Section 23. Powers and Duties of City Manager.
The duties and responsibilities of the City Manager shall be in accordance with South Dakota
State law, the Brookings City Charter, the City Governance and Ends Policies, all ordinances and
resolutions of the City of Brookings, and such policies as shall be adopted from time to time by
the City Council. The duties and responsibilities of the City Manager shall include but not
necessarily be limited to the following list:
The City Manager shall be the chief administrative officer of the City, responsible
to the Council for the administration of all city matters placed in the city
manager’s charge by or under this Agreement and the City Charter. The City
Manager shall:
A. Appoint and, when necessary in his discretion, suspend or remove all city
employees and appointive administrative officers provided for by or under the City Charter.
The City Manager may authorize any administrative employee or officer subject to the City
Manager’s direction and supervision to exercise these powers with respect to subordinates
in that employee or officer’s department, office or agency;
B. Direct and supervise the administration of all departments, offices and agencies of the
City, except as otherwise provided by the Charter or by other applicable law;
C. Attend all City Council meetings. The City Manager shall, except when the governing
body may be considering suspension or removal of the City Manager, have the right to
take part in discussion at City Council meetings;
D. See that all laws, provisions of the City Charter and acts of the City Council, subject to
enforcement by the City Manager or by employees or officers subject to the City
Manager’s direction and supervision, are faithfully executed;
E. Prepare and submit the annual budget and capital program to the City Council;
F. Submit updates annually on the date specified by the City Council a five-year capital
program in such form as the City Manager deems desirable or the City Council may
require;
G. Submit updates annually on the date specified by the City Council a five-year financial
plan in such form as the City Manager deems desirable or the City Council may require;
H. Submit to the City Council and make available to the public a complete report on the
finances and administrative activities of the City as of the end of each fiscal year;
I. Make such other reports as the City Council may require concerning the operations of
City departments, offices and agencies subject to the City Manager’s direction and
supervision;
J. Keep the City Council advised as to the financial condition and future needs of the City;
Sign all warrants for the payment of money, and the same shall be countersigned by the
Clerk, but no warrant shall be issued until the claim therefor has been approved by the
City Council, except as may be otherwise provided by ordinance or resolution;
K. Be the personnel director of the City;
L. Make recommendations to the City Council concerning the affairs of the City;
M. Provide support staff to assist the Mayor and other Council members; and
N. Perform such duties as are specified in the City Charter or as may be required by the City
Council.
SAMPLE ADVERTISEMENT - QUALIFICATIONS, EDUCATION/EXPERIENCE & SALARY
City Manager - Brookings, SD (pop. 23,773) is seeking an experienced, energetic, and innovative
municipal executive to assist the community through a period of extensive growth and economic
diversification. Located in an ideal setting, Brookings is the county seat and home to South Dakota State
University. The city operates under a home rule charter Council-Manager form of government with an
elected Mayor and six (6) city council members. Position supervises 139 FT employees and annual budget
of $53.5 M. Bachelor’s degree in business or public administration, political science, or related field
required. Master’s degree in public administration and ICMA Credentialed Manager designation preferred.
Candidate should possess at least five (5) years of progressive municipal government experience with at
least two (2) years as Assistant City Manager, Manager or General Government Administrator. Qualified
candidates will have experience in municipal government operations, finance/budgeting, economic
development, strategic planning, Council/staff relations, and personnel management. Starting salary range
will be market competitive depending upon qualifications and experience. The expected hiring range is

9‐10‐15. General powers of city manager. The manager shall have the following further powers and

(1) He shall see that the laws and ordinances are enforced;
(2) He shall supervise the administration of the affairs of the first or second class
municipality;
(3) He shall make such recommendations to the governing body concerning the affairs of
the first or second class municipality as may seem to him desirable;
(4) He shall keep the governing body advised of the financial condition and future needs of
the first or second class municipality;
(5) He shall prepare and submit to the governing body an annual budget not later than
August first of each year;
(6) He shall see that all terms and conditions imposed in favor of the first or second class
municipality or its inhabitants in any contract or franchise to which the municipality is a
party are faithfully kept and performed;
(7) Except when the governing body may be considering his removal the manager shall be
entitled to be present at all meetings of such governing body and its committees, and to
take part in their discussions;
(8) He shall sign all warrants for the payment of money, and the sa me shall be countersigned
by the auditor, but no warrant shall be issued until the claim therefor has been approved
by the governing body, except as may be otherwise provided by ordinance or resolution;
(9) He shall have the right to prepare and introduce ordinances and resolutions and take
part in the discussions on all matters coming before the governing body, but shall have
no vote;
(10) The manager shall have such further powers and duties as may be prescribed by
ordinance or resolution.
No contract of the manager for the payment of money in excess of two hundred dollars, except for
current necessities, shall be binding upon the first or second class municipality unless the payment shall be
approved by the governing body.

Be It Resolved by the City Council of the City of Brookings, South Dakota, as follows:
1. The assessment roll for Street Assessment Project No. 2017-05STA having been
filed in the office of the City Clerk on the 22nd day of January, 2018, the City Council
shall meet in the Chambers at the City & County Government Center, 520 3rd Street,
Brookings, SD on Tuesday, the 27th day of February, 2018 at 6:00 o'clock PM, the said
date being not less than twenty (20) days from the filing of said assessment roll for
hearing thereon.
2. The City Engineer is authorized and directed to prepare a notice describing, in
general terms Alley Assessment Project 2017-05STA, the date of filing the assessment
roll, the time and place of hearing thereon, stating that the assessment roll will be open
for public inspection at the office of the City Engineer and referring to the assessment
roll for further particulars.
3. The City Clerk is authorized and directed to publish said notice in the official

Whereas, the City of Brookings Police Department requests action to purchase two
2018 Ford Interceptor sedans from Einspahr Auto Plaza, Brookings, SD; and
Whereas, Einspahr Auto Plaza is Item #17148 for a 2018 Ford Interceptor sedan from
the South Dakota State Bid Authority; and
Whereas, the City of Brookings Police Department will purchase from Einspahr Auto
Plaza, Brookings, SD, two 2018 Ford Interceptor sedans in the amounr of $54,683.00
Whereas, the Capital Budget for the purchases is $61,000.
Now, Therefore, Be It Resolved that the contract from Einspahr Auto Plaza, Brookings,
SD in the amount of $54,683.00 be accepted.
G. Action on Abatement of Property Taxes for Ayres Properties LLC, 821 Regency
Court, in the amount of $402.00, legal description: S 10’ of Lot 1, All Lot 2, Block
2, Roberts Second Addition.
Presentation of annual Dr. Martin Luther King, Jr. Day Awards. In celebration of Dr.
King’s birthday, the Brookings Human Rights Commission sponsored a poster contest
for elementary and intermediate school students and an essay contest for middle school
and high school students to help students reflect on Dr. King’s ideas and their impact on
the community. This year’s theme for the poster contest was “We may all have come
on different ships, but we’re in the same boat now.” The theme for the essay contest
was “True peace is not merely the absence of tension; it is the presence of justice.”

Brookings Empowerment Project (BEP) in the amount of $7,000 for the Transitional
Housing Pilot Project, be approved. An amendment was made by Mayor Corbett,
seconded by Council Member Niemeyer, stipulating the transfer of the funds would be
made only upon sufficient completion of the Memorandum of Understanding and the
Lease Agreement. The motion carried by the following vote: Yes: 6 - Corbett, Niemeyer,
Kidwiler, Bacon, Wendell, and Tilton Byrne; Abstain: 1 – Hansen. On the original
motion as amended, the motion carried by the following vote: Yes: 6 - Corbett,

Background:
A public hearing and action by the local governing body is required to approve all alcohol licenses.
The Off-Sale Malt License would be effective until to June 30, 2018, and then subject to an annual
renewal. If approved, the application would be forwarded to the State Department of Revenue for
final action and issuance of the license.
