HomeMy WebLinkAboutCCMinutes_2015_06_23 � 327 Brookings City Council June 23, 2015 The Brookings City Council held a meeting on Tuesday, June 23, 2015 at 6:00 p.m., at City Hall with the following members present: Deputy Mayor Keith Corbett, Council Members Dan Hansen, Ope Niemeyer, Patty Bacon, Scott Meyer, and Jael Thorpe; Mayor Tim Reed was absent. City Attorney Steve Britzman, City Manager Jeffrey Weldon, and Deputy City Clerk Bonnie Foster were also present. Consent Aqenda. A motion was made by Council Member Thorpe, seconded by Council Member Bacon, to approve the Consent Agenda. The motion carried by the � following vote: Yes: 6 - Corbett, Hansen, Niemeyer, Thorpe, Meyer, and Bacon; Absent: 1 — Reed. 3.A. Action to approve the agenda. 3.B. Action on appointment to the Brookings health System Board of Trustees; appoint Dr. Andrew Ellsworth (term 6/23/2015-1/1/2016). Proclamation. A Mayoral Proclamation for the Dakota Royal Charity Draft Horse Show Days was read. Resolution 15-070. A motion was made by Council Member Hansen, seconded by Council Member Niemeyer, that Resolution 15-070, a Resolution awarding the Landfill Farm Land Bid. be approved. The motion carried by the following vote: Yes: 6 - Corbett, Hansen, Niemeyer, Thorpe, Meyer, and Bacon; Absent: 1 — Reed. Resolution 15-070 - Resolution of Intent to Lease Real Property to Private Person (City Farm land) Whereas, the City of Brookings opened bids for approximately 120 acres of Landfill Farm Land Lease for the City-owned parcel located in Section 8-T110N-R49W located north of the Brookings Regional Landfill on Tuesday, June 9, 2015 at 1:30 PM at the Brookings City & County Government Center; and Whereas, the City of Brookings has received the following bids for Landfill Farm Land Lease: Daniel Luze, Elkton, SD - $211.00/acre, and David Rochel, Aurora, SD $154.25/acre. The lease will be for a period of (5) five years, commencing on January 1, 2016 and ending on December 31, 2020. Annual rent payment will be due on April 1st of each year. If a portion of the farm land is used for Solid Waste activities, the number of acres to be paid for will be adjusted at the bid price of$211.00 per acre. Now Therefore, Be It Resolved that the high bid of Daniel Luze, Elkton, SD for $211.00 per acre be accepted. Be It Further Noted, that a public Hearing on this Resolution was held on June 23, 2015 at 6:00 o'clock P.M. in the Chambers of the City & County Government Center and that all persons were given an opportunity to be heard on the intent to lease real property. FIRST READING: Ordinance 15-011. First Reading and Introduction was held on Ordinance 15-011, an Ordinance rezoning the SW '/4 of the NE '/4 of Section 34-T110N- R50W from a Residence R-1 B to a Residence R-1 C and R-2 District and a Residence R-2 District to a Residence R-1 C District. Public Hearing: July 14, 2015. Temporarv Liquor Application. A motion was made by Council Member Hansen, seconded by Council Member Niemeyer, that the Temporary Liquor Application for Downtown Brookings, Inc., to host a series of events on the 300 Block of 5th Street (between 3rd Ave. and Main Ave.) on July 16, July 23, July 30, August 6, August 13, August 20 and August 27, 2015, be approved. The motion carried by the following vote: Yes: 6 - Corbett, Hansen, Niemeyer, Thorpe, Meyer, and Bacon; Absent: 1 - Reed 32 � Resolution 15-069. A motion was made by Council Member Hansen, seconded by Council Member Meyer, that Resolution 15-069, a Resolution for a Petition to Annex the S '/z of the NW '/4 of Section 34-T110N-R50W (West of Timberline Addition), be approved. The motion carried by the following vote: Yes: 6 - Corbett, Hansen, Niemeyer, Thorpe, Meyer, and Bacon; Absent: 1 — Reed. Resolution 15-069 - Resolution Annexing the South '/Z of the Northwest '/4 of Section 34-T110N-R50W Whereas, the City of Brookings is authorized pursuant to South Dakota Codified Law 9-4-1 to annex contiguous territory upon receipt of a written petition, describing said territory sought to be annexed, signed by not less than three-fourths (3/4) of the legal voters and by the owner or owners of not less than three-fourths (3/4) of the value of said territory; and Whereas, the City of Brookings desires to annex the following described property, to wit: the south 1/2 of the northwest 1/4 of Section 34-T110N-R50W. Whereas, the aforesaid land is contiguous to the present boundaries of the City of Brookings; and Whereas, the City of Brookings has received a Petition for Annexation of Territory signed by the owners of greater than three-fourths (3/4) of the value of the aforesaid property and there being no legal voters residing in said territory. Now, Therefore Be It Resolved by the City of Brookings, South Dakota that the property described above is hereby annexed to the City of Brookings. Preliminarv Plat. A motion was made by Council Member Hansen, seconded by Council Member Niemeyer, that the Preliminary Plat of Lots 10-25, Block 6; Lots 9-15, Block 7; and Lots 7-15 and 20-33, Block 8, Timberline Addition in the W1/2 of the NE1/4 excluding the North 1,350' in Section 34-T110N-R50W be approved. The motion carried by the following vote: Yes: 6 - Corbett, Hansen, Niemeyer, Thorpe, Meyer, and Bacon; Absent: 1 — Reed. Preliminarv Plat. A motion was made by Council Member Hansen, seconded by Council Member Thorpe, that the Preliminary Plat of the south portion of Prairie Hills Addition in the E1/2 of Section 2-T109N-R50W be approved. The motion carried by the following vote: Yes: 6 - Corbett, Hansen, Niemeyer, Thorpe, Meyer, and Bacon; Absent: 1 — Reed. Meyer left the meeting at 7:46 p.m. Policv Discussion pertaininq to Sale of Citv Propertv for Develoament Purposes. A motion was made by Council Member Hansen, seconded by Council Member Thorpe, to ask City Staff to look at developmental policy in which when land is sold as currently zoned Business or intended to be zoned Business that it is done at auction and look at what clawbacks might be possible with regard length of time someone can sit on that land before it is developed. The motion carried by the following vote: Yes: 5 - Corbett, Hansen, Niemeyer, Thorpe, and Bacon; Absent: 2 — Meyer and Reed. Adiourn. A motion was made by Council Member Hansen, seconded by Council Member Bacon, to adjourn the meeting at 8:11 p.m. The motion carried by a unanimous vote.
