HomeMy WebLinkAboutOrdinance 35-1999 T f ORDINANCE NO. 35-99 AN ORDINANCE REVISING THE ZONING ORDINANCE OF THE CITY OF BROOKINGS PERTAINING TO SIGNS BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS, SOUTH DAKOTA, THAT ARTICLE VII, SECTION 50.80.000, CHAPTER 50, THE 1994 REVISED ZONING ORDINANCE SHALL BE AMENDED, AS FOLLOWS, TO-WIT: 1. Section 50.80.300 DEFINITIONS .018 Banner — Any sign of lightweight fabric or similar material that is attached to a structure or building with cables, ropes, tie downs or other fasteners. National flags, state or municipal flags, or the official flag of any institution or business shall not be considered banners. Section 50.80.740 MISCELLANEOUS SIGNS B. Portable signs shall be regulated as follows: 1. A portable sign displayed on a lot shall be subject to a fee established by the governing body, 2. Portable signs may be displayed on a lot for ninety (90) permit days per calendar year. Permits shall be issued for a maximum of 30 consecutive days with a minimum of 30 consecutive days between the permit expiration date and the issuance of a new permit. EXCEPTION: Portable signs exceeding 32 square feet shall be allowed on a lot for up to 7 days within a maximum permit period. 3. Same D. Banner Signs shall be regulated as follows: 1. A banner sign displayed on a lot shall be subject to an annual fee established by the governing body. 2. Banners shall be secured to a structure or building at all times. DATE: January 4, 2000 RE: Zoning Ordinance Amendments - Ordinance 35-99 Proposal: Amend sign regulations pertaining to portable and banner signs. Backqround: Portable and banner signs were first regulated when the new sign ordinance was adopted in December 1998. The primary focus was to establish minimal controls so a business would not use numerous portable signs or banner signs to advertise products. The new sign ordinance was designed to encourage permanent type signage. The location on the lot was also important. The city had experienced a problem with portable signs over sidewalks and signs overturning in storms. Another concern was that some portables had actually become permanent because they had existed for several years. FROM: Planning Administrator Dan Hanson ,r, ° DATE: March 21, 2000 RE: Sign Ordinance Amendments and Street Vacation SiQn Ordinance The changes to the sign ordinance as discussed at the January 10th and March 6th meetings with the City Council are as follows: 1. Increase the maximum size of a portable sign from 24 square feet to 32 square feet. 2. Include an exception for a portable sign larger than 32 square feet to be allowed for up to seven (7) days. (This would allow a sign such as the Daktronics portable sign to be used for special events.) , These changes should be included as amendments prior to a final decision on the ordinance. Street Vacation Proposal: Vacate 10th Street between 32"d Avenue and 34th Avenue. ° Recommendation: The City Planning Commission voted seven (7) yes and zero (0) no to recommend vacating this street.
