HomeMy WebLinkAboutCCMinutes_2014_07_22 � 221 Brookings City Council Juty 22, 2014 The Brookings City Council held a meeting on Tuesday,July 22, 2014 at 5:00 p.m., at City Hall with the following members present: Mayor Tim Reed, Council Members Keith Corbett, Dan Hansen, Ope Niemeyer,John Kubal, Tom Bezdichek and Jael Thorpe. Assistant City Attorney Dick Smith, City Manager leffrey Weldon and Deputy City Clerk Bonnie Foster were also present. 5:00 p.m. Executive Session A motion was made by Kubal, seconded by Corbett,to enter into Executive Session at 5:00 p.m. to consult with legal counsel about proposed or pending contractual matters with the City Engineer, Assistant City Engineer, Assistant City Attorney, City Manager, City Council, and Deputy City Clerk present. A motion was made by Niemeyer, seconded by Corbett, to exit Executive Sess+on at 5:58 p.m. 6:00 p.m. Regular Council Meeting Consent A�enda. A motion was made by Corbett, seconded by Hansen,to approve the consent agenda. A. Action to approve the agenda. B. Action to approve the July 8 Counci) Meeting Minutes. All present voted yes; motion carried. First Readin�—Ordinance No. 16-14. First reading was held on Ordinance No. 16-14, an Ordinance amending Chapter 94, Zoning, pertaining to the Brookings Regional Airport Overlay District. Public Nearing: August 26, 2014. First Reading—Ordinance No. 17-14. First reading was held on Ordinance No. 17-14, an Ordinance rezoning the following legal description noted below from Agricultural A and Industrial I-2 District to the Airport AP District(Legal description: Outlot Z in the SW'/.of the NW%, and the W% of the SW%, excluding Anderson's Addition, in Section 26-T110N-RSOW; Airport First Addition, Lot A of Lot 1, Christensen Addition, and Lot 3, Block 2, and Blocks 3, 4, and 5, Grossman Heights Addition, all in the E% of the SW%of Section 26-T110N-R50W; Airport Fourth Addition, and Lots 1, 2, and the N � of Lot 3 in the NW%of Section 35-T110N- R50W;the SE% of Section 27-T110N-R50W, excluding Weiland Addition;the NE%of Section 27-7110N-RSOW excluding the Canadian Pacific Railroad R.O.W., land lying northeasterly of the Canadian Pacific Railroad R.O.W., and Blocks 1, 2, and 3, and lots 1 and 2, Block 4, Rainbow Addition; the NW% of Section 27-T110N-R50W, excluding Sublot B-2 and the Canadian Pacific Railroad R.O.W.;the E%of the SW%of Section 27-T110N-R50W; Outlot 1A, Outlot 2, and Tract 2A of James Addition, in the NE%of Section 28-T110N-R50W; and the Airport Third Addition in the SW%of Section 22-T110N-R50W). First reading was held on Ordinance No. 18-14, an Ordinance amending Division 1 of Article VI. of Chapter 22 of the Code of Ordinances of the City of Brookings and pertaining to Licensing of Rental Dwelling Units in the City of Brookings, South Dakota. Public Hearing: August 12, 2014. First Readin�—Ordinance No. 19-14. First reading was held on Ordinance No. 19-14, an Ordinance amending Article II of Chapter 22 of the Code of Ordinances of the City of Brookings and pertaining to Building Code Variances in the City of Brookings, SD. Public Hearing: August 12, 2014. Ordinance No. 13-14. A public hearing was held on Ordinance No. 13-14, an Ordinance amending Chapter 94, Zoning, creating the Airport AP District. A motion was made by Corbett, seconded by Hansen,to approve Ordinance No. 13-14. All present voted yes; motion carried. 22 � � Resolution No. 53-14. A public hearing was held on Resolution No. 53-14, a Resolution of Intent to Lease Hay Land in Section 11-T109N-R50W to Dennis Welbig. A motion was made by Corbett, seconded by Hansen, to approve Resolution No. 53-14. All present voted yes; mo#ion carried. Resolution No. 53-14- Resolution of Intent to Lease Hay Land in Section 11-T109N-RSOW to Dennis Welbig Be It Resolved by the governing body of the City of Brookings, South Dakota,that the City of Brookings intends to enter into a lease with Dennis Welbig for the period of 2014, pertaining to the following described property: The designated hay land,twenty (20) acres more or less, in Section 11,T109N-R50W in the City of Brookings, Brookings County, South Dakota. The Lease will be an amount of Thirty One Dollars and Ten Cents per acre ($31.10)for hay land, payable on October 1, 2014. Be It Further Nated,that a Public Hearing on this Resolution was held on July 22, 2014 at 6:00 o'clock P.M. in the Chambers of the City& County Government Center and that all persons were given an opportunity to be heard on the intent to lease real property. House Movina. A public hearing was held on moving a two-story building from 417 9th Avenue to the property described as Lot 15, and the W'r4 of the vacated alley, in Block 3, Morehouse Addition, also known as 614 7th Avenue. A motion was made by Kubal, seconded by Corbett,to approve. All present voted yes; motion carried. Resolution No. 54-14. A public hearing was held on Resolution No. 54-14, an amendment to the Vision 2020 Comprehensive Plan regarding the Airport Master Plan. A motion was made by Hansen, seconded by Kubal,to approve Resolution No. 54-14. All present voted yes; motion carried. Resolution No. 54-14-A Resolution Amending the City of Brookings Vision 2020 Comprehensive Plan Whereas,the City Council of the City of Brookings,SD in accordance with SDCL 11-6-18 adopted the Vision 2020 Comprehensive Plan for the City of Brookings, SD; and Whereas,the City Council determined that the Airport Master Plan of said Comprehensive P1an should be amended and supersede the previously adopted Airport Master Plan of the Comprehensive Plan adopted February 11, 2002; and Whereas,the City Planning Commission of the City of Brookings, SD has recommended approval of the Vision 2020 Comprehensive Plan in accordance with SDCL 11-6-17. Now,Therefore, Be It Resolved by the City of Brookin�s,SD that the Airport Master Plan of the Vision 2020 Comprehensive Plan, as amended, is hereby adopted for the City of Brookings, with said plan to supersede the previous Airport Master Plan. The Vision 2020 Comprehensive Plan shall be on file in the office of the City Clerk and is available for public inspection by any interested person. Ordinance No. 1414. A public hearing was held on Ordinance No. 14-14, an Ordinance rezoning Lots 4, 5, and 6, Block 1, Folsom Addition from an Industrial I-1 District to a Business B- 3 District. A motion was made by Niemeyer,seconded by Corbett,to approve Ordinance No. 14-14. All present voted yes; motion carried. Ordinance No. 15-14. A public hearing was held on Ordinance No. 15-14,an Ordinance revising Sections 14-121 and 14-122 of Article IV of Chapter 14 of the Code of Ordinances and pertaining to Dogs and Cats in the City of Brookin�s, South Dakota. Public comment: Dan Kemp, 703 5th St.;Jeanne Mersch, 110 9th St.; Diane Hexem, 501 Main Ave. So.; David Aaron, y 223 6218t"St. A motion was made by Bezdichek to approve Ordinance No. 15-14, failed to receive a second; motion failed. Resolution No. 55-14. A public hearing was held on Resolution No. 55-14, a Resolution of Intent of the City of Brookings to Lease to SGS North American Inc. the following described property in the Research &Technology Center, 803 32"d Avenue, Brookings, SD. A motion was made by Corbett, seconded by Niemeyer,to approve Resolution No. 55-14. A motion was made by Corbett, seconded by Niemeyer,to table Resolution No. 55-14 to the next regularly scheduled council meeting. All present voted yes; motion carried. Review of Council's Studv Session Policv. A motion was made by Reed, seconded by Corbett, to make the following changes to the Council's Study Session Policy to Section 3, General Rules: remove "The Mayor presides over the meeting", change the wording from "No motions would be taken at a study session"to "Only votes on procedural items will be allowed," and strike out the following language regarding public input "unless specifically invited on a special issue." All present voted yes; motion carried. Ad'tourn. A motion was made by Hansen, seconded by Niemeyer,to adjourn. All present voted yes; motion carried.
