HomeMy WebLinkAboutJPBMinutes_2013_11_07BROOKINGS CITY/COUNTY JOINT POWERS BOARD MEETING Thursday, November 7, 2013 The Joint Powers Board met on Thursday, November 7, 2013 with the following members present: John Kubal, Ryan Krogman, Dennis Falken and Keith Corbett attending in place of Tim Reed. REGULAR BUSINESS Chairperson Falken called the meeting to order and a quorum was established. Motion by Krogman, seconded by Kubal to approve the minutes from the August 8, 2013 Joint Powers Board Meeting. All members voted “aye.” Motion carried. The board discussed the status of remaining warranty issues. City Manager Jeff Weldon said there are areas where the wood veneer is cracking due to the dryness in the building last winter. He said the cost to repair that will probably be a multi-way split among various vendors. Weldon said there has been a lot of finger-pointing, but Clark Drew’s explanation about the dryness seems most plausible. He said West Plains engineering is also involved. Weldon said there are dark spots developing on some of the precast planters. He said this will be Gil Haugen’s responsibility. Weldon said he isn’t sure what is causing the spots, but they are appearing in certain areas on the lower level of the building. Weldon said there are areas in the building where the stain is flaking off the millwork. Commission Assistant Stephanie Ellwein said areas o f base trim and the stairwell are most noticeable. Weldon said this is a Clark Drew issue as well. He said they do continue to hold performance bonds on these outstanding issues. Weldon said a more serious issue with the change over to the heating season is that the building is way too dry. He said buildings like this typically do not have hum idification systems, but Johnson Controls is saying there aren’t enough people per square foot to make up for that. Weldon said Johnson Controls is working with West Plains on this issue. He said the east side of the building is worse than the west side. Ellwein said the humidity should be around 45% and it was 18% the day before on the east side. Weldon said the HVAC system worked well this summer, but now they’re having issues again. Falken asked about the vendor performance bonds. Weldon said they s till hold the bonds although the retainage amounts have been paid out. He said the vendors still have good reason to be concerned if they decide to cash in the performance bonds. Weldon said there has also been a noise in the elevators. He said they’ve looked into it, but haven’t found anything. Kubal asked about issues where countertops are pulling away from the walls. Ellwein said some areas have been fixed, but the vendor didn’t have a list of all the countertops where this was happening so some are still in need of repair. Ellwein said there was a window that was also fixed, but there is still damage to the sheetrock. She said she doesn’t feel the city and county should be responsible for those costs. The board considered purchasing artwork for the main corridor in the building. Weldon said he was approached by an artist that has a water -coloring painting that depicts the intersection of 5th Street and Medary Avenue in Brookings. He said the cost is $3,458 and the artwork is 3 feet tall by 8 feet wide and would need to be reframed. Weldon said they’ve talked about possibilities and they do have places to put a picture that size. He noted that there is about $50,400 left in the construction contingency as well. Krogman said it would cost another $1,000 to reframe it. Falken said he’s not sure he’s interested in spending money for something that depicts one specific area. Corbett said this could turn into more trouble than what it’s worth. Krogman asked if there have been any complaints about the décor in the building. Ellwein said employees have made comments, but no one from the public has. Kubal said he will look at the painting and report back to the board. Krogman said he does like the idea of local pictures. The board discussed the status of the back-up generator. Weldon said he’s not sure what the board wanted done after the last meeting since he wasn’t there. He said he believ es it was determined that the county’s generator would be sufficient, but it would have limitations. Ellwei n said they need to determine what the generator would be able to handle for sump pumps, and if it can only handle one would that be sufficient. Falken said their big concern is the sump pumps and if it can run enough of them to protect the building. He said they could get that information from Building Maintenance Supervisor John Molengraaf and City Building Inspector Greg Miller for the next Joint Powers Board meeting. Weldon said they can look into it and see what it can handle. Weldon said he has cost estimates for a concrete pad and protection bollards if or when then decide to install the generator. City Attorney Steve Britzman and Deputy State’s Attorney Abigail Howard updated the board on the Gil Haugen mediation. Weldon said he was approached by Don Iverson about selling his property that is located next to the city and county building. He said Iverson wouldn’t give him a price, but has asked for the same price per square foot the city and county paid for the other properties. Weldon said the difference is they needed those properties and they don’t need this. Falken asked if they should do a market value estimate to get a base value of what it is worth. Krogman said they could go through a realtor or an appraiser to do that. Kubal said if they wait, the property could escalate in value. Krogman said if the property changed its use to commercial property it would be worth more, but as a single family home it isn’t worth much in the location it is in. Falken said since he came to us they should respond to him. He said they need to tell him they aren’t interested or give him a price. Falken said giving him a price is like making an off er though. He said he would just as soon purchase the rest of the property on the block and do it all at once. Krogman said he doesn’t see any harm in getting a cost estimate to see if it is close to what they may be willing to pay for it. He said they will have to determine how much the property is worth to the city and county if Iverson asks for a price that goes over the value though. Weldon said they can get a market value analysis; have a realtor look at the comparables and do a walk-thru. He said the whole purpose will be to formulate an offer. Falken said if the price is right they should get it, but he’s not too concerned with acquiring it at this time. Krogman said the price may go up if and when the other properties in the block come up for sale though, so it may make more sense to purchase this one now. Motion by Kubal, seconded by Corbett to hire a realtor to do a market evaluation and get a broker’s price opinion on the Iverson property. All members voted “aye.” Motion carried. The next meeting is scheduled for February 13, 2013. ADJOURNMENT Motion by Kubal, seconded by Corbett to adjourn. All members voted “aye.” Motion carried.
