August 12, 2014 The Brookings City Council held a meeting on Tuesday, August 12, 2014 at 5:00 p.m., at City Hall with the foilowing members present: Mayor Tim Reed, Council Members Keith Corbett, Dan Hansen, Ope Niemeyer,Tom Bezdichek and Jael Thorpe. John Kubal was absent. City Attorney Steve Britzman, City Manager Jeffrey Weldon and City Clerk Shari Thornes were also present. 5:00 p.m. Budget Work Session 6:00 p.m. Regular Council Meeting Consent A�enda. A motion was made by Hansen, seconded by Corbett,to approve the consent agenda. A. Action to approve the agenda. B. Action to approve the July 15 and July 22 Council Meeting Minutes. C. Action on an appointment to the Historic Preservation Commission: lanet Merriman (term: 8/12/2014-1/1/2015). D. Action on Resolution No. 56-14, a Resolution declaring items as surplus property. Resolution No. 56-14-Appraising and Authorizing Sale of Surplus Property Whereas,the City of Brookings has surplus items as listed in a Notice of Sale that are no longer necessary or useful for City purposes,and it is the desire of the City to dispose of same as surplus property; Now,Therefore Be It Resolved,that all the attached listed property be declared surplus by the City Council. Resolution No. 57-14-A Resolution authorizing the Mayor to sign a Joint Powers Agreement between the Department of Transportation and the City of Brookings for Project P 0014(204)421 PCN 04TV; Sunrise Ridge Road, Brookings,SD Whereas,the Brookings City Council desires the construction improvement of Sunrise Ridge Road from 6th Street to 25t"Avenue in Brookings, SD; and Whereas, the City of Brookings is obligated and hereby agrees to provide maintenance as required by the Joint Powers Agreement between the Department of Transportation and the City of Brookings; and Whereas,the City of Brookings is obligated and hereby agrees to the provisions outlined in the Joint Powers Agreement between the Department of Transportation and the City of Brookings. A motion was made by Corbett, seconded by Hansen,to approve Resolution No. 58-14, a Resolution awarding the contract for 2014-03SSI Division Avenue Drainage Improvement Project, Phase I. All present voted yes; motion carried. Resolution No. 58-14- Resolution Awarding Bids for 2014-03551 Division Avenue Drainage Improvement Project, Phase I Whereas,the City of Brookings opened bids for 2014-03SSI Division Avenue Drainage Improvement Project, Phase I, on Tuesday,August 5, 2014 at 1:30 pm at the Brookings City& County Government Center; and Whereas,#he City of Brookings has received the foNowing bids for 2014-03SSI Division Avenue Drainage Improvement Project, Phase I: Bowes Construction, Inc.: $253,024.95 and Rounds Construction Company, Inc.: $272,670.24. Now Therefore, Be It Resolved that the project be awarded to the low bid of Bowes Construction, Inc. for$253,024.95, contingent on South Dakota Department of Environmental and Natural Resources approval. Resolution No. 59-14. A motion was made by Hansen, seconded by Corbett,to approve Resolution No. 59-14, a Resolution authorizing Change Order No. 3 (CCO#3)for Brookings Runway Re-Alignment Project (Phase 2), A{P#3-46-0005-025-2013; Bowes Construction, Inc. All present voted yes; motion carried. Resolution No. 59-14-A Resolution authorizing Change Order No. 3 (CCO#3)for Brookings Runway Re-Alignment Project (Phase 2), AIP#3-46-0005-026-2013; Bowes Construction, Inc. Be It Resolved by the City Council that the following Change Order be allowed for Brookings Runway Re-Alignment Project (Phase 2), AIP#3-46-0005-026-2013, Construction Change Order Number 3, Bowes Construction, Inc.: Adjust the contract for excavation and backfill for the Instrument Landing System shelters, MALSR Lights and Localizer Antenna, 1080 Ft of 24" RCP storm sewer and one flared end,4 storm sewer junction boxes, rip rap, PCC Non-aircraft pavement for jet blast protection at the ends of Runway 12/30, and sub�base course for Taxiways B, 61, and 62 for a total increase of $286,116.05 to the project. A motion was made by Niemeyer, seconded by Hansen,to approve Resolution No. 60-14, a Resolution authorizing Chan�e Order No. 2 (CCO#2) for Brookings Runway Re-Alignment Project (Phase 2),AIP#3-46-0005-026-2013; Muth Electric, Inc. AI1 present voted yes; motion carried. Resolution No. 60-14-A Resolution authorizing Change Order No. 2 (CCO#2)for Brookin�s Runway Re-Alignment Project(Phase 2),AIP#3-46-0005-026-2013; Muth Electric, lnc. Be It Resolved by the City Council that the followin�change order be allowed for Brookings Runway Re-Alignment Project (Phase 2), AIP#3-46-0005-026-2013, Construction Change Order Number 2; Muth Electric, Inc.: Adjust the contract for additional quantity for the bored 1-2" Duct to allow for boring under the MALSR Road, and for an additional 2-Panel Taxiway Sign (Destination Sign) on Taxiway A,the addition of Taxiway Location Signs, Unlighted Taxiway Ending Marker Signs and sign relocation, and extra work to move the DM.E Antenna Foundation due to unstable subsurface conditions for a total increase of$15,372.00 to the project. � 227 Adjust the contract completion date by 63 calendar days for FAA NAVAIDS for the Instrument Landing System and adjust the contract completion date by 14 calendar days for the electrical work for Phase A. Ordinance No. 18-14. A public hearing was held on Ordinance No. 18-14, an Ordinance amending Division 1 of Article VI of Chapter 22 of the Code of Ordinances of the City of Brookings and pertaining to Licensing of Rental Dwelling Units in the City of Brookings, South Dakota. No public comment. A motion was made by Corbett, seconded by Hansen,to approve Ordinance No. 18-14. All present voted yes; motion carried. Ordinance No. 19-14. A public hearing was held on Ordinance No. 19-14, an Ordinance amending Article II of Chapter 22 of the Code of Ordinances of the City of Brookings and pertaining to Building Code Variances in the City of 8rookings, SD. No public comment. A motion was made by Corbett, seconded by Niemeyer,to approve Ordinance No. 19-14. All present voted yes; motion carried. Temporarv Liquor License. A public hearing was held on a temporary liquor license for the VFW 727th/DAV Charity Poker Run to be held at the National Guard Armory on August 30, 2014. A motion was made by Corbett, seconded by Niemeyer,to approve. All present voted yes; motion carried. TABLED ITEM: Resolution No. 55-14. A motion was made by Hansen, seconded by Corbett,to remove from the table, Resolution No. 55-14, a Resolution of Intent of the City of Brookings to Lease to SGS North American Inc. the following described property in the Research & Technology Center, 803 32"d Avenue, Brookings,SD. All present voted yes; motion carried. A motion was made by Niemeyer, seconded by Thorpe,to approve Resolution No. 55-14. All present voted yes; motion carried. Resolution No. 55-14- Resolution of Intent to Lease Real Property to SGS North America Inc. Be It Resolved by the governing body of the City of Brookings, South Dakota that the City of Brookings intends to enter into a lease agreement with SGS North America Inc.,for a period of one year with an option to renew for two additional one year periods pertaining to the following described property: Research &Technology Center—803 32"d Avenue. The lease will be an amount of$10.00 per square foot for Year One (1), and increased by the percentage increase of the previous twelve month period of the Consumer Price Index— Midwest Region based on the agreed upon square footage of 2,120 square feet. Be It Further Noted,that a Public Hearing on this Resolution was held on July 22, 2014 at 6:00 o'clock P.M. at the Brookings City&County Government Center and that all persons were given an opportunity to be heard on the intent to lease real property.
