board of equalization consists of the board of supervisors of each township or the governing
body of each incorporated municipality, together with a member of the school board or school boards
whose district comprises all or a part of the township or municipality.
TIME AND PLACE OF MEETING
The local board of equalization shall begin meeting on the third Monday of March and adjourn no later
than the following Friday. The meeting shall be at the office of the clerk or finance officer of the township
or municipality.
DUTIES
The township clerk or municipal finance officer acts as the clerk of the local board of equalization. It is
his/her responsibility to keep an accurate record of all changes made in assessments as well as a record
of the proceedings. The clerk must note all appeals in the board minutes and on the form PT 17.
The local board of equalization has the duty to hear and decide appeals within the five days. A written
decision must be sent within seven days after adjournment. Any appeals not resolved by the local
board are considered as no change.
It is the clerk's responsibility to help property owners complete the form PT 17. If a quorum is not present,
the clerk has the authority to adjourn the meeting and announce the time of the next meeting.
It is the duty of the board to certify the accuracy of the assessment roll and deliver it to the director of
equalization on or before the fourth Monday in March, along with a copy of the minutes and all
completed PT 17 forms. The board is to review all properties to ensure there is equalization of the
assessments and that all property is listed.
Prior to adding omitted property or increasing an assessment on property, the board must notify the
property owner of the proposed addition or increase and the time and place of the board meeting at which
the addition or increase will be considered. The board must give a property owner an opportunity to
appear before the board or submit written documentation concerning the addition or increase.
The local board of equalization does not have the authority to hear appeals on owner -occupied status.
They may inform the Director of Equalization of errors in owner-occupied status.
The local board does not have the authority to correct or change the level of assessment of property
types.
BEFORE A VALUE CAN BE INCREASED - notice has to be given to the property owner to allow him/her
a chance to appear before the board to discuss the change.

property owner to allow him/her a chance to appear before the board to discuss the addition.
The director of equalization has the right to appeal any decision of the local board to the county board. If
the director does appeal a decision, it is his/her responsibility to notify the property owner, local board and
county auditor by submitting the PT 16 by April 17, 2018.
It is the duty of the board to take action on each appeal. The board's action must be included in the
minutes. The board has the authority to equalize assessments between individual parcels of property, but
does not have the authority to change the level of assessment between classes of property.
Local boards must complete their work within five days. School board members may vote only on the
appeals involving property located within their respective district.
Local boards must notify each appellant of the decision affecting his/her property in writing within seven
days after the adjournment of the local board of equalization (March 23, 2018).
MARCH 26, 2018 - clerk of local board SHALL return to the assessor the assessment roll and the
complete record of the proceedings.
COUNTY BOARD OF EQUALIZATION
All board minutes shall be transmitted to the Department of Revenue. The Secretary of Revenue has the
power to review and invalidate any actions for which there is no legislative authority.
Appeal to the county board must be perfected by mailing or by filing a written notice of appeal
with the clerk of the county board. Filing means “in the hands” of the clerk. Postmarked by the
deadline is considered timely.
COMPOSITION
The county board of equalization consists of the county commissioners. The county auditor acts as the
clerk of the county board. The county auditor's responsibilities are the same as those described for the
clerk of the local boards.
TIME AND PLACE OF MEETING
The county board of equalization begins meeting on the second Tuesday in April and must complete its
work no later than three weeks after the second Tuesday in April. The county board meets at the county
courthouse.
DUTIES
The county board of equalization has all the power, authority and duties of a local board of equalization in
all unorganized territories. A county board of equalization may:
(1) Correct clerical errors of the assessment roll;
(2) Hear appeals from individuals regarding aggregate assessments, classification and
equalization;
(3) Equalize between taxing districts and between classes of property. The board shall raise or
lower, if necessary, each class of property on a percentage basis covering the class as a
whole within the assessment district;
(4) Hear appeals of owner-occupied status.
The county board DOES NOT HAVE THE AUTHORITY to raise or lower the assessment of an individual
parcel of property if it would cause the county board to reassess all property within the taxing district.
The county board DOES HAVE THE DUTY to ensure all property is listed on the assessment roll.

power to review and invalidate any actions for which there is no legislative authority.
Appeal to the consolidated board must be perfected by mailing or by filing a written notice of
appeal with the clerk of the local board. Filing means “in the hands” of the clerk. Postmarked by
the deadline is considered timely mailing.
Any county, municipality, school, and township may agree by resolution to consolidate the local board of
equalization with the county board of equalization no later than the second Tuesday of November. The
resolution shall state the number of members from each governing board that will sit as a consolidated
board of equalization.
COMPOSITION
The consolidated board consists of the county commissioners and members fr om the local board of
equalization, which may include township supervisors or city commissioners, and school board members.
TIME AND PLACE OF MEETING
The consolidated board of equalization begins meeting on the second Tuesday in April and must
complete its work no later than three weeks after the second Tuesday in April. The consolidated board
meets at the location agreed upon by the governing bodies.
DUTIES
The consolidated board of equalization may:
(1) Correct clerical errors of the assessment roll;
(2) Hear appeals from individuals regarding aggregate assessments, classification and
equalization; and
(3) Equalize between taxing districts and between classes of property. The board shall raise or
lower, if necessary, each class of property on a percentage basis covering the class as a
whole within the assessment district.
VOTING BY CONSOLIDATED BOARD
Municipal, school and township board members may participate and vote only regarding property
within the boundaries of each member’s respective taxing district. The county commissioners shall
be a majority of the members eligible to vote on the property valuation in question.
A consolidated board of equalization SHALL NOT act on matters that are within the jurisdiction of the
county board of equalization. The actions that are within the jurisdiction of the county board of
equalization jurisdiction are actions on exempt property and owner-occupied status.

BASIC ASSESSMENT INFORMATION
In South Dakota, it is the assessor's responsibility to assign your property a value for tax purposes. For
agricultural land, that value is based on the productivity value. For all other property, that value is equal to the
amount for which it would sell on the open market. These values are sometimes called the "true and full value."
Assessors determine the market value of property by using a combination of the following three approaches:
Cost approach - the assessor estimates the cost of replacing the property (structures), reduces that amount by its
age (depreciation), and adds the value of the land.
Market approach - the assessor compares the subject property to like properties that have recently been sold.
Income approach - the assessor uses the value of the projected income from like properties to determine value.
The assessor also classifies property as agricultural or non-agricultural. The assessor makes this determination
by considering the amount of the owner's income derived from agriculture , the property's primary use and the
property’s size. After determining the market value and the classification of a parcel of property, the assessor
sends a notice to the property owner. This assessment notice is to be mailed by March 1 of every year.
Owner-occupied single family dwelling - This designates that the property is to receive a lower levy for school
general fund tax purposes. To be eligible, the property owner must have filed an "Owner -Occupied Certificate" by
March 15, 2018. (Any property previously designated as owner-occupied would remain so, unless it sold or had a
change in use.)
You may appeal your property's owner-occupied status. This appeal is made directly to the County Board of
Equalization. In your appeal you must state that you meet the qualifications which are:
(1) You owned the property on November 1, 2017.
(2) You occupied the property on November 1, 2017.
(3) This is the only property you own that would receive the owner-occupied status.
(4) That the property is your principal place of residence
(5) You filed the certificate by March 15, 2018.
You may also appeal the taxable/exempt status of your property. This type of appeal is made directly to the
County Board of Equalization.
Decisions of County Board of Equalization may be appealed in the same manner as other decisions.
PROPERTY OWNER'S RIGHTS AND DUTIES
As the owner of real property in South Dakota, you have the right to ensure your property is being assessed at no
more than market value and also assessed equitably in relationship to other properties. Any lessee responsible
for payment of taxes pursuant to the provisions of a lease shall be considered the taxpayer and may also appeal
the valuation, classification, taxable status of the property. When you receive your assessment notice, it is your
duty to review the notice to ensure the property is listed correctly. Also you need to check the assessed value.
Ask yourself "If I sold this property, is this the amount I would expect to receive?" If it is higher than what you
think you could sell it for, first talk to your county director of equalization. He/she can explain how th e values were
determined and show you sales of like properties that he/she used in determining your value. If you still disagree
with the assessment on your property, your first step in the appeal process is to the local board of equalization.
Your appeal must be for the total value of the property. An appeal on just the structure value or just the land value
will be considered an appeal of the entire property.
Mobile home owners - the same appeal process is used for registered mobile homes, however you are required
to pay your current year taxes in a timely manner pending the outcome of the appeal. For any tax relief, the taxes
would need to be paid under protest and file lawsuit for refund within 30 days of payment.
NOTE: The following people do not have to appeal to the local board before going to county board:
Non-residents - A property owner is considered a non-resident if the person resides outside the local board
jurisdiction. A non-resident does not have to appeal to the local board before appealin g to county board, but may
do so if desired.
Unorganized township property owners - as there is no local board for unorganized townships, these property
owners appeal directly to the county board of equalization.
LOCAL BOARD
The first step in the appeal process is to the local board of equalization. The local boards consist of the township
board of supervisors or the governing board of the municipality, and a member of the school board. The board's
primary function is to determine that all taxable properties have been placed on the assessment roll and that a
reasonable degree of equalization exists among these properties. The board, however, may only equalize
assessments between individual properties. It may not change the level of assessment between enti re classes of
property, such as agricultural and non-agricultural.
To appeal to the local board, you must notify the clerk in writing of the local board, stating you wish to appeal the
assessment of your property. The clerk must receive your notification by March 15, 2018. Postmarked by this
date is considered timely. You should state the legal description of the property you are appealing and a brief
explanation of why you are appealing, such as "property is higher than market value".
Your local board clerk will notify you when your appeal will be heard by the local board. During this hearing, the
form PT17 must be completed. If you appear at the hearing, the clerk will help you complete the form. Your
explanation of your appeal may be in person or in wr iting. It should state the reason you are appealing your
assessment. You must also have evidence to prove your point. Just stating the value is too high is not enough.
Suggested points are sales of properties you believe are similar to your property. Also assessments of properties
similar to yours are useful. Point out how the properties are comparable to your property.
The local board must notify you in writing of the decision by March 30, 2018.
COUNTY BOARD
If you disagree with the decision of the local board, you may appeal to the county board. This board is composed
exclusively of county commissioners. The county board's primary functions are to hear appeals from property
owners in unorganized territories and appeals from local board decisions, and t o see that all classes of property
are equalized.
To appeal to the county board, you must write a letter to the county board, stating you wish to appeal the

CONSOLIDATED BOARD OF EQUALIZATION

may not, however, appeal to the OHE and the circuit court simultaneously.

received by May 18, 2018. If you appeal to OHE, you will receive additional information from that office on how
and when the hearing of your appeal will be conducted.
CIRCUIT COURT
If you disagree with the decision of the OHE, you have the right to appeal to the circuit court. You may also take
your appeal directly from the county board of equalization to the circuit court, bypassing the OHE. Please
remember, you cannot appeal to the OHE and Circuit Court simultaneously.

Volume Based Collection Service (pay-as-you-throw).
Summary: At the City Council meeting of January 9, 2018, Council Member Bacon asked the City
staff to research the possibility of providing different sized trash containers and recycling bins and a
corresponding fee schedule.
Background: Volume based residential collection is based on cart size. The less volume of
garbage you generate, the smaller size of cart you use and thus the less cost per month for the
resident. The three potential cart sizes are a 35-gallon, 65-gallon, or a 95-gallon. In the past a
program like volume based collection has been used to encourage people to recycle, thus the more
recycling a resident does the less their garbage service bill will be each month. The City of
Brookings Solid Waste Department uses a 95-gallon cart for garbage collection and a 65-gallon cart
for recycling collection once a week. The current charge per month for our service is $18.00 per
month plus 6.5% sales tax.
Garbage System: The City of Brookings Collection operation services 5,264 residential homes per
week for garbage pickup. 450 homes or 8.5% require a second green cart based on the size of their
family/home businesses. This service is on Monday and Tuesday of each week. There are four
automated garbage trucks in our operation, so each truck has 658 stops per day. The average truck
travels 72 miles per day to complete their assigned route.
Recycling System: The City of Brookings Collection operation services 4,325 residential homes per
week for recycling pickup. 125 homes require a second blue cart based on the size of their
family/home businesses. This service is on Thursday and Friday of each week. There are four a
utomated garbage trucks in our operation, so each truck has 541 stops per day. The average truck
travels 64 miles per day to complete their assigned route.
Recycling Carts: The recycling cart program started in 2013. The first 3,200 carts were purchased
through a grant from the state. The City went with the 65-gallon carts to cover everyone’s needs. If
they generated more than the cart could hold, they are given an extra cart at no additional cost.
Currently, 125 residents have an extra recycling cart, which is 2.3% of our service area.
Monthly Recycling Fee: The City of Brookings residents are paying a $2.25 recycling fee on their
monthly garbage service. The fee is the cost of recycling each month whether they are participating
in the program or not. People not recycling are still funding the program.

2.00 per month on residents using the 65-gallon carts, which would mean passing that on to the user
of the 95-gallon cart.
Operational Issues: The use of 35-gallon carts would be an issue because the carts are very small
in diameter and the gripper arm on the automated truck would need to be adjusted every time one is
picked up, so that the cart would not fall though into the hopper of the truck.
Sustainability Council: The Brookings Sustainability Council reviewed this issue at their February
14, 2018 meeting and voted unanimously to recommend the City remain with the current program at
this time because it does not meet the economic pillar of sustainability.
Recommendation: To start a program of volume based collection there would be some additional
expenses. The rate structure would have to take into consideration the current revenue in place now.
The rates would have to balance out, so the revenue would not go down to keep our budget in line.
In summary, volume based collection has a history of working in cities with a population of 100,000 or
more residents because it is easier to spread the cost of the program over larger service area.
Staff recommends the City continue its current service and cost structure. Going forward, the City
should monitor the growth of the community over the next 10 years and then conduct a study to see
who would participate in the program and determine if there is a need to start a volume based
collection system. This would also give us the time to outline a plan and to build up some means of
funds to start purchasing the needed carts.

Notes from Rapid City doing Volume Based Collection:
From an operation standpoint, having an automated truck that can collect from a 35 gallon up to a 95-
gallon container is difficult, as many times with the grippers set up, we can easily loose a 35-gallon
container into the hopper. We are looking at eventually doing away with the 35-gallon trash and going
with just a 65 and 95-gallon container.
The whole point of the volume based system years back was to increase the amount of recycling we are
picking up. With recycling programs in place in all the cities, there has not been a major benefit to the
volume-based program. This program also increases the workload for your staff tremendously. The
Primary problem we have at this time is there is not enough variance in cost between the three
container sizes, so we are somewhat discouraging more recycling to save money.

This Resolution will authorize the City Manager to sign the Agreement for Professional Services and
other related documents for Brookings Regional Airport Project No. AIP #3-46-0005-030-2018,
Reconstruction of the General Aviation Apron and Hangar Taxilane Project.
Background:
The Brookings Regional Airport has applied for FAA and SDDOT grant funding to reconstruct the
general aviation apron and hangar taxilane area. The project will be designed by Helms Associates,
and the work will include grading, geotextile fabric, aggregate base course, underdrain piping, storm
sewer, asphalt surfacing, pavement markings, topsoiling, seeding and security lighting.
The approximate design cost is $89,005. It is anticipated that the City will receive a grant for the
design and construction of this project with 90% federal funds, 5% state funds, and 5% City funds.
This resolution will authorize the City Manager to sign the agreement for professional services and
other related documents for AIP Project No. 3-46-0005-030-2018.
Fiscal Impact:
The City’s estimated share is of the agreement is $4,450.25 upon receipt of the grant offer.

Whereas, the Brookings City Council desires South Dakota Department of
Transportation and FAA assistance with the Brookings Regional Airport Project 3-46-
0005-30-2018;
Whereas, the City of Brookings desires professional services with Helms and
Associates Corporation for the design of the Reconstruction of the General Aviation
Apron and Hangar Taxilane Project.
Now, Therefore Be It Resolved that the City Manager of the City of Brookings is
authorized to sign the Agreement for Professional Services and other related
documents for AIP #3-46-0005-030-2018.

Background:
This project is the annual project to provide hot mix asphalt patching material that the Street
Department picks up at the plant to repair asphalt pavement throughout the City. The Street
Department staff also uses the asphalt material to overlay small street areas which are usually one
block long or shorter.
A bid letting was held on Tuesday, February 20, 2018 and the City received the following bid:
Bowes Construction Co., Inc.$79,260.00
The total low bid is approximately 0.8% higher lower than the engineer’s estimate of $78,580.00.
Fiscal Impact:
The City will enter into a contract with Bowes Construction Co., Inc. for $79,260.00.
Recommendation:
Staff recommends approval.

Background:
This project is the chip seal project for the 2018 Project Area, which is located south of 8 th Street
South and east of Medary Avenue. This is an annual project, where the contractor applies oil and city
-purchased pea rock chips to the streets. The City then sweeps up the excess chips a few days
afterward for re-use or sale.
The City opened bids on Tuesday, February 20th, 2018 at 1:30 pm at the City & County Government
Center and the following bids were received:
Topkote, Inc., Yankton, SD $259,114.80
The Road Guy Construction Co., Inc., Yankton, SD $262,500.00
Bituminous Paving, Inc., Ortonville, MN $315,630.00
The low bid was approximately 9% lower than the Engineers Estimate of $281,550.00. This
resolution will award the project to the low bid of Topkote, Inc., Yankton, SD for the contract amount
of $259,114.80.
Fiscal Impact:
The City will enter into a contract with Topkote, Inc. for $259,114.80.
Recommendation:

Action on Resolution 18-017, a Resolution authorizing the City Manager to Sign Wetland Functional

Summary:
This resolution will authorize the City Manager to sign a Wetland Functional Capacity Unit Credits
Purchase Contract with North Central Mitigation as part of the Section 404 Permit with the Corps of
Engineers for the 15th Street South and 7th Avenue South project.
Background:
City staff has been working with the Corps of Engineers on a Section 404 Permit for the 15 th Street
South & 7th Avenue South project. The City applied for the permit because the street project
proposes to impact approximately 3 acres of wetlands, which equates to 14.38 Functional Credit
Units. A Functional Credit Unit is a measurement of the quality of the wetland.
The City’s initial proposed mitigation plan was to construct additional wetlands on the City’s parcel on
32nd Street South, east of Main Avenue. The City would be required to construct the new wetland at
a minimum of a 2:1 ratio and monitor it for 5 years to assure the wetland is created. The City learned
that a wetland bank was created by North Central Mitigation in the Brookings watershed, and the
bank has been approved by the Corps of Engineers to allow mitigation at a 1:1 ratio. This project
would purchase 14.28 credits at the purchase price of $179,750.00 from North Central Mitigation.
The City is choosing to purchase credits from the wetland bank for several reasons. The Corps of
Engineers prefers that mitigation is performed by purchasing credits through a wetland bank that has
been established and approved by the Corps. In addition, the estimated cost of constructing
wetlands on the City’s parcel at a 2:1 ratio was a more expensive option along with the commitment
of a minimum of five years of monitoring.
The agreement allows the City up to 12 months to obtain the Section 404 permit and payment will not
be required until after the assessment hearing and the 20-day referral period has passed.
The next steps include working with the Corps of Engineers on the 404 Permit and holding an
assessment hearing for this project.
Fiscal Impact:
The City will pay $179,750.00 to North Central Mitigation upon receipt of a 404 Permit and after the
assessment hearing has been adopted.

Whereas, the City of Brookings is desirous in obtaining a Section 404 Permit for
the 15th Street South and 7th Avenue South project, application number NOW-2014-
1941-PIE; and
Whereas, the U.S. Army Corps of Engineers, Omaha District, will require
compensatory off-site wetland mitigation as part of the project; and
Whereas, the Corps has authorized North Central Mitigation to complete the
Mitigation Requirement; and
Whereas, the North Central Mitigation agrees to sell 14.38 Functional Credit Unit
Credits for the purchase price of $179,750 for the City of Brookings project.
Now, Therefore, Be It Resolved that the City Council of the City of Brookings
authorizes the City Manager to sign the Wetland Functional Capacity Unit Credits
Purchase Contract with North Central Mitigation.

Introduction and First Reading on Ordinance 18-003, an Ordinance authorizing Supplemental
Appropriation #1 to the 2018 Budget. Second Reading: March 13, 2018.
Summary:
This ordinance will amend the 2018 Budget 1) to carryover items from the 2017 budget, 2) to change
certain amounts budgeted in 2018, and 3) to distribute the COLA that was unknown at time of the
budget, from the contingency fund, to the departments.
Background:
The first portion of the amendment (Part 1) allocates expenditures for projects or purchases, which
were budgeted in 2017, but were not completed by December 31, 2017.
The second portion of the amendment (Part 2) makes adjustments to the 2018 Budget for various
revenue and expenditures. The amendment includes the following:
·Provide funds from contingency for unexpected repairs to the ice refrigeration system at
Larson Ice Arena.
·Allow for transfer of remaining cash from the S. Fire Station Capital Project Fund to the 25%
Sales and Use Tax fund once the landscaping is complete.
·Provides an additional $7,000 to be spend to complete the Medary Ave Railroad crossing
signal.
·Provides for a private donation of and the spending of funds to purchase Christmas
decorations for 6th Street.
·Provides for $574,172 to be spent from the 3rd B Sales Tax Fund on the remodel of the County
Resources Center as approved by City Council January 9, 2018.
·Provides for a transfer of cash from the Bel Debt Service Fund to the Bel Project Fund to pay
outstanding bills and allow for an additional expenditure of $5,000 to complete the Bel
Digester Project.
·Provides for reallocating some Airport Funds and a reduction of Runway Funds that were
spent in 2017.
The third portion of the amendment (Part 3) allocates the negotiated COLA to the department
budgets. At the time the 2017 Budget was prepared and presented to Council, negotiations with the
collective bargaining units were not complete and the COLA was not determined. Extra money was
budgeted in the contingency account to be distributed after the negotiations were completed.

Public Hearing and Action on Resolution 18-019, a Resolution Levying Assessment for Project No.
2017-01SWR, 2017 Sidewalk Repair Sites.
Summary:
This resolution will levy the Sidewalk Assessment for Project No. 2017-01SWR, 2017 Sidewalk
Repairs.
Background:
This project is the annual concrete project and entails construction of miscellaneous concrete work
including curb and gutter repair, fillets, valley gutters, curb ramps, and sidewalk along vacant
property. This project also includes homeowner trip hazards which weren’t repaired in the 2016
sidewalk area, located east of Medary Avenue South and between 6th Street and Orchard Drive and
property owners in the 2017 sidewalk area who volunteered to be in the project, located north of 6th
Street and east of Medary Avenue.
Resolution 16-045 was adopted on June 14, 2016 and authorized the Sidewalk Assessment Project
for the trip hazard sidewalks and Resolution 17-061 was adopted June 13, 2017 which authorized the
Sidewalk Assessment Project for the new sidewalk locations. The assessment cost for each
property owner is calculated by using their specific sidewalk cost plus a 6% fee for engineering and
administration.
The City mailed each property owner a notice of the hearing and a copy of the Assessment Roll
which details the cost of the sidewalk repairs. Upon approval of the resolution, the Finance Office will
send each property owner a bill for the repairs and the payments will be recovered into the
assessment fund.
Fiscal Impact:
The city will collect the Sidewalk Assessment Revenue for the sidewalk repairs.

Resolution 18-019
A Resolution Levying Assessment For Project No. 2017-01SWR
2017 Sidewalk Repair Sites
Whereas, the City Council has provided for sidewalk repair work to be completed under
Project No. 2017-01SWR, 2017 Sidewalk Repair Sites.
Be It Resolved by the City Council of the City of Brookings, South Dakota, as follows:
1. The City Council has made all investigation and authorized by Resolution 16-
045 and Resolution 17-061, which deems the work necessary and has found
and determined that the amount which each lot or tract will be benefited by
the construction of the sidewalk improvement heretofore designated as
Concrete Maintenance Project No. 2017-01SWR is the amount stated in the
proposed assessment roll.
2. The assessment for Sidewalk Assessment Project No. 2017-01SWR is
hereby approved and the assessment thereby specified are levied against
each and every lot, piece or parcel of land thereby described.
3. Such assessments, unless paid within thirty (30) days after the date of
mailing of a statement of account by the City, shall be collected by the City in
accordance with the procedure for Plan One in Sections 9-43, South Dakota
Compiled Laws of 1967, as amended with interest of 10% on the unpaid
balance.
4. Assessments amounting to less than $300.00 shall be paid in one payment.

Public Hearing and Action on Resolution 18-020, a Resolution Levying Assessment for Alley
Assessment Project 2017-05STA , Alley from 1st Street South and 2nd Street South between 5th
Avenue South and 6th Avenue South.
Summary:
This resolution will approve Resolution 18-020, which will levy the assessment for Alley Assessment
Project 2017-05STA, Alley from 1st Street South and 2nd Street South between 5th Avenue South and
6th Avenue South.
Background:
The City received a petition to pave the alley from 1st Street South to 2nd Street South between 5th
Avenue South and 6th Avenue South. The City Council approved Resolution of Necessity 16-103 on
December 13, 2016, authorizing the City to proceed with bidding the project. The project included
excavation, gravel and asphalt pavement and the final change order has been approved.
This public hearing and adoption of the resolution is the final step to assess the property owners with
their portion of the construction and engineering costs. The original estimated cost in the Resolution
of Necessity was $55.00 per front foot, however, the final cost based on actual bid quantities is
$38.51 per front foot. The assessment for all abutting properties will be divided into five (5) equal
annual installments and interest of ten (10) percent per annum shall accrue on the unpaid balance of
the assessment for property owners who wish to pay over the five year period.
The City published the notice of the public hearing and mailed a copy of the notice and assessment
roll to the property owners being assessed.
Fiscal Impact:
The assessment costs will collected by the City and deposited in the Assessment Fund.
Recommendation:
Staff recommends approval.

Resolution Levying Assessment for Alley Assessment Project 2017-05STA , Alley from
1st Street South and 2nd Street South between 5th Avenue South and 6th Avenue South
Be It Resolved by the City Council of the City of Brookings, South Dakota, as
follows:
1. The City Council adopted Resolution of Necessity 16-103 and has made all
investigation which it deems necessary and has found and determined that
the amount which each lot or tract will be benefited by the construction of the
alley improvement heretofore designated as Alley Assessment Project No.
2017-05STA is the amount stated in the proposed assessment roll.
2. The assessment for Alley Assessment Project No. 2017-05STA is hereby
approved and the assessment thereby specified are levied against each and
every lot, piece or parcel of land thereby described.
3. The assessment shall be divided into five (5) equal annual installments for
alleys.
4. Such assessments, unless paid within thirty (30) days after the date of
mailing of a statement of account by the City, shall be collected by the City in
accordance with the procedure for Plan One in Sections to 9-43-51, South
Dakota Compiled Laws of 1967, as amended.
5. Interest of ten (10) percent per annum shall accrue on the unpaid balance of
the assessment.

Summary:
Brookings Health System is seeking a Conditional Use Permit to establish a mixed
business/residential use for an Ambulance Service in a B-2A District.
Background:
The property is currently used as a parking lot and is located along Yorkshire Drive in close proximity
to the Brookings Health System building. The general area includes a mix of medical clinics and
residential development. The Ambulance Service Center will be similar to other Emergency
Response Centers such as a Fire Station. There will be several bays containing ambulance vehicles
and also an area for first responders to reside while providing 24-hour emergency service.
The B-2A District is primarily intended for a mix of offices and other compatible uses. The
architectural firm has prepared a site plan to show the building and overall site design. If the
Conditional Use Permit is approved, staff will complete a full review of the site plan prior to a building
permit being issued.
A Conditional Use is defined as a use which, because of its unique or varying characteristics, cannot
be properly classified as a permitted use in a particular district. After due consideration, as provided
in this chapter, of the impacts of such use upon neighboring land and of the public need for the
particular use at a particular location, such conditional use may or may not be granted.
Planning Commission Recommendation:
The Planning Commission voted 6-0 to recommend approval of the conditional use.

An ordinance pertaining to an application for a Conditional Use to establish a

Office District.
Be It Ordained by the governing body of the City of Brookings, South Dakota that said
Conditional Use shall be approved for a mixed business / residential use for an
Ambulance Service on E150’ of W454.32’ of Lot 1, excluding S164.3’, Block 4,
Maylands First Addition (along Yorkshire Drive) with the following conditions:
1. Such business uses shall be only those uses permitted in the respective
zoning district. Provisions set forth in section 94-41 shall govern all residential
uses.
All sections and ordinances in conflict herewith are hereby repealed.

Chairperson Greg Fargen called the regular meeting of the City Planning Commission
to order on Tuesday, January 2, 2018, at 5:30 PM in the Chambers Room #310 on the
third floor of the City & County Government Center. Members present were James
Drew, Alan Johnson, Lee Ann Pierce, Kristi Tornquist, Eric Rasmussen and Fargen.
Absent was Tanner Aiken. Also present were City Planner Staci Bungard, Community
Development Director Mike Struck, City Manager Jeff Weldon, Tyler Harnish, designArc
Group, and others.

OFFICIAL SUMMARY
Item #5a –The applicant is seeking a conditional use permit for a mixed service
residential/ambulance use in a B-2A Office District. The B-2 District is typically used for
a mix of offices and other compatible uses. This building would be located along
Yorkshire Drive across the street from the hospital Emergency Room. Tornquist asked
if there was a signal light on 22nd Avenue and Yorkshire Drive. Tornquist is concerned if
there isn’t a signal and that the ambulance will struggle with getting out onto 22nd
Avenue. Bungard doesn’t believe there is a signal light there. Tornquist also asked
what the lot is currently used for. Architect, Tyler Harnish, explained that the lot is
currently used for overflow parking. Johnson wondered if city staff had received any
concerns from neighbors. Bungard explained that they haven’t heard from anyone.
Johnson wondered if the Ambulance staff could maybe incorporate a different policy
that required them to wait to turn sirens on. Harnish explained that he and hospital staff
could look into some sort of policy or policy change for the sirens.

Summary:
The applicant is seeking approval of a residential rezoning request for a portion of land on the west
side of Main Avenue South between 20th Street South and 26th Street South.
Background:
The property is located between 20th Street South and 26th Street South on the west side of Main
Avenue South. The land is currently vacant and the general area has residential development to the
north and west with Dakota Prairie Elementary and the Brookings South Main Fire Station to the
south. In addition, there is planned residential and commercial development to the east in Prairie
Hills Addition.
The land was rezoned along with a Preliminary Plat in 2015; however, the property needs to be
rezoned to match the new subdivision design. The applicant is requesting R-1D, R-2, and R-3, which
is similar to the current zoning. The owners are not intending to have any commercial lots in Fox
Run Addition at this time. The R-1D zoning is proposed on the west side of the land adjacent to the
existing single-family development and then the zoning transitions to R-2 and R-3 closer to Main
Avenue South.
Findings of Fact:
1.The Future Land Use Map in the Comprehensive Plan shows this area as residential.
2.The area is a logical extension of residential land use and the rezoning request fits the current
development pattern.
3.City utilities are available and can be extended to the property.
Planning Commission Recommendation:
The Planning Commission voted 5-0 to recommend approval of the rezoning request.

An Ordinance to change the Zoning within the City of Brookings
Be It Ordained by the City of Brookings, South Dakota:
Section 1. That the real estate situated in the City of Brookings, County of Brookings, State
of South Dakota, described as follows, to-wit:
Lot 1, Block 1, Christie Springs Addition; Block 4, Christie Third Addition; and a
portion of the NW ¼ of Section 2-T109N-R50W excluding all outlots and other
platted areas thereof and excluding the S640’ of the N1062’ of the E246’ in NW
¼ of Section 2-T109N-R50W from Residence R-1C Single-Family, Residence R-
3 Apartment, and Business B-2 District to Residence R-1D Single-Family,
Residence R-2 Two-Family, and Residence R-3 Apartment District (Fox Run
Addition).
In accordance with Section 94-7 of Article I of Ordinance 17-13 of the Code of Ordinances
of Brookings, South Dakota, as said districts are more fully set forth and described in
Articles III and IV, Chapter 94 of Ordinance No. 17-13 of the City of Brookings, South
Dakota.
Section 2. The permitted use of the property heretofore described be and the same is
hereby altered and changed in accordance herewith pursuant to said Ordinance 17-13 of
the City of Brookings, South Dakota.
Section 3. All sections and ordinances in conflict herewith are hereby repealed.

Chairperson Greg Fargen called the regular meeting of the City Planning Commission
to order on Tuesday, January 2, 2018, at 5:30 PM in the Chambers Room #310 on the
third floor of the City & County Government Center. Members present were James
Drew, Alan Johnson, Lee Ann Pierce, Kristi Tornquist, Eric Rasmussen and Fargen.
Absent was Tanner Aiken. Also present were City Planner Staci Bungard, Community
Development Director Mike Struck, City Manager Jeff Weldon, Tyler Harnish, designArc
Group, and others.
Drew recused himself.
Item #6a –VK Properties LLC and Advantage Investment Group LLC submitted a
petition to rezone Lot 1, Block 1, Christie Springs Addition; Block 4, Christie Third
Addition; and a portion of the NW1/4 of Section 2-T109N-R50W excluding all outlots
and other platted areas thereof and excluding the S640’ of the N1062’ of the E246’ in
NW1/4 of Section 2-T109N-R50W from Residence R-1C Single-Family, Residence R-3
Apartment, and Business B-2 District to Residence R-1D Single-Family, Residence R-2
Two-Family, and Residence R-3 Apartment District (Fox Run Addition).
(Pierce/Johnson) Motion to approve the rezone request. All present voted aye.

OFFICIAL SUMMARY
Item #6a –This is a rezone request for a portion of land on the west side of Main
Avenue South between 20th Street South and 26th Street South. The land is currently
vacant and the general area has residential development to the north and west. The
Dakota Prairie Elementary School and the Brookings South Main Fire Station are
located to the south. This land was rezoned along with a preliminary plat in 2015,
however the property needs to be rezoned to match the new subdivision design. The
applicant is requesting R-1D, R-2, and R-3 which is similar to the current zoning. Drew,
representing Advantage Investment Group LLC, explained that they would like to start
developing this land next year. He feels that the zoning transitions well with the areas
around it. They plan to have R-3 (higher density) zoning along Main Avenue South and
20th Street South. Johnson is concerned about the two Ag lots not having an egress
out. Drew explained that this is just the rezoning process that is being acted on tonight,
but on the plat, they will have accesses included for these lots. Pierce commented that
the upcoming Comprehensive Plan is going to recommend fewer cul-de-sacs because
of the connectivity issue with neighborhoods. Drew understands this, but consumers
are actually in favor of cul-de-sacs, because the traffic isn’t through traffic. Adam
Varenhorst, 2105 Morning Glory Dr, which is west of this area, is concerned that in the
current rezoning map, there is no sign of water retention. Currently they have water
issues in their backyard and this development is going to cause additional drainage
issues for him and his neighbors. Bungard explained that an approved drainage report
will be required before this area is final platted. Bungard recommended to Varenhorst
that he continue to follow the progress of this development as the platting stage will be
coming in the future. Tornquist wondered if this rezone request is consistent to the land
use that the new comprehensive master plan has tentatively planned for this area of
town? Struck stated that it is fairly consistent, however a decision cannot be made on
that plan since it is not officially adopted. Tornquist does understand the benefits and
attractiveness of a cul-de-sac, but also understands the thought of the Comprehensive
Plan Committee of reducing the number of cul-de-sacs.

Public Hearing and Action on Resolution 18-012, a Resolution of Intent to Lease to Northern Plains
Power Technologies the following described property in the Research and Technology Center, 807 32
nd Ave., Brookings, SD.
Summary:
The City is proposing to lease space in the Research and Technology Center located at 807 32nd
Avenue to Northern Plains Power Technologies. Northern Plains Power Technologies has been
leasing space in the facility and would like to continue the lease.
Background:
Northern Plains Power Technologies is currently leasing 2,066 square feet of office space. The lease
will be on a month-to-month basis for a period not to exceed December 31, 2019. The lease rate will
be at $10.00 per square foot. The Research and Technology Center site is planned for
redevelopment, however, the timing of such redevelopment is contingent upon the build-out of the
Brookings Marketplace and market conditions.
The following statutes provide guidance for municipalities leasing property:
9-12-5.1. Powers - Lease of property - Term and conditions. Every municipality may lease its
municipally-owned property. Any such lease shall be for a term and upon the conditions provided by
resolution of the governing body.
9-12-5.2. Powers - Lease to private person - Resolution - Notice -Hearing - Authorization. If the
governing body decides to lease any municipally owned property to any private person for a term
exceeding one hundred twenty days and for an amount exceeding five hundred dollars annual value
it shall adopt a resolution of intent to enter into such lease and fix a time and place for public hearing
on the adoption of the resolution. Notice of the hearing shall be published in the official newspaper
once, at least ten days prior to the hearing. Following the hearing the governing body may proceed to
authorize the lease upon the terms and conditions it determines.
A notice of public hearing was published once, ten days prior to the public hearing.
Approval of the Resolution of Intent will authorize the City Manager to execute a Lease Agreement
with Northern Plains Power Technologies according to the terms and conditions authorized by the
City Council.
Fiscal Impact:
Approval of the lease will provide $1,721.66 in revenue per month or $20,660 per year.
Recommendation:
Staff recommends approval.

Resolution of Intent to Lease Real Property to Northern Plains Power
Technologies
Be It Resolved by the governing body of the City of Brookings, South Dakota that the
City of Brookings intends to enter into a lease agreement with Northern Plains Power
Technologies on a month-to-month basis for a period not to exceed December 31, 2019
at a lease rate of $10.00 per square foot annually and pertaining to the following
described property:

Be It Further Noted, that a Public Hearing on this Resolution was held on February 27,
2018 at 6:00 o’clock P.M. at the Brookings City & County Government Center and that
all persons were given an opportunity to be heard on the intent to lease real property.

LEASE AGREEMENT
_________________
THIS LEASE AGREEMENT is made and entered into by and between the City of
Brookings, South Dakota, a municipal corporation, Lessor, hereinafter referred to as
"City", and Northern Plains Power Technologies, hereinafter referred to as "Tenant".
WHEREAS, City owns the Brookings Area Research and Technology Center, located at
807 – 32
nd Avenue, in Brookings, South Dakota, and desires to lease a portion of said
facilities to Tenant, and
WHEREAS, the above-named Tenant has expressed a desire to lease a portion of said
facilities hereinafter described in accordance with the terms and conditions set forth
herein, now therefore,
FOR AND IN CONSIDERATION OF THE MUTUAL COVENANTS, CONDITIONS AND
PROMISES, THE PARTIES DO HEREBY AGREE AS FOLLOWS:
1. Lease Agreement
The City does hereby lease unto Tenant and Tenant does hereby agree to lease and
take from City, that space located in the Brookings Area Research and Technology
Center, which is located at 807 – 32
nd Avenue, Brookings, South Dakota, marked as
Unit 2 on the attached Exhibit “A”, and containing approximately 2,066 square feet,
hereinafter referred to as “Unit 2”.
2. Term
This Lease Agreement shall commence on April 1, 2018 and shall be for a month-to-
month tenancy which may be cancelled by either party upon giving notice to the other
party at least thirty (30) days prior to the end of the month. The term of this lease shall
end no later than December 31, 2019. In the event the City terminates the lease prior to
December 31, 2019, it shall give as much notice as possible and will work with the
Tenant to allow, if possible, additional time to vacate the premises.
3. Use of Premises
The above leased premises shall be used by Tenant in connection with its research and
development pertaining to that business for the following purpose and no others without
the prior written consent of City:
Engineering consulting services and computer modeling technologies serving the
distributed generation and smart-grid industries.
Tenant shall not use any portion of the premises for purposes other than those specified
herein without the prior written consent of the City and no use shall be made or
permitted to be made upon the premises nor acts done which will increase the existing
rate of insurance upon the property or cause cancellation of insurance policies covering
said property. Tenant shall not conduct or permit any sale by auction on the premises.
4. Rent
Monthly Rent for the Duration of this Lease
The Tenant shall pay as rent to City during the term of this Lease monthly rent in the
sum of $10.00 per square foot, based upon the occupancy of 2,066 square feet, the
total monthly sum of $20,660.00, payable on or by the 15th day of each month,
commencing with the month of April, 2018.
Tenant shall pay each monthly rental on or before the 15th day of each month through
the full term of this Lease, and is late if paid after the 20th day of the month. Failure to
timely pay the rent, in addition to all other remedies, will result in a ten (10%) percent
late charge.
5. Utilities
Tenant shall be responsible for paying its own utilities.
6. Tenant Covenants
The Tenant makes the following covenants:
1. To keep the interior of Unit 2 and all fixtures therein in good condition and repair.
2. Not to make any structural alterations or additions to Unit 2 without the written
consent of the City.
3. Not to assign this Lease, nor sublet Unit 2, nor to permit any other person to
occupy Unit 2, except for employees of the Tenant.
4. To remove, at the termination of this Lease, all goods and effects, and to leave
Unit 2 in good repair and order, reasonable wear and tear excepted.
5. To use Unit 2 for the purpose of the Tenant's business only, and to comply in all
respects to the schedule of Tenant's Rules of Occupation, hereinafter called
"Rules", annexed to this Lease as Exhibit "B", or such amended rules that may
be issued by the City or the City's agents.
6. To purchase and maintain such insurance as Tenant deems appropriate to
protect Tenant from loss of Tenant's property due to fire and/or casualty; and to
purchase and maintain a commercial general liability premises policy in the
minimum amount of $1,000,000.00 per occurrence and $2,000,000.00
aggregate, and Tenant shall provide City with a Certificate of Insurance showing
City as an additional insured. The Certificate shall provide for a ten (10) day
written notice to City in the event of cancellation or material change of coverage.
Tenant shall furthermore hold the City harmless and indemnify it from any injury,
loss or damage that may occur to the property of employees of Tenant or other
third parties visiting the Tenant or other Tenants in the facility.
7. To the maximum extent permitted by insurance policies which may be owned by
City or Tenant, Tenant and City, for the benefit of each other, waive any and all
rights of subrogation which might otherwise exist.
8. To comply with all Federal, state, or local laws which may affect the Tenant's use
of Unit 2.
9. Not to affix signs or advertising displays of any kind, either to the exterior or
interior walls of Unit 2, or to any of its doors or windows, without the prior written
consent of City.
10.Tenant shall not vacate or abandon the premises at any time during the term
hereof, and if Tenant shall abandon or vacate the premises, or be dispossessed
by process of law, or otherwise, any personal property belonging to Tenant left
upon the premises shall be deemed to be abandoned at the option of the City.
11.City shall not be liable for any damage or injury to Tenant, or any other person, or
to any property, occurring on the demised premises or any part thereof, and
Tenant agrees to hold City harmless from any claims for damages unless such
damage or injury results from the negligence of the City.
7. Lessor’s Covenants
The City makes the following covenants:
1. The City covenants that it has the right to grant this Lease as Owner of the
building.
2. To keep the exterior of the premises in good repair and condition, and to clean
and maintain the areas of the Brookings Area Research and Technology Center
which are used in common by all Tenants. The City shall be responsible for the
exterior and interior structural maintenance of the building and maintaining the
common areas. The City shall be responsible for pest control around the
exterior of the Center and in the common areas. The City shall also be
responsible for maintenance of the heating and cooling system.
3. To insure and keep insured at all times the buildings, structures and fixtures
owned by the City against fire, windstorm and similar occurrences.
4. To permit the Tenant to occupy Unit 2 during the term of this Lease quietly and
peaceably, provided the Tenant performs the covenants of this Lease.
5. To provide and update a directory of Tenants in the reception area and to pro-
vide identification signs within the building to enable visitors to locate Tenant.
6. To provide suitable means of disposing of a reasonable amount of non--
hazardous waste materials resulting from use of the leased premises by
Tenant.
8. Mutual Covenants
1. It is mutually agreed that the principal objective of the Brookings Area Research
and Technology Center is to encourage the formation of successful new
businesses and to create new job opportunities, and this Lease and any other
agreement between the City and the Tenant must be construed in the context of
this objective.
2. Both parties agree that if Unit 2 shall be substantially destroyed by windstorm,
fire or other happening, then either party may elect to terminate this Lease by
giving written notice of termination to the other party.
3. If Tenant receives the City's written permission to alter or add to the structure,
such alterations or additions will be undertaken at the expense of the Tenant.
4. If Tenant fails to perform any of the covenants contained in this Lease, or if the
Tenant shall be declared bankrupt or insolvent, or if a receiver of the property of
the Tenant is appointed, or if an assignment shall be made of a Tenant's
property for the benefit of creditors, or if Tenant is otherwise in default under
this Lease, then the City shall give written notice of default to Tenant. The
Tenant shall have thirty (30) days to cure said default. In the event the Tenant
fails to cure said default within the thirty (30) day period, the City may
immediately enter into Unit 2, without further notice, and repossess Unit 2, expel
the Tenant and those claiming through or under the Tenant, and remove their
effects. The Tenant hereby expressly waives the service of any notice of
intention to re-enter, and Tenant covenants that, in the case of such
termination, the Tenant will indemnify the City against any loss of rent and other
claims that the City may incur by reason of termination of this Lease and re-
entry, including reasonable attorney's fees.
9. Miscellaneous
1. Any notice from the City to Tenant or from Tenant to City shall be deemed duly
served if mailed by certified mail to the last known address of the Tenant, or to
the address of the City or to the address of the Agents acting for City, and the
customary certified mail receipt shall be conclusive evidence of such service.
2. This Lease shall be subject to and construed under the laws of the State of
South Dakota.

TENANT RULES OF OCCUPATION
1. These are the Rules of Occupation referred to in Section 6.5 of the Tenant
Covenants contained in the Lease between the City and Tenant.
2. Tenants will be required to:
a. Ensure that all access doors into the building are properly closed after exit
or entry. Fire exit doors are for emergency use only and must not be used
for entry or exit or for loading or unloading freight. This requirement is
imposed to protect the security and integrity of the whole building and its
occupants.
b. Dispose of all waste materials in the receptacles provided by the City, and
not to leave any garbage or waste materials in any part of the premises or
on the parking lot. No oil, grease, paint, or other deleterious matter can be
deposited in any drain inside or outside the building.
c. Ensure that no gasoline or any other particularly inflammable explosive or
combustible material is stored within Unit 2 occupied by Tenant or on any
part of the Brookings Area Research and Technology Center in violation of
the City of Brookings Fire Code, with the exception only of fuel contained in
the fuel tanks of Tenant’s vehicles.
d. Take care to connect all plant and machinery to electrical services in an
approved manner and not to overload any electrical circuits.
e. Avoid obstructing the corridors or passageways within the Brookings Area
Research and Technology Center and to use only approved means of
transporting freight, goods or supplies through such corridors or
passageways.
f. Permit the City scheduled access at all reasonable times to enter and
inspect Unit 2 leased to the Tenant, and to allow contractors employed by
the City to enter and carry out repairs or alterations to any part of Unit 2 or
its fixtures, subject to reasonable notice and an opportunity to be present
during said repairs or alterations.
g. Do nothing which would cause the insurance procured by the City to
become void or invalidated.
h. To ensure that all employees of the Tenant that access Unit 2 are aware of
these Rules and to make it a condition of employment that employees obey
these Rules or any variation of them which are made from time to time.

Summary:
Representatives from Banner Associates and HDR Engineering will provide a presentation on the
results of the 22nd Avenue Corridor Study between Highway 14 Bypass and 20th Street South.
Background:
The City of Brookings retained the engineering services of Banner Associates and HDR to study the
22nd Avenue corridor between Highway 14 Bypass and 20th Street South. The study will provide the
City with recommendations on street widening, pavement section, lane configurations, pedestrian
walkway, and shared-use path routing, intersection layout, street lighting, potential utility relocations,
and construction phasing.
Representatives from Banner Associates and HDR Engineering will provide a presentation on the
results of the 22nd Avenue Corridor Study which is in the 90% review stage. There will be a public
comment period after the presentation. The City mailed a notice of the meeting to the property
owners on 22nd Avenue between Highway 14 Bypass and 20th Street South.
