An Ordinance amending Article II of Chapter 22 of the Code of Ordinances of the City
of Brookings and pertaining to Building Code Variances in the City of Brookings, SD.
Be It Ordained and Enacted by the Council of the City of Brookings, State of South Dakota, as
follows:
I.
Sec. 22-37. -Variances.
The building code Board of Appeals may authorize, upon appeal in specific cases, a variance
from the terms of this article which is not contrary to the public interest, if, owing to special
conditions, a literal enforcement of the provisions of this article will result in unnecessary
hardship; provided, however, that no variance will be granted unless the spirit of this article is
observed and substantial justice is done.
II.
Any or all ordinances in conflict herewith are hereby repealed.
