HomeMy WebLinkAboutOrdinance 25-1997 ORDINANCE NO. 25-97 AN ORDINANCE REVISING ORDINANCE NO. 11-91 REGARDING THE LICENSING OF LEASED DWELLING UNITS WITHIN THE CITY OF BROOK�IGS. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS, SOUTH DAKOTA THAT CHAPTER 19, HOUSING, OF THE CODE OF ORDINANCES SHALL BE AMENDED AS FOLLOWS, TO WIT: I. Section 19-30 Definidons (A) (b) Dwelling - a dwelling is a building or a portion thereof used exclusively for permanent residential occupancy including one-family dwellings, two-family dwellings, apartments, condominiums, townhouses, fraternities, sororities, boardinghouses and mobile homes. Section 19-36. Inspection Required. Upon receipt of an application for any dwelling unit rental license, except for the initial licensing as per section 19-33, the building official ar its authorized representative shall, within sixty(60) days after receiving the application, inspect the dwelling unit to be licensed to determine whether the unit complies with the initial inspection requirements of section 19-37. No dwelling unit rental license shall be issued by the city unless the dwelling unit complies with the initial inspection requirements. Units not previously licensed shall be allowed ninety (90) days from the date of inspection to conform to the requirements established in section 19-37. Compliance dates on currently licensed units shall be determined by the Building Official or his authorized representative. Secdon 19-37 (1) Smoke Detector - Each dwelling unit shall contain a properly installed and maintained smoke detector which meets the minimum standards established under SDCL 34-29-15.3. One smoke detector is required on each floor used for sleeping purposes. Dwelling units existing on January 1, 1980 may install battery operated smoke detectors. Secdon 19-37. (2) (b) (3) One operable window approved for emergency escape or rescue. Escape or rescue windows shall have a minimum net clear openable area of 4.6 square feet. The minimum net clear openable height dimension shall be 24 inches. The minimum net clear openable width dimension shall be 20 inches. When windows are provided as a means of escape or rescue, they shall have a finished sill height not more than 48 inches above the floor. Escape and rescue windows with a finished sill height below the adjacent ground elevation shall have a window well. Window wells shall comply with the following: (1) The clear horizontal dimensions shall allow the window to be fully opened and provide a minimum accessible net clear opening of 9 square feet with a minimum dimension of 36 inches. (2) Window wells with a vertical depth of more than 48 inches shall be equipped with an approved permanently affixed ladder or stairs that are accessible with the window in the fully open position. The ladder or stairs shall not encroach into the required dimensions of the window well by more than 6 inches. Such means of . ► .1r � escape shall be acceptable if the window is within twenty (20) feet of grade or if the window opens onto an exterior balcony or porch roof. Excepdon. Sleeping rooms in basement dwelling units which existed prior to September 24, 1968 may have a permanently affixed ladder, platform or equivalent rigid object below one window, meeting the minimum net clear opening requirements, capable of supporting the occupant(s) and having a vertical distance from the window sill of not more than forty-eight (48) inches. The distance from the ladder, platform or equivalent rigid object to the window sill shall not be less than thirty-six (36) inches if the window opens into the room. The ladder, platform or equivalent rigid object shall have a horizontal surface projection from the wall of not less than seven (7) inches. The length, running parallel with the wall, shall not be less than twenty(20) inches. Section 19-38. Subsequent to conformance with the initial inspection requirements and issuance of the license, additional inspections of the premises may be made if the Building Official determines hazardous conditions exist on the premises which may endanger the health, safety and welfare of the occupants. Said inspections shall be made in accor�iance with the provisions of the Uniform Building Code. Section 19-39. Display of License The license shall be displayed in a conspicuous place within each dwelling unit near the main entrance. Apartment buildings may display one license in a conspicuous place within the building near the primary entrance or an entrance authorized by the Building Official. It shall be unlawful for any person or persons to display any license under this chapter which has been terminated or revoked or which has not been lawfully procured or issued. II. All ordinances in conflict herewith are hereby repealed.
