Brookings City Council
January 23, 2018
The Brookings City Council held a meeting on Tuesday, January 23, 2018 at 6:00p.m.,
at City Hall with the following City Council members present: Mayor Keith Corbett,
Council Members Mary Kidwiler, Dan Hansen, Holly Tilton Byrne, Nick Wendell, Patty
Bacon, and Ope Niemeyer. City Manager Jeff Weldon, City Attorney Steve Britzman,
and City Clerk Shari Thornes were also present.

Be It Resolved by the City Council of the City of Brookings, South Dakota, as follows:
1. The assessment roll for Street Assessment Project No. 2017-05STA having been
filed in the office of the City Clerk on the 22nd day of January, 2018, the City Council
shall meet in the Chambers at the City & County Government Center, 520 3rd Street,
Brookings, SO on Tuesday, the 27th day of February, 2018 at 6:00 o'clock PM, the said
date being not less than twenty (20) days from the filing of said assessment roll for
hearing thereon.
2. The City Engineer is authorized and directed to prepare a notice describing, in
general terms Alley Assessment Project 2017 -05STA, the date of filing the assessment
roll, the time and place of hearing thereon, stating that the assessment roll will be open
for public inspection at the office of the City Engineer and referring to the assessment
roll for further particulars.
3. The City Clerk is authorized and directed to publish said notice in the official
newspaper at least one (1) week prior to the date set for hearing and to mail a copy
thereof, by first class mail addressed to the owner or owners of any property to be
assessed at his, her or their last mailing address as shown by the records of the
Director of Equalization at least one (1) week prior to the date set for said hearing

Be It Resolved by the City Council of the City of Brookings, South Dakota, as follows:
1. The Assessment Roll for Sidewalk Assessment Project No. 2017-01 SWR having
been filed in the office of the City Clerk on the 22nd day of January, 2018, and the City
Council shall meet in the Chambers at the City & County Government Center, 520 3rd
Street, Brookings, SO on Tuesday, the 271h day of February, 2018, at 6:00 o'clock PM,
the said date being not less than twenty (20) days from the filing of said Assessment
Roll.
2. The City Engineer is authorized and directed to prepare a notice describing, in

F. Action on Resolution 18-008, a Resolution to purchase two marked Police
Sedans off the South Dakota State Bid.
Resolution 18-008 -Purchase of Police Vehicles
Whereas, the City of Brookings Police Department requests action to purchase two
2018 Ford Interceptor sedans from Einspahr Auto Plaza, Brookings, SD; and
Whereas, Einspahr Auto Plaza is Item #17148 for a 2018 Ford Interceptor sedan from
the South Dakota State Bid Authority; and
Whereas, the City of Brookings Police Department will purchase from Einspahr Auto
Plaza, Brookings, SO, two 2018 Ford Interceptor sedans in the amounr of $54,683.00
Whereas, the Capital Budget for the purchases is $61,000.
Now, Therefore, Be It Resolved that the contract from Einspahr Auto Plaza, Brookings,
SO in the amount of $54,683.00 be accepted.

G. Action on Abatement of Property Taxes for Ayres Properties LLC, 821 Regency
Court, in the amount of $402.00, legal description: S 1 0' of Lot 1, All Lot 2, Block
2, Roberts Second Addition.
Presentation of annual Dr. Martin Luther King, Jr. Day Awards. In celebration of Dr.
King's birthday, the Brookings Human Rights Commission sponsored a poster contest
for elementary and intermediate school students and an essay contest for middle school
and high school students to help students reflect on Dr. King's ideas and their impact on
the community. This year's theme for the poster contest was "We may all have come
on different ships, but we're in the same boat now." The theme for the essay contest
was "True peace is not merely the absence of tension; it is the presence of justice."
Mayor Keith Corbett presented the following winners with their awards: Grade K-1
Poster: 1st Place-Sanhita Tummala, 2nd Place-Jagat Perumal. Grade 2-3 Poster: 1st
Place-Kingston Schneider, 2nd Place TIE-Abigail Peck and Quinn Ulvestad. Grade
4-5 Poster: 1st Place -Anika Hood a, 2nd Place -Olivia Hove. Middle School Essay: 1st
Place TIE-Grace Enz and Aditya Tummala, 2nd Place-Olivia Foster, 3rd Place-
Nithin Perumal. High School Essay: 1st Place-Nathan Cole Dai, 2nd Place TIE -Jenna

Resolution 18-005. A motion was made by Council Member Hansen, seconded by
Council Member Kidwiler, that Resolution 18-005, a Resolution Resolution ap'provirig
the First Lease Amendment for Communications Tower with NCWPCS MPL 32-Year
Sites Tower Holdings, LLC, be approved. The motion carried by the following vote: Yes:
7 -Corbett, Niemeyer, Hansen, Kidwiler, Bacon, Wendell, and Tilton Byrne.
Resolution 18-005 -Resolution Approving the First Lease Amendment for
Communications Tower with NCWPCS MPL 32-Year Sites Tower Holdings LLC
Be It Resolved by the Governing Body of the City of Brookings, South Dakota, that the
City of Brookings approves a Lease Amendment for the current site of a
Communications Tower near Bob Sheldon Field with NCWPCS MPL 32-Year Sites
Tower Holdings LLC, Lessee, for five (5) additional five (5) year periods, commencing
upon the first day following the expiration of the current Lease, and pertaining to the
following described property:
A parcel of land located in a portion of Lot A of the Subdivision of Park View &
Lots One (1) to Five (5) of Park View Second Addition, a part of the Southwest
Quarter of the Southwest Quarter (SW%SW%) & the West One-half of the West
One-half (W%W%) of the Southeast Quarter of the Southwest Quarter
(SE%SW%), all in Section Twenty-five (25), Township One Hundred Ten (110)
North, Range Fifty (50) West of the 5th Principal Meridian, City of Brookings,
County of Brookings, South Dakota.
Ordinance 18-001. Introduction and first reading was held on Ordinance 18-001, an
Ordinance pertaining to a Conditional Use Permit to establish a mixed business I
residential use for an Ambulance Service in a Business B-2A Office District on E150' of
W454.32' of Lot 1, Excluding S164.3', Block 4, Maylands First Addition (along Yorkshire
Drive). Public Hearing: February 13, 2018.
Ordinance 18-002. Introduction and first reading was held on Ordinance 18-002, an
Ordinance rezoning Lot 1, Block 1, Christie Springs Addition; Block 4, Christie Third
Addition; and a portion of the NW% of Section 2-T1 09N-R50W excluding all outlets and
other platted areas thereof and excluding the S640' of the N1 062' of the E246' in NW%
of Section 2-T109N-R50W from Residence R-1C Single-Family, Residence R-3
Apartment, and Business B-2 District to Residence R-1 D Single-Family, Residence R-2
Two-Family, and Residence R-3 Apartment District (Fox Run Addition). Public Hearing:
February 13, 2018.
Request from Brookings Empowerment Project. A motion was made by Council
Member Kidwiler, seconded by Council Member Niemeyer, that a request from
Brookings Empowerment Project (BEP) in the amount of $7,000 for the Transitional
Housing Pilot Project, be approved. An amendment was made by Mayor Corbett,
seconded by Council Member Niemeyer, stipulating the transfer of the funds would be
made only upon sufficient completion of the Memorandum of Understanding and the
Lease Agreement. The motion carried by the following vote: Yes: 6-Corbett, Niemeyer,
Kidwiler, Bacon, Wendell, and Tilton Byrne; Abstain: 1 -Hansen. On the original
motion as amended, the motion carried by the following vote: Yes: 6-Corbett,
Niemeyer, Kidwiler, Bacon, Wendell, and Tilton Byrne; Abstain: 1 -Hansen.
Adjourn. A motion was made by Council Member Hansen, seconded by Council
Member Niemeyer, to adjourn the meeting at 7:12p.m. The motion carried by a
unanimous vote.
