HomeMy WebLinkAboutOrdinance 32-1999 i ` � ORDINANCE NO. 32-99 AN ORDINANCE AMENDING CHAPTER 20 OF THE REVISED ORDINANCES OF THE CITY OF BROOKINGS PERTAINING TO HOSPITAL AND NURSING CARE FACILITIES TO READ AS FOLLOWS.to-wit: BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS that Chapter 20 of the Revised Ordinances of the City of Brookings be amended as follows: ARTICLE I. IN GENERAL Sec. 20-1. Created. Unchanged. Sec. 20-2. Purpose The purpose of the Brookings Hospital and Brookview Manor is: 1. To provide health care services to inpatients and outpatients in need of hospital based services. 2. To maintain a long-term nursing care facility which wilt provide necessary services for the elderly, chronically ill or disabled persons for which it is equipped. 3. To provide quality health care and supportive services to a11 persons within the capabilities of the facility, without regard to sex, race, creed, religious preference, ethnic background, age or economic status. Sec. 20-3--20-17. Reserved. ARTICLE II. JOINT MU1vICIPAL-COUNTY HOSPITAL BOARD OF TRUSTEES Sec. 20-18. Board of Trustees. There is hereby continued, as heretofore established in and for the City, a Boa.rd of Trustees to govern the Brookings Hospital and Brookview Manor, which were constructed in part, through the use of municipal and county funds. Sec. 20-19. Composition, appointment, criteria for appointment. The Board of Trustees provided for by this Article shall be composed of nine (9) members. Six(6)members shall be duly qualified residents and electors of the City of Brookings and shall be appointed by the Mayor with the advice and consent of the City Council. Three (3)members shall be residents and electors of the County of Brookings, residing outside the corporate limits of the City of Brookings and sha11 be appointed by the County Commission. At least one(1) of the nine (9)members shall be a member of the active medical staff of the Brookings Hospital. Individuals recommended to the City Council or the County Commission to serve as members of the Board of Trustees shall evidence an interest in fostering and maintaining a system of quality health care through support of the purpose of the Brookings Hospital and Brookview Manor as stated in this Section 20-2. Appointment shall be made without reference to sex, race, creed, religious preference, ethnic background, age or economic status. Sec. 20-20. Compensation/Terms. The members of the Board of Trustees shall serve without compensation�cept reasonable expenses sha11 be paid when a member is performing Hospital and Manor business. The members of the Board of Trustees shall be appointed for staggered three (3)year terms. New members shall be appointed prior to the first day of 7anuary of each year. No members may serve more than three(3) consecutive terms. In the event a Board Member resigns or is disqualified prior to the end of their term, the Mayor, with the advice and consent of the City Council or the County Commission, as the case may be, sha11 appoint a new Board Member to complete the resigning Board Member's term. If a member shall miss more than fifty percent (50%) of the meetings annually without authorization of the Board, he or she sha11 automatically be disqualified from serving on the Board and a replacement shall be appointed. Sec. 20-21. Ex-officio Members. The Mayor, subject to the advice and consent of the City Council, may appoint an ex- officio member of the Hospital Board of Trustees. The ex-officio member sha11 be entitled to all privileges and rights of a Board Member, except he or she shall not be entitled to make or second motions or to vote. Sec. 20-22. Meetings. Unchanged. The Board of Trustees created by tlus article shall annually elect from its number a President, Vice-President, and Secretary, each of whom sha.11 hold their office respectively for one(1)year and until their successors have been elected from their number. The Boaxd shall have and is vested with a11 powers and authority, except as may be expressly limited by applicable law. The Board shall have power to do or cause to be done by delegation to others and all lawful things for and on behalf of the Hospital and Manor. The Board of Trustees sha11 have power and authority to direct and control the Hospital and Nursing Care Facility and shall have the power and authority to adopt By-Laws necessary in the proper governance of the Hospital and Manor, provided such By-Laws are consistent with state law and city ordinance. Sec. 20-28. Collection of Funds. All funds and revenues derived from the operation of such Hospital and Nursing Care Facility shall be collected by the business office and a record of a11 such funds and revenues received shall be submitted to the City Finance Office by copy of daily deposit slips and by submission of an annual audited financial report. Sec. 20-29. Payment of Warrants. All expenditures of the Brookings Hospital and Brookview Manor shall be approved by the Board of Trustees and warrants for payment of such expenditures sha11 be drawn on the Hospital and Brookview Manor funds.
