AMENDMENT NO. 2 TO THE STATE OF SOUTH DAKOTA DOT JOINT POWERS FINANCIAL, MAINTENANCE AND ENCROACHMENT AGREEMENT Motion was made by Peterson that the following Resolution No. 9 -14 be approved. RESOLUTION NO. 9 - 14 RESOLUTION APPROVING AMENDMENT NO. 2 TO THE STATE OF SOUTH DAKOTA JOINT POWERS FINANCIAL, MAINTENANCE AND ENCROACHMENT AGREEMENT BETWEEN DOT, CITY OF BROOKINGS AND BROOKINGS MUNICIPAL UTILITIES BE IT RESOLVED by the Brookings Municipal Utilities Board (the Board) that: 1. Amendment No. 2 to the Agreement entitled "State of South Dakota Joint Powers Financial, Maintenance and Encroachment Agreement Between DOT, City of Brookings and Brookings Municipal Utilities” be hereby approved. 2. The President of the Board and/or Executive Vice President/General Manager be hereby authorized to execute the approved contract documents. Adopted this 24th day of March, 2014.
